The maximum value of all of the orders that may be placed during all of the ordering periods under all of the contracts awarded hereunder is $800,000,000. Each ordering period (CLIN) set forth in the schedule includes an estimated quantity of the dollar value of all orders that will be placed during that ordering period. Offerors should use those estimated quantities for planning purposes and in the preparation of its proposals. Circumstances may change after award such that the Government may need to issue orders which exceed the estimated quantity set forth for any particular ordering period. The aggregate of all the estimated quantities for all ordering periods is $800,000,000.00 which is the maximum amount the Government may order under all the contracts as a whole including option ordering periods if exercised.
The Government, may, however place orders during any ordering period which exceed the estimated quantity for that period as long as the contract maximum is not exceeded. As such, the Government may place orders during the first ordering period which consume the contract total. Any estimated quantity not consumed in an ordering period remains available for use in a subsequent ordering period.
The Government intends to issue a task order to obligate the contract minimum guarantee of $25,000 to each contractor. No minimum guarantees apply to the option periods. This task order to obligate the minimum guarantee will be issued concurrently with the award of the basic contract. Contractors may not invoice against this task order. Once the contractor receives a task order which exceeds the minimum guarantee amount, the minimum guarantee task order will be modify to de-obligate the funds from the task order.
SECTION 00201
I. INTRODUCTION
A. DESCRIPTION OF ACQUISITION
1. This acquisition will result in the award of a Global Petroleum Oil and Lubricants (GPOL) Indefinite Delivery/Indefinite Quantity (IDIQ) Multiple Award Construction Contract (MACC), with a Not to Exceed (NTE) maximum value of $800M for all years. Approximately six (6) contracts will be awarded. The contract will include provision for ordering Firm Fixed Price task orders to provide Sustainment, Restoration and Modernization (SRM), Clean, Inspect and Repair (CIR) and related projects at Department of Defense Facilities Worldwide. The contract will be awarded using competitive negotiated procedures, as it has been determined in accordance with FAR 6.401 to be the most appropriate method of contracting for the subject requirement.
2. The purpose of the Global Petroleum, Oil and Lubricant (GPOL) MACC is to provide SRM and CIR for POL systems at various locations worldwide. The work entails design, engineering, inspection, testing, and construction of POL fuel systems and their various components. The services include all aspects of POL project execution. The award of a MACC will serve to establish long-term contractual relationships with multiple firms to reduce procurement and administrative costs, provide a pool of contractors with the required POL skills, and to provide quality and efficiency in delivery of SRM and CIR solutions for DoD POL systems globally. Task orders performed in foreign countries will be subject to the provisions of the applicable host country Status of Forces Agreement (SOFA) or equivalent treaty.
3. The acquisition strategy is to procure a MACC using unrestricted, full and open competition with a requirement to reserve task orders valued at $1,000,000 or less to Small Business if they are to be performed within the 50 US States, excluding US Territories. The best value continuum source selection process to be used for this acquisition is the tradeoff analysis process as described in FAR 15.101-1.
4. Each contract will contain a base ordering year and four (4) 12-month option ordering periods for a maximum of sixty (60) months. The maximum value of all task orders to be awarded under all ordering periods for all contracts is $800,000,000.
Options will be exercised in accordance with FAR Part 17.207, Exercise of Options. Periods of Performance will be negotiated for each individual task order and based upon the requirements size and complexity of each task order.
5. The Government intends to issue a multiple award contract with a guaranteed minimum amount of $25,000 to each contractor for the life of each contract. The Government anticipates the award of a seed task order to one MACC contractor. The award of the seed task order will fulfill the minimum guaranteed amount for that MACC holder. The maximum value of all of the orders that may be placed during all of the ordering periods under all of the contracts awarded hereunder is $800,000,000. The government anticipates awarding approximately six (6) IDIQ contracts under the MACC, with approximately three (3) of the contracts reserved for small business firms. All offers will be evaluated on the same criteria, however, offers from small business will be ranked separately from offers evaluated and ranked from “other than small business” firms. Task orders will be FFP and generally within the value range of $500K to $12,000,000. Task orders estimated at a value of $1,000,000 or less to be performed within the 50 United States will be set aside for the small business MACC holders only. Small Business Set Aside task orders will be competed amongst small businesses, if less than two Small Business MACC holders respond to the request for task order proposal (RFTOP), a new RFTOP will be solicited from all MACC holders.
II. EVALUATION
A. BASIS FOR AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contracts; to negotiate with offerors in the competitive range; and to award the contracts to the offerors submitting the proposals determined to represent the best value—those proposals most advantageous to the Government, price and other factors considered.
2. The Government intends to evaluate proposals and award the contracts without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced offeror or other than the highest technically rated offeror.
4. All technical factors when combined are of equal importance to the performance confidence assessment (past performance) rating; and all technical factors and the performance confidence assessment (past performance) rating, when combined are approximately equal to price.
5. Any proposal found to have a deficiency in meeting the solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions.
Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.
SECTION - 00210
I. EVALUATION FACTORS FOR AWARD
1. The solicitation requires the evaluation of price and the following non- price factors and sub-factors:
Factor 1 – Corporate Experience Factor 2 – Management Approach Factor 3 – Key Personnel Factor 4 – Project Execution Approach Factor 5 – Safety Factor 6 – Small Business Utilization
Sub-factor 6.A. – Past Performance in Utilization of Small Business Concerns Sub-factor 6.B. – Small Business Participation Factor 7 – Past Performance
Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.
The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity.
2. The relative order of importance of the non- price evaluation factors and sub-factors is the technical factors (Factors 1, 2, 3, 4, 5 and 6 and their respective sub-factors) are of equal importance to each other respectively, and, when combined, are equal in importance to the past performance evaluation performance confidence assessment (Factor 7). When a proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor (the non- price evaluation factors) when combined are approximately equal to price.
The importance of price will increase if the Offerors’ non- price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non- price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.
Utilizing the same evaluation criteria for evaluation purposes, the Source Selection Evaluation Board (SSEB) will document the proposal evaluation findings as follows:
Non-Price and Price Evaluation Findings will be documented in four (4) separate matrixes.
Non-Price Evaluation Findings:
1. One (1) matrix for Unrestricted Business
2. One (1) matrix for Small Business
Price Evaluation Findings:
1. One (1) matrix for Unrestricted Business
2. One (1) matrix for Small Business
The best value decision will be based on a comparative assessment of proposals against all source selection criteria established in this Solicitation Evaluation Criteria and Source Selection Plan. The Government intends to make award to offerors submitting the proposals determined to represent the best value and those proposals most advantageous to the Government, price and other factors considered. The government anticipates awarding approximately six (6) IDIQ contracts under the MACC, with approximately three (3) of the contracts reserved for small business firms.
The Price Factor evaluation will be provided to the Technical Evaluation Team Board after evaluation of all non-price factors other than Past Performance has been completed and evaluation findings have been documented.
