Reference Question 136 00201,IV.(1) (page 14 of

107, 2nd paragraph) Referenced section states that projects submitted for Small Business Corporate Experience are to be valued at approximately $500,000 to $1,000,000. Will Small Business projects that exceed the $1,000,000 value be accepted? The larger projec+C66ts may exhibit a higher level of technical and management ability.

Answer RFP Section 00210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. Projects must have been completed within the last five (5) years of the date of issuance of this RFP. '

137 Factor 2, page 15 of 107 The Factor 2 introduction paragraph states "Additionally, the Government seeks Offerors that can provide a rapid response for both CONUS and OCONUS emergency POL needs. If a Small Business proposer does not intend to participate in any OCONUS task orders would we need to address OCONUS work in our proposal?

Task Orders over $1,000,000 CONUS or OCONUS will be competed among all MACC holders. MACC holders are expected to compete for all task order over $1M CONUS and OCONUS. Proposals failing to provide required and complete information may be rated lower.

Description of Acquisition and IV. Non-Price Evaluation Factors, Factor 1, Corporate Experience

The definition of relevant projects on page 14 includes projects valued at approximately $500,000 to $5,000,000. Under the Description of Acquisition on page 7 a range span of$500K to $12,000,000 is presented for an expected task order. Therefore, can it be assumed a project can be submitted as corporate experience and still be deemed relevant if it meets the500K to 12M value range?

RFP Section 00210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. Projects must have been completed within the last five (5) years of the date of issuance of this RFP. '

139 Page 14, 00201, IV.(1)(i)

Relevant Projects are defined with values $500,000 to $5,000,000 for large businesses. Per the description of the acquisition (page 7), task orders on the contract will generally range from $500K to $12,000,000. Would the government consider increasing the relevant project value to $12,000,000?

RFP Section 0210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. Projects must have been completed within the last five (5) years of the date of issuance of this RFP. '

140 Page 22, 00210, IV.(5)(i)(1) and (2) Both the EMR and DART Rates are requiring submission of information for the previous complete calendar years;

however, the years listed are 2010, 2011, and 2012, and do not include 2013, which is complete. Please confirm that safety data should be provided for 2011, 2012, and 2013.

EMR and DART Rates should be submitted for the previous completed calendar years of 2010, 2011, 2012.

141 Page 8, 00210, I.A.5 Per this paragraph, RFTOPs will be solicited from all MACC holders if not set aside for small businesses. May a large business offeror participate as a team member on a small business team?

Yes, not withstanding any statutaory or regulatory prohibition, Large Businesses may participate as a team member on a small business team.

Page 14, IV. Non-Price Evaluation Factors, (1) Factor 1, Corporate Experience, Relevant Projects

The RFP states that relevant projects for Small Business are to be valued at approximately $500,000 to $1,000,000. Question: Will projects be rated lower if they are outside of the range of $500,000 to $1,000,000?

RFP Section 00210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. Projects must have been

What is the Navy’s expectation of an awardee’s commitment to respond to the variety of and quantity of task orders? Does the firm have the ability to choose not to respond to certain task orders? This information is not included in the solicitation documents.

MACC holders are expected to compete for all task order over $1M CONUS and OCONUS. Each contractor is required to submit a reasonable number of good faith proposals. Contractors are not obligated to propose on all Task Orders; however, they are required to contact the Contracting Officer withing two

(2) days of notification if they cannot participate in the walk through or submit an offer. Failure to provide this notification may impact future consideration for exercising request for task orders and exercise of an option.

144 Page 14, Factor 1

Please clarify why this section requests experience for projects from $500K to $5M, while the task order limit is $12M.

1.6 There appears to be conflicts in the

personnel qualifications required in Factor 3 of the RFP and this specification section, where the qualifications are somewhat less stringent. Please clarify what standards, and whether or not the RFP standard will apply to every task order.

A Small Business may use a Large Business withing the limits in FAR 52.219-14 (C) (4). "Construction by special trade contractor. The concern will perform at least 25 percent of the cost of the contract, not including the cost of materials, with its own employees."

146 Page 99, 00700, 5252.209-

Concerning Conflicts of Interest. Is it considered a conflict of interest if a Contractor or an A/E Firms are on multiple teams? Specifically: a. Could a SB Contractor bid as prime for the SB contract and also support a LB as a sub on an unrestricted contract? b.

Could a SB Contractor bid as prime for the SB contract and also support a LB as a sub on an unrestricted contract?

c. Could a firm be a subcontractor on a SB team and also be a prime for either LB or SB?

Yes, not withstanding any statutaory or regulatory prohibition, Large Businesses may participate as a team member on a small business team.

147 To preserve the integrity of our proposal documents, may we submit the electronic files for Volume 1, Non Price Proposal in Adobe Acrobat PDF (bookmarked and searchable) in lieu of submitting in both MSWord and Adobe Acrobat? (Similar to the electronic submittal requirements for Volume 2, Price Proposal). In addition, signed documents, such as Teaming Agreements, Letters of Commitment, and PPQs will need to be scanned for inclusion into the Proposal. It is much easier to manage the electronic file in Adobe Acrobat.

A hard copy of the proposals is required (Vol 1 and 2), for the electronic copy on a CD, it is acceptable to only submitted in Adobe format, however in DPI format.

148 RFP page 6 of 107 RFP States: Offerors should use those estimated quantities [$800,000,000] for planning purposes and in the preparation of its proposals. Question: For planning purposes should each offeror plan on a set initial ceiling of one-sixth of the estimated 800M in order to calculate program costs.

The estimated Maximum amount per ordering period is $160,000,000.

149 Page 7, I, a.5 Large Business Small Business (SB) Plan - This procurement, having both Unrestricted (UR) and SB awards, and having the SB portion dedicated to projects less than $1 M in CONUS and UR primarily focused on OCONUS work presents a challenge for Large Business to establish a SB plan that is able to set aside significant dollars for SBs. Given that 80% + of the CONUS awards will most likely be set aside and that SB goals for OCONUS cannot be measured, the amount of work estimated to eligible for award to SBs will be very low relative to the $800 M size of the contract. Would EXWC please verify this reasoning to be correct and indicate that you recognize that this will be the case?

The Government can't determined what percentage or dollar amount will be for CONUS or OCONUS work.

150 Page 24, Sec 6, a.c The RFP states: “Provide information on previous, existing, planned or pending mentor-protégé agreements (MPA) under any Federal Government or other program held within the last five years.” Is the five year period of performance cut-off from the beginning of the MPA agreement or the end?

The five year period of performance will be cut off from the end of the MPA.

151 Page 14, Factor 1, Para. 9 The Offeror may utilize experience of a key subcontractor to demonstrate construction experience under this factor.” If subcontractor experience is used, do we have to provide Attachment 4 for this project example?

Many subcontractors perform a major or critical aspects of the work, but are not the prime contractor and therefore have no small business information on the overall project. Also projects that are out of the U.S. do not have SB contract compliance criteria.

Factor 1, para 9 requires contractors to submit a letter of commitment and explanation of the meaningful involvement if a key subcontractor expirience will be use for Factor 1. Attachment 4 is only related to Factor 6 - Small Business Utilization ( see Page 25, letter for instructions.

152 Page 13,Sec 00210, III.(b) Per the basis of evaluation, the Government will conduct a price analysis based on the offeror submitted total Price for the Seed task order price to assess fair and reasonable price. Because no level of detail for pricing is to be provided (just Schedule of Price CLIN 0001), we assume that a cost realism analysis is not being conducted. Please confirm.

The Government will evaluate the price proposal for compliance with the submission requirements and price reasonableness in accordance with Price Basis for Evaluation, Page 13 of the Solicitation.

153 Page 20, Sec 00210, IV. 3 (i)

155 Page 7, Sec 00201, I.A.5 We understand that the EXWC POL MACC will have a requirement to reserve task orders valued at $1,000,000 or less for Small Business if they are to be performed within the 50 US States, excluding US Territories. a. Please confirm that CONUS task orders greater than $1,000,000 will be competed with all six MACC holders, both Small Business and Large Business. b.

Please confirm that all OCONUS task orders, will be competed with all six MACC holders, both Small Business and Large Business

Task Order estimated at a value of $1,000,000 or less to be performed within the 50 United States will be set aside for the small business MACC holders only.

Task Orders over $1,000,000 CONUS or OCONUS will be competed among all MACC holders. See page 7 of the solicitaiton.

156 Page 17, Sec 00210, IV. (3) May we submit more than one resume per position as long as we remain within the page limitation? Amend 0002 Response # 102

Multiple resumes are allowed, evaluation will be in accordance with the factor basis of evaluation (see page 20-21 of the Solicitation). Page limitation remains 200 pages.

Please confirm that safety EMR and DART data should be provided for 2011, 2012, and 2013. Amend 0002 Response # 103

EMR and DART Rates should be submitted for the previous completed calendar years of 2010, 2011, 2012.

158 Page 14-15-34, Sec 00210, IV (1) (i) (ii) and Att 2

Please confirm if the requirement is 5 construction projects only or 5 construction and 5 design projects, or a total of 5 construction and design projects. The first row of the form Attachment 2 (page 34) has check boxes for 5 construction projects and 5 design projects. The form also has separate blocks for Construction Projects (Block 7) vs. Design Projects (Block 8). Our interpretation of Factor 1 is that a maximum of 5 relevant projects are requested. Relevant projects are construction, SRM, CIR, repair of liquid fuel pipelines, repair of fuel system support facilities, and CP projects. These are construction/repair projects and therefore our proposal should only include construction/repair projects.

Construction Experience Project Data Sheet can be altered and should not exceed two pages. This is a standard NAVFAC form, therefore captures Construction and Design projects, contractors can modify to delete the row for design projects. In accordance with Factor 1, "Submit a Corporate Experience Project Data Sheet for a minimum of three

(3) to a maximum of five (5) relevant construction projects that the offeror completed and serve as a prime construction contractor that best demonstrates experience on relevant projects within the past five (5) years" (page 14 of the Solicitation).

159 Page 19-20, Sec 00210, IV (3)

The positions of Site Manager, QCM and SSHO have detailed credentials and are to be full time employees of the prime contractor. During the execution of a project award and as will be used for pricing the Seed Project, there is no delineation of the staff required to be on site during construction. Specifically, will 2 independent persons be required on site during construction; Site Manager/QCN and SSHO or can a Site Manager also be QCM and

SSHO?

The Contractor shall provide a Safety oversight team that includes a minimum of one (1) person at each project site to function as the Safety and Health Officer (SSHO). (See Part 2, Sec 01 35 26.05 20 Page 6 of the GPOL MACC SOW Combined Part 2- 6).

160 Page 99, Sec 00700, Clause 5252.209-9300

Concerning Conflicts of Interest. Is it considered a conflict of interest if a Contractor or an A-E Firm are on multiple teams? Specifically: a. Could a LB Contractor also be a sub on a SB team to support A-E or other efforts?

161 Amendment No. Page Sec Para 1

Will you provide an extension to the due date considering that the amendment and TO PWS was released one week later that initially scheduled?

The Proposal Due Date has been extended from 26 Mar 2014 to 09 April 2013 no later than 2:00 PM PST.

162 Please confirm the due time for proposals to be received. Amendment 1 indicates March 26th at 2:00PM PST, however the Seed Project RFP included with Amendment 2 indicates March 26th at 2:30PM PST (Section 00100, Paragraph D).

Proposal due date has been extended from 26 Mar 2014 to 09 April 2014 no later than 02:00 PM PST.

See Amendment 0004.

163 Will the Navy have someone to receive proposals until 2:00 PM the originally stated time or only until 12:00 pm (noon) as stated in the original RFP Document, Page 10, Section II, paragraph C. (i)?

A Governemnt representative from NAVFAC ACQ EXWC will be standing by the Pass and ID Office, inside Building Number 1183, at Sunkist Gate, Naval Base Ventura County, Port Hueneme CA on the morinig of 09 Apr 2014, from 10:00 AM to 12:00 PM local time to receive offers to this solicitation.

164 Amendment Block 11 Does the government expect to receive all pages comprising an amendment within the price proposal or only the 1st page of the Amendment which contains the signature?

Offeror must acknowledge receipt of each amendment by completing and submitting Page 1 of each amendment (SF30). Amendment pages will not count towards the page limitation of 200 pages.

165 Sec 00210, II Can the Required Forms (SF1442, Amendments, Bid Bond) be excluded from the 200 page limit for both volumes? It is hard to determine total page count when we cannot anticipate the number of Amendments, nor the number of pages comprising an Amendment.

SF1442, Amendment SF30 pages are excluded from the page limitation. Bid Bonds will count towards the page limitation of 200.

166 May we submit the electronic files for Volume 1, Non Price Proposal in Adobe Acrobat PDF (bookmarked and searchable) in lieu of submitting in both MSWord and Adobe Acrobat?

This will make it much easier to incorporate signed documents, such as Teaming Agreements, Letters of Commitment, and PPQs into our electronic files.

A hard copy of the proposals is required (Vol 1 and 2), for the electronic copy on a CD, it is acceptable to only submitted in Adobe format, however in DPI format.

167 Sec 00210, II Can the Required Forms (SF1442, Amendments, Bid Bond) be excluded from the 200 page limit for both volumes? It is hard to determine total page count when we cannot anticipate the number of Amendments received, nor the number of pages comprising an Amendment.

SF1442, Amendment SF30 pages are excluded from the page limitation. Bid Bonds will count towards the page limitation of 200.

168 Page 14, Sec 00210, IV (1) Will construction projects submitted by SB GPOL offerors that exceed $1M in size be considered relevant?

RFP Section 00210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. Projects must have been

169 Can SB GPOL offerors submit both CONUS and OCONUS projects and be considered relevant?

Refer to definition of Relevant Project, page 14 of the Solicitation. "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $5,000 000 for Large Business, $500,000 to $1,000,000 for Small Business. Projects must have been completed within the last five (5) years of the date of issuance of this RFP".

170 Sec 00010 There is only one seed project that will be completed in a 365 day period (Base Year) and yet the Solicitation Form asks for a NTE Amount Price for the Base Year followed by a price for each of the follow-on Second, Third and Fourth Option Years. Specifically, what Pricing is being asked for in the option years and how is it expected to be calculated and evaluated by your Team? On what cost or condition is the Option Year pricing based?

171 General Question It is important for the Contractors to have as much information on the existing tank as possible. This is especially importanat with regards to dimensions, tolerance, and the "as built" internal conditions of the Tank. A contractor needs this in order to plan for and obtain good supplier and subcontractor bid prices for the installation of the new floating roof and to better understand the internal piping, nozzles, overflows and safety systems. Currently all the government is providing is very basic information and general tank diameters and information. Typically, a contractor could expect a tank drawing of some type for an existing tank on which to base his estimate. Can we expect to receive copies of the "As Built" drawings for these tanks or type of tanks on which to base our cost estimates and bid? Will they show the internal piping and nozzle configurations that must be protected?

See Drawings incorporated into the Solicitation via Amendment 0005.

172 General Question The availability, access to and cost of the water provided by the Government is still a big question. Can the Contractors expect to be able to access and utilized the fire hydrant water that is available on or adjacent to each site for the Tank Cleaning phase of the project? If so is there any cost or charges or special permits thar are needed to do so?

There are fire hydrants available in the proximity to obtain water from. The contractor shall notify the government (to relay to base fire) 10 work days prior to planned use.

Refer to Part 2 01 50 00.05 20 1.6 Temporary Utilities.

173 General Question Due to the lateness of the issuance of Amendment 0003 and the delayed Site Walk and the numerous questions raised at the event, can a postponement of the Due Date for this Solicitation be requested? This request will only benefit the Government by allowing Contractors the time they really need after a job walk to assemble a better cost proposal using the questions and information requested during that event. Most all of the Contractors at he Job Walk fell that March 26th is too short a time to assemble and received the preferred and best pricing we can to provide the "Best Value Price" sought by the Government. DPSI, therefore, requests that your office considered a two week extension of the Bid Date for this Solicitation in order to obtain the requested information needed from your office ans use it in our proposal.

The Proposal Due Date has been extended from 26 Mar 2014 to 09 April 2013 no later than 2:00 PM PST.

174 SF30 Para 14, Proposal Due Date

We are experiencing difficulties with subcontractor pricing due to the short timeline for proposal submission after the site walk. We request an extenstion to the due date to 9 April 2014 (two weeks) to allow for quality pricing and schedule development with our team.

The proposal due date has been extended to 09 April 2014 no later than 02:00 PM PST. See Amendment 0004.

175 IV, (2), (5) What is the acceptable minimum bond capacity limit for small business proposals for this IDIQ contract for each contract year per project and the aggregate?

In accordance with FAR Clause 52.228-1 ( c), The amount of the bid guarantee shall be 20% percent of the bid bond or $3,000,000 which ever is less. A $3,000,000 is acceptable.

176 Seed Project RFP Sec 00010

The SF 1442 and the Seed Project RFP state that offers shall be valid for 90 calendar days from the date proposals are due. In the preproposal conference, the government stated that it intended to award the contract project by the end of the calendar year. For the purposes of the seed project schedule, should we use June 24, 2014, as the award date, or should we use some other date?

Per Seed Project, RFP Part 1, Price shall be considered available for award for 90 calendar days form the date proposals are due.

177 Seed Project RFP Sec 00100

During the site visit, it was noted that the government did not take into account the limited number of tanks that were to be out of service when it calculated the 365-day period of performance (POP). Taking into consideration this limitation as well as the 60-day notices and other required government review time, we suggest increasing the POP to 730 days as the current POP does not appear to be realistic.

The Seed Project Period of Performance has been extended from (365 days) 12 months to 22 months.

178 Page 2, 01 14 00.05 20, Para 1.3.f

Will one bulk tank and one ready service tank be available immediately at contract award, or will we need to provide 60 days’ notice for the first tanks to be taken out of service?

After a government notice to proceed is made, a 60-day notice will need to be requested for initial bulk and ready issue tanks to be made available to the contractor. After all scope work for a tank is completed and it is ready to be returned back to the government, the government will have the next tank ready for turnover to the contractor within 10 working days.

179 Page 5, Sec 01 14 00.05 20, Para. 1.4.3

The working hours mentioned during the site visit were different than the working hours in the specifications.

Please clarify the hours that contractors will be able to work.

See Part 2, Specification 01 14 00.05 20, 1.4.3 Work Hours and 1.4.4 Work Outside Regular Hours. (Note Normal working hours should be 0600 to 1500 for normal work week day.)

180 So that offerors can provide accurate costs for repairs, please provide as-built drawings.

See Drawings incorporated into the Solicitation via Amendment 0005.

181 Page 1, Sec 01 14 00.05 20 Para 1.3(b)

We understand that the government will drain each tank before the repairs are made. Please confirm that the government has tank-to-tank fuel transfer capability available for the ready-for-service inspections of the tanks.

Yes, the government has means to transfer fuel from tank to tank.

182 Page 1, Sec 01 14 00.05 20 Para 1.3.(b)

What is the anticipated duration for the government to transfer fuel between tanks after one tank is returned to service and the next tank opened for inspection?

After a government notice to proceed is made, a 60-day notice will need to be requested for initial bulk and ready issue tanks to be made available to the contractor. After all scope work for a tank is completed and it is ready to be returned back to the government, the government will have the next tank ready for turnover to the contractor within 10 working days.

183 Page 1, Sec 13.A The due date says it is due 26 Feb 2014 however it states in the delivery instructions

The proposal due date has been extended to 09 April 2014 no later than 02:00 PM PST. See Amendment 0004.

184 Page 7, Sec 1.A, Para 5 Is there an expected release date for the seed task order?

MACC with large and small business participation and some work is to be performed outside the United States or its outlying areas and therefore is not subject to FAR 19.704 and 52.219-9, can the government please provide the dollar value or percent of total program value ($800M) that we should use as the Total Contract Value?

The estimated Maximum amount per ordering period is $160,000,000. Refer to Solicitation Section 00100, CLIN-Item number 0001-0005.

192 Page 1, Sec 13, Para A. With the issuance now of amendment 3 and the lateness of the receipt of the initial seed project, will you consider extending the due date?

The proposal due date has been extended to 09 April 2014 no later than 02:00 PM PST. See Amendment 0004.

193 Amendment 0002 In response to questions regarding font size for graphics (e.g., Q #24), you indicated that tables/charts can be font size 10; however, you didn’t indicate the font style…is the font still required to be Times New Roman or can we substitute another sans serif typeface (such as Arial) to set graphics apart from text?

Yes, tables and charts can be landscape format and can be font size 10. Another font style can be used.

194 Amendment 0002

In response to questions (Q #8), you indicated that task orders over $1M CONUS or OCONUS will be competed among all MACC holders (including SB firms). However, in other questions (e.g., Q#135), you seem to indicate (via underlining) that for SB projects for Factors 1 and 7 to be relevant, the project value needs to fall between $500,000 and $1,000,000. Since SB firms, as MACC holders, will be asked to compete on projects >$1M, doesn’t it follow that projects submitted by SB firms >$1M would be considered relevant? Please clarify.

RFP Section 00210, Factor 1 corporate Experience has been changed as follows: "Relevant Projects include, but are not limited to; worldwide Petroleum, Oil and Lubricants (POL) Fuel System construction projects, sustainment, restoration and modernization (SRM), cleaning, inspection and repairs (CIR) of bulk liquid fuel tanks, repair of liquid fuel pipelines, repair of fuel system support facilities and cathodic protection repair projects valued at approximately $500,000 to $12,000 000. 200 Page 12, Sec III, (a)(ii) The solicitation states the SEED task order price is to be submitted on NAVFAC 4330-43. In review of NAVFAC 4330-43, the indirect cost pools and formulas do not correspond to our DCAA approved accounting structure. In order to submit a compliant and accurate cost, the formulas will need to be adjusted to match our accounting system and an explanation provided in the comments section. Is this going to be acceptable?

Yes, the offeror is permitted to tailor the NAVFAC 4330-43 so that the presentation by cost element, indirect cost rates and their application to base costs, is consistent with the company established and/or Government acknowledged cost accounting practices.

It is also permissible for the offeror to provide detailed subsidiary cost and rate schedules or comments to show and explain how amounts under the company established cost presentation were summed for purposes of presenting on the NAVFAC 4330-43. A combination of the two presentation approaches is acceptable as well.
