SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
AMENDMENT 0001
The purpose of Amendment 0001 is to make the following changes:
1) Responds to Pre-Proposal Inquiries 9-74.
2) Amends Section B, Note J, Paragraph 7 to include “percentage to be determined at the delivery order level.”
3) Removes Clause G-216-H003 Ordering Process for Multiple Award Contracts (MACS) (NAVSEA)
(JAN2020).
4) Modifies Section L to remove the following statement “…and the technical proposal should be enclosed in a sealed envelope marked “TECHNICAL INFORMATION – NOT TO BE PUBLICLY
DISCLOSED”.”
5) Modifies Section L to remove the Volume III Past Performance page limitations.
SECTION B - SUPPLIES OR SERVICES AND PRICES
The following have been modified:
NOTES A-O
NOTE A: Offeror shall complete the "Price Group" and "Estimated Total Price" blocks of each data item on the
Contract Data Requirements List(s), attached to individual Delivery Orders.
NOTE B: Because there are firm fixed price (FFP) CLINs included in this solicitation, a DCAA approved cost accounting system is not required to be eligible for award of a prime contract. However, it is contemplated that cost type orders will be issued. Successful awardees would not be eligible to receive a cost plus fixed fee (CPFF) or flexibly priced delivery order, in accordance with FAR 16.301-3, until a pre-award survey of the offerors accounting system design complies in all material respects with the criteria contained in the Pre-award Survey, SF1408, Attachment S-6. The Government shall use a Forward Price Rate Agreement (FPRA) for this evaluation and for all
Delivery Orders. However FPRA may be negotiated each year by the Administrative Contracting Officer (ACO) after award. The Government will initiate requests for accounting system reviews for any successful Offeror that does not currently have an approved system after awards have been made from this solicitation. Documentation will be provided to the successful awardees that will need to be completed and returned to the Government before the audit request can be initiated. Financial capability reviews are conducted by DCMA. Documentation for this review will need to be provided to DCMA upon request by the Government. This will be required after award has been made so no submission is required with the current proposal. A DCAA approved cost accounting system is not required to use Travel cost reimbursement CLINs 0X17 and 0X18.
NOTE C: CPFF CLINs 0X02, 0X04, 0X06, 0X08, 0X10, 0X12, 0X14, 0X16 will remain unpriced without a NTE
Ceiling. Orders may be placed against these CPFF CLINs using the remaining ceiling limits of Sister FFP CLINs.
For example: if the NTE ceiling on CLIN 0003 is $10,000,000 then that ceiling is shared with CLIN 0004.
NOTE D: The Facilities Capital Cost of Money (FCCOM) is not a fee bearing cost under this contract. However, such amount is included in the total estimated cost for the purpose of the “LIMITATION OF COST” clause in this contract.
NOTE E: For ordering Kitting Material in support of CLINs 0X01, through 0X12, see Section C Provisioned Items
Orders C-217-H003 Alternate II (NAVSEA) (Oct 2018). The fixed fee in any orders placed in this section shall be no greater than (5%) of the total estimated cost of any kitting and prototype materials. (Fee percentage to be negotiated by the ordering officer upon placement of the order.)
NOTE F : Supplies/services under all CLINs are subject to Special Contract Requirements entitled
“FAIR OPPORTUNITY PROCESS (ORDERING PROCEDURES)”
NOTE G : Reserved
NOTE H: Travel costs are not fee-bearing costs under this solicitation and subsequent orders. The Contractor shall obtain prior written approval by the ACO per trip occurrence. All estimated and incurred travel costs shall be in accordance with FAR 31.205-46.
NOTE I: Contract Data Requirements List (CDRLs), DD Form 1423, will be issued under each Delivery Order when required.
NOTE J: FULLY BURDENED SHIP REPAIR LABOR AND MATERIAL BURDEN RATES (CEILING
RATES)
1. The Contractor’s proposed fully burdened ship repair labor rate will be used as a ceiling for negotiating Firm
Fixed Price (FFP) delivery orders, growth work, and new work to be performed under this IDIQ-MAC. The fully burdened ship repair labor rate is a fixed hourly rate that includes all wages, overhead, general and administrative expenses, Facilities Capital Cost of Money (FCCOM) and profit. The fully burdened ship repair labor rates (straight time) represent the respective ceilings for the blended labor rates of the offeror, including labor transferred between divisions, subsidiaries, or affiliates of the offeror under a common control.
Delivery order modifications shall include only direct production man-hours as the fully burdened ship repair labor rate includes all production support functions (whether charged directly or indirectly by the offeror’s accounting systems). For these purposes, direct production man-hours are those hours expended in direct production as exemplified but not limited to the following functions:
Abrasive Cleaning/Blasting
Brazing
Burning
Carpentry
Design Support
Diesel Mechanics
Electrical Work
Electronic Work
Engineering
Fire Watch
General Labor
Lagging
Machinists (inside and outside)
Painting
Pipefitting
Rigging
Sheet-metal Work
Shipfitting
Staging/Scaffolding
Welding
Labor hours for production support functions shall not be separately proposed. Examples of production support functions include but are not limited to:
Administration
Cleaning (except tank cleaning)
Execution Planning
Lofting
Material Handling & Warehousing
Other Indirect Support
Project Management
Program Management
Purchasing Staff
Quality Assurance
Safety/Environmental
Scheduling
Security
Supervision (all types, including, but no limited to supervision of trades, support personnel and subcontractors).
Surveying
Testing
Transportation
Note: Offers shall provide the list of labor categories used to price Attachment J-20 under each CLIN Section
(see Attachment J-20).
2. Consumable materials are goods used in the ordinary course of work performance such as office supplies, paper, rags, vehicle or equipment fuel costs, cleaning chemicals, disposable tools, welding rods, paint buckets, paint brushes, protective clothing, etc. that are consumed/used in the process of repair and do not become an integral part of the repaired vessel. Consumable material shall not be separately priced but shall be included in the contractor’s proposed fully burdened ship repair labor rate (Attachment J-20).
3. Physical materials are goods that become an integral part of the repaired vessel in the course of the repair, such as equipment, replacement steel, pipes, paint, and fasteners. The material mark-up rates apply to physical materials but not to consumable materials. The mark-up will be applied to the actual cost of the physical material. Actual cost does not include handling charges, general and administrative cost, overhead, profit, or any other indirect cost.
4. For contract changes involving subcontractors, subcontractor quotes will be treated as Other Direct Costs (ODCs) and will be subject to the contract material burden rate shown in paragraph (7) below. Subcontractor quotes must be competitively acquired and submitted with the contractor’s Change Order Price Analysis (COPA) in response to
Request for Contract Changes (RCCs) and Reservation Task Requests (RTRs) issued by the Contracting Officer
(SEE Section C-15.1.3 Paragraph 2). At no time will the proposed total to be performed by the prime contractor combined with subcontractor quote, material quote, and applicable burdens be allowed to cost more than it would have, had the prime contractor directly provided all material and labor. The proposed total pricing restriction addressed in the preceding sentence does not apply in any case where the work is required to be performed by
Original Equipment Manufacturers (OEMs), Government directed subcontractors, and/or Government authorized vendors. RCCs and RTRs that are subcontracted for material only (no associated labor required within the RCC) shall not be subject to the Material Burden Rate.

7. In the event of an extension due to excusable or compensable delay, the Contractor’s fully burdened ship repair labor rate shall be escalated by [percentage to be determined at delivery order level] commencing 3 months after the
Attachment J-3 “Contract Complete” date. This rate shall be escalated quarterly through the 24th month, if necessary, following the “Contract Complete” date and shall be used to negotiate all growth and new work. The material burden rate shall not increase.
NOTE K: IDIQ MAC I HOLDERS that have the capability of performing all work both CONUS and OCONUS.
MAC I will include all CLINs: 0X01 -0X18.

NOTE M: IDIQ MAC III HOLDERS that have the capability of performing all work for PM, FM, CC, Ship
Assessment CONUS and OCONUS. MAC III will include CLINs: 0X09-0X18.
NOTE N: LEVEL OF EFFORT TO COMPLETION – SHIP REPAIR (Fill-ins to be completed at the Delivery
Order Level)
1. The Contractor agrees to provide the Level of Effort to Completion (LOE to Completion), which shall be (to be filled in at delivery order level) man-hours and $(to be filled in at delivery order level) materials in the performance of growth CLINs.
2. The total LOE to Completion for the performance of the above CLINs shall be man-hours of direct labor and the associated material required to support that labor and effort. The mix of labor and material may be adjusted, but may not exceed the dollar value of each CLIN listed above.
3. Effort performed in fulfilling the LOE to Completion obligations specified above shall only include effort performed in direct support of this contract and shall not include time and effort expended on such things as local travel to and from an employee's usual work location, uncompensated effort while on travel status, truncated lunch periods, work (actual or inferred) at an employee's residence or other non-work locations.
4. LOE to Completion labor hours and material are within the general scope of the work stated in the contract and may not be used to: (1) direct a change as defined in, "FAR 52.243-1 CHANGES FIXED -PRICE clause of this contract or (2) change any of the terms or conditions of the contract.
5. If, in the opinion of the Contractor, any effort directed in the Growth Management Request Form (Attachment J-
18) calls for effort outside the scope of the contract, the Contractor shall notify the Contracting Officer in writing within two (2) working days after the receipt of any such direction. The Contractor shall not proceed with the work affected by the Growth Management Request Form (Attachment J-18) unless and until the Contractor is notified by the Contracting Officer that the directed work is within the scope of this contract. Thereafter, any remaining disagreement on the scope issue shall be a dispute under FAR 52.233-1, the Disputes clause; however, nothing in this clause shall excuse the Contractor from proceeding with the subject growth work as directed by the Contracting
Officer.
NOTE O: SPECIAL AGREEMENT FOR GROWTH WITH A VALUE OF $25,000 OR LESS (Fill-ins to be completed at the Delivery Order Level)
To make administration of small dollar value growth more efficient and less costly, both parties
(Government and Contractor) agree to a pre-priced value for individual growth items with an estimated price of
$25,000, or less. The contract will include a firm fixed price (FFP) for growth valued at $25,000, or less. Zero-dollar changes and administrative contract changes (for example, a drawing revision change where no additional work is required) shall not be executed using the Small Dollar Value Growth procedures, but will follow the change RCC process.
1. The amount included in this Contract for the growth described above shall be equal to a maximum quantity of [to be filled in with Delivery Order solicitation] occurrences for growth work computed at a firm fixed price of $[to be filled in with Delivery Order solicitation].
2. A Waterfront Circuit Team comprised of a small group of Contractor and Government representatives shall administer the special agreement for growth with a value of $25,000 or less. The Contractor shall establish a group of empowered representatives who will be located in close proximity to the ship during the availability period and who will interact with a similar group of Government representatives (also to be located in close proximity to the ship and to be identified by the Naval Supervising Activity (NSA)). Specific arrangements for the Waterfront Circuit
Team shall be mutually agreed to between the Contractor and the NSA.
3. The Contractor shall report proposed growth work through the normal CFR process in accordance with contract terms. The Government may also independently identify growth work. No later than 24 hours after the final approval of the Condition Found Report (CFR), the Waterfront Circuit Team shall use best efforts to determine if the proposed growth is $25,000, or less, and document the agreed to technical scope of work. The Contracting
Officer shall direct the commencement of all growth work. Directed growth work will be followed by documentation to appropriately reflect specification changes.
4. The Contractor and the Contracting Officer shall develop a growth work tracker to identify and record the number of directed occurrences under this Note. All growth meeting the criteria of paragraph 1 above shall be accepted under this clause without delay and disruption in ship redelivery.
5. When the quantity of occurrences for Small Dollar Growth is depleted, the Small Dollar Growth process shall revert to the LOE to Completion process for remaining growth.
6. Within (to be filled in at delivery order level) days after the end of the delivery order period of performance, the
Contractor and Contracting Officer, utilizing the growth work tracker, shall determine the number of pre-priced occurrences not directed under this contract. Accordingly, the Contracting Officer will decrease the contract price by an amount calculated by multiplying the remaining number of occurrences by the pre-established FFP per occurrence.

Volume IV – Pre-Award Information mailto:erica.fetter@navy.mil mailto:brian.romano@navy.mil
(2) The Offeror shall structure the Proposal so information provided for each section is as comprehensive as possible. The information provided for each section should be sufficiently self-contained to minimize the need to refer to other Proposal sections for evaluation purposes. If cross-references are needed, page and paragraph numbers shall be included.
(3) Four separate volumes: Volume I (Price), Volume II (Technical Capability), Volume III (Past
Performance), and Volume IV (Pre-Award Information) are required. The Technical volume shall consist of no more than 90 pages when printed out. There is no limit on the number of pages that can be submitted for the
Price and Past Performance and Pre-Award Information volumes. The Offerors shall ensure consistency, defined as “free from variation”, between the Technical proposal and Price proposal. During the course of evaluating the Price and Technical proposals, the Contracting Officer will validate that the Technical proposal and Price proposal are consistent. Specifically, the prices proposed will be evaluated and verified using historical and current market information to confirm prices proposed are reasonable and consistent with the technical approach. Any inconsistencies between the Technical and Price proposals may be viewed as weaknesses and/or risks in the proposals, and the offer may, at the Government’s discretion, be considered unacceptable and eliminated from competition for award.
(4) To ensure that each Offeror’s proposal is uniformly formatted, the following rules apply for the preparation of proposals. The Proposals must be sized properly for being printed out onto 8-1/2" x 11" paper, except the
Price Proposals. The proposals must be prepared using the Times New Roman typeface at a font size no smaller than 12-points. Margins shall be a minimum of one-inch top, bottom and both sides.
(5) Offerors are cautioned that, in accordance with the clause “Instruction to Offerors-Competitive
Acquisitions” (FAR 52.215-1), the Government intends to award a contract on the basis of initial proposals received, without discussions. Therefore, each proposal shall contain the Offerors’ best terms from a price and technical standpoint.
B. Solicitation Responsiveness. Offerors are advised to submit Proposals that are complete, clear, and consistent in all respects without the need for additional explanation or information. Offerors are cautioned against the use of general, vague, or unsubstantiated statements, which prevent concise proposal evaluations. Each factor will be evaluated on how well the response meets the requirements of the solicitation. The response that completely addresses all of the solicitation requirements may be judged superior to the response that minimally addresses solicitation requirements.
C. Offerors must comply with specific information under the heading called Submission Requirements found with
“Technical Proposal”, “Past Performance”, “MSRA Equivalency” and “Price Proposal.” Failure of the Offeror to comply with all aspects of solicitation requirements located within the “Technical Proposal,” “Past Performance,” or
“Price Proposal” section may, at the Government’s discretion, render the proposal unacceptable, and the Offeror may be eliminated from competition for award.
D. Competitive Range. If an award is not made on the basis of initial proposals, the Contracting Officer will make the determination as to which proposals are in the “competitive range.” The competitive range shall be determined based on the results of the evaluation of initial Technical, Past Performance, and Price proposals, considering all evaluation criteria, and shall include the most competitive proposals. The number of proposals within the competitive range may also be reduced if the Contracting Officer determines the number of most competitive proposals that might otherwise be included within the competitive range exceeds the number at which an efficient competition can be conducted.
