Industry Questions Post RFP release 20 December 2011
Reference: H-2 Paragraph 1.a and 1.b; H-1 Paragraph 4.4 and 5.5
We read the two statements at H-1 Paragraph 1.a and 1.b to mean that if the awarded contractor receives either a Mishap, HAZREP or a CAR (Major) during a quarter, as defined in H1 Paragraph 4.4 and 5.5, then the contractor would not be eligible for an award fee during that quarter.
1) Is our reading of H-2 Paragraph 1.a and 1.b correct?
Answer: Yes, though it should be noted that H-2.1.b also includes critical, repeat, and cure CARs, and receipt of any of these will also result in ineligibility for incentive.
2) Will the Government provide historical data that provides the number of these type incidents experienced in the past 8 quarters for the current contractor.
Answer: The Government considers the historical data/performance irrelevant as a response to this question. The thresholds for the Safety and Quality Measurements are requirements of the Government, and are defined in the PWS paragraphs 8.1.1 and 8.1.2. Per H-2, the thresholds must be met for any incentive eligibility.

3) Given the… changes to required content for Section L as well as … M, we request that you provide a further extension for the due date of proposals to 20 Jan 2012.
Answer: The Government has considered the request carefully, but the proposal submission date remains 12 January 2012.
