Section H - Special Contract Requirements

H-1 Performance Evaluation In order to avoid disruption to CNATRA’s mission, the Government has established three areas critical to the Contractor’s performance. These three areas (Safety, Quality, and Performance) form the Performance Measurement Framework (PMF), and are detailed in Section J, Attachments 4, 5 and 6, to this contract. In each area the Government has established Contract Minimums it expects from the Contractor’s services, to be found within the Performance Work Statement (Attachment (1)). The Government reserves the right to utilize any other remedies available under this contract.

The PMF will be utilized to assess the Contractor’s performance, and to provide a record on the Contractor’s performance during a specific period of time.

Upon conclusion of the transition-in period, the Government will evaluate the Contractor’s performance for each (three-month) quarterly performance period. All calculations for the PMF assume a quarterly evaluation period, however, the first performance period is two months. Each measure will be weighted in accordance with the following table for determining a quarterly PMF Evaluation Factor. In the event a mishap occurs during an evaluation period and is still under investigation when the quarterly evaluation would normally be expected, the evaluation may be withheld until the mishap investigation is concluded.

EVALUATION MEASURE WEIGHTING WITHIN THE

AIMD PERFORMANCE MEASUREMENT FRAMEWORK

SAFETY

QUALITY

PERFORMANCE

TOTAL

40% 30% 30% 100%

Example PMF Evaluation Factor Calculation If in a given performance period, the PMF measures were determined by the ACO in accordance with the appropriate guidance of Section J, Attachments 4, 5 and 6 to be:

Safety Measure (SM) = 0.85 Quality Measure (QM) = 1.0 Performance Measure (PM) = 1.006375

Then, PMF Evaluation Factor = 0.40(0.85) + 0.30(1.0) + 0.30(1.006375) = (0.340 + 0.300 + 0.302) = 0.902 or PMF Evaluation Factor = 90.2%

Calculated values shall be rounded to three decimal places.

H-2 Performance Incentive (CLINs 0X13) The Contractor must at least meet Contract Minimums for all three components (Safety, Quality, Performance) of the Performance Measurement Framework (PMF) to be eligible to earn the performance incentive. The PMF compoenent metrics to meet, as noted in the Performance Work Statement (PWS) Section 8, are as follows:

AIMD Safety Metric Contract Minimum = no mishaps or HAZREPs per quarterly evaluation period.

AIMD Quality Metric Contract Minimum = no major, repeat, critical, or cure CARs per quarterly evaluation period.

AIMD Performance Metric Contract Minimum = turnaround time (TAT) of less than or equal to 6.0 days and return components to a ready for issue (RFI) rate of 0.9 (90%).

The Government has established a potential Not to Exceed (NTE) limit of $250,000.00 performance incentive per fiscal quarter to be earned by the Contractor. The incentive fee to be awarded for the quarter is a function dependent on the extent to which the Contractor exceeds the minimum Performance Measure (PM) requirement of the Performance Measurement Framework (PMF), i.e., the extent to which PM exceeds 1.0 for the quarter. See Section J, Attachment 6, for PM calculation methodology. The contractor is not eligible for any incentive if the minimums for Safety Metric or Quality Metric are not met. Furthermore, no incentive fee will be earned or awarded if the PM achieved is 1.0 or less during the fiscal quarter. The incentive is determined as:

file_2.png file_3.wmf if PM > 1.0 for the quarter, and where the resultant from the evaluation of the factor file_4.png file_5.wmf is rounded to three significant decimal places.

Example Incentive Calculation If in a given fiscal quarter, the PM was determined to be 1.013875, then file_6.png file_7.wmf file_8.png file_9.wmf file_10.png file_11.wmf file_12.png file_13.wmf

Any performance incentive earned will be paid under the applicable PMF performance incentive SLIN 0X13XX pertaining to the associated quarterly performance/evaluation period. The ACO will issue a task order to the Contractor following the quarterly evaluation period once the actual performance has been verified and documented. The task order will note the amount of incentive earned as a firm fixed price (FFP) for that period based on the calcuations above.

H-3 Reimbursement of Travel, Per Diem

(a) Area of Travel. Performance under this contract may require travel by contractor personnel. If travel, domestic or overseas, is required, the contractor is responsible for making all necessary arrangements for its personnel. (2) When transportation by privately owned conveyance is authorized, the contractor shall be paid on a mileage basis not to exceed the applicable Government transportation rate as contained in the FTR, JTR or SR. (3) The contractor agrees, in the performance of necessary travel, to use the lowest cost mode commensurate with the requirements of the mission as set forth in the basic contract and in accordance with good traffic management principles. When it is necessary to use air or rail travel, the contractor agrees to use coach, tourist class, or similar accommodations to the extent consistent with the successful and economical accomplishment of the mission for which the travel is being performed.
(4) The contractor’s invoices shall include receipts or other evidence substantiating actual costs incurred for authorized travel. In no event will such payments exceed the rates of common carriers.
(d) Vehicle and/or Truck Rentals. The contractor shall be reimbursed for actual rental/lease of special vehicles and/or trucks (i.e., of a type not normally used by the contractor in the conduct of its business) only if authorized in the basic contract or upon approval by the COR. (f) Per Diem. The contractor shall not be paid for per diem for contractor personnel who reside in the metropolitan areas in which the tasks are being performed. Per Diem shall not be paid on services performed within a (75) seventy-five-mile radius of the contractor’s home office or the contractor’s local office. Per Diem is authorized for contractor personnel beyond a (75) seventy-five-mile radius of the contractor’s home or local offices whenever a task assigned requires work to be done at a temporary alternate worksite. Per Diem shall be paid to the contractor only to the extent that overnight stay is necessary and authorized under this contract. The authorized per diem rate shall be the same as the prevailing per diem in the worksite locality. These rates will be based on rates contained in the FTR, JTR or SR. The applicable rate is authorized at a flat seventy-five (75%) percent on the day of departure from contractor’s home or local office, and on the day of return. Reimbursement to the contractor for per diem shall be limited to actual payments to per diem defined herein. The contractor shall provide actual payments of per diem defined herein. The contractor shall provide supporting documentation for per diem expenses as evidence of actual payment.
