About this file

This document is a Justification and Approval (J&A) for a non-competitive procurement of SEMCO Pinnacle Dedicated Outdoor Air System (DOAS) units for the Building 606-MSEC renovation project at West Point, NY. The U.S. Army Corps of Engineers (USACE), New York District will solicit and award a firm-fixed-price construction contract using Best Value Trade Off (BVTO) procurement methodology, with funding from Sustainment, Renovation & Modernization (SRM) budget.

The J&A justifies using only SEMCO Pinnacle DOAS units due to their unique dual wheel configuration that provides efficient dehumidification and temperature control for a chilled beam cooling system. The units were selected through a life cycle cost analysis and are critical to meeting the project's mechanical system requirements. A Notice of Intent published on 13 December 2024 received no responses, and the contract will require offerors to include these specific DOAS units in their proposals. The procurement is authorized under 10 U.S.C. § 2304(c)(1) for sole-source acquisition where no other suppliers can meet the agency's specific requirements.

JUSTIFICATION AND APPROVAL

REVIEW

FOR OTHER THAN FULL AND OPEN COMPETITION

FOR:

SEMCO Pinnacle Series Dedicated Outdoor Air System

(DOAS)

Lincoln Hall Renovation Project West Point, NY

31 January 2025 rev 1 – 14 February 2025

1. CONTRACTING ACTIVITY:

The U.S. Army Corps of Engineers (USACE), New York District (NAN), Contracting (CT), 26 Federal Plaza, New York, NY 10278.

2. DESCRIPTION OF ACTION:

This Justification and Approval (J&A) supports the use of brand name components for the Building 606- MSEC renovation project. The government will not purchase the components directly, but rather will require that offerors include SEMCO Pinnacle Series Dedicated Outdoor Air System (DOAS) as part of proposals submitted in response to the solicitation to comply with the Contract specifications that will lead to the award of a new firm-fixed-price (FFP) construction contract. The United States Army Corp of Engineers (USACE) is responsible for the acquisition and administration of the construction. Funding for this acquisition will be Sustainment, Renovation & Modernization (SRM). The project will be solicited and awarded as a Best Value Trade Off (BVTO) procurement in accordance with FAR Part 14.

3. DESCRIPTION OF SUPPLIES/SERVICES:

SEMCO Pinnacle DOAS units will be used to ensure sufficient air conditions are met to effectively operate the heating and cooling systems installed under this project. The basis of design was developed based on a life cycle cost analysis (LCCA) and these units proved to meet all requirement and be life cycle cost effective (LCCE). It is paramount that these specific units are utilized to avoid operation and maintenance issues during building operations. These units are the key component of the overall mechanical system.

4. AUTHORITY CITED:

10 U.S.C. § 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(c), Application for Brand Name Descriptions. In accordance with FAR 6.302-1(c), the Contracting Officer will specify that all offerors be required to procure an item particular to one supplier (brand-name item).

5. REASON FOR AUTHORITY CITED:

A. Background:

During the Building 606 design various mechanical systems were evaluated on a LCCA basis and a chilled beam cooling system was determined to be the most LCCE. Given the unique cooling strategy (use of chilled beam) the basis of design was the use of SEMCO DOAS units.

These units were modeled during design and proven to meet the tight air condition tolerance requirements.

B. Justification:

The requirement to use SEMCO Pinnacle DOAS units is predicated on the critical nature of this piece of equipment in ensuring the performance of the chilled beam air conditioning system. To provide adequate moisture control in a chilled beam system, the primary dehumidification unit must provide ventilation air at a very dry condition at near room neutral temperature conditions.

While there are several strategies to achieve this, the Pinnacle unit uses a dual wheel configuration to provide both suppressed dew point and “free” reheat. This is more efficient than the traditional method of mechanically subcooling and then reheating and supports the energy efficiency goals of the project. The traditional approach may require additional equipment such as low temperature chillers or direct expansion cooling, which increases maintenance and potential points of failure. The Pinnacle unit can meet the temperature and humidity requirements with the standard chilled water temperatures coming from the base chiller plant.

SEMCO also provides a performance-tested control system to ensure that discharge air conditions are always maintained, which would otherwise need to be field programmed by the control contractor with other manufacturers. Given the critical nature of this control sequence, it is paramount that a system that has been tested such as SEMCO’s be utilized. Given the recent market research and investigation by the designer of record during development of the design, no other manufacturer’s system exists that has a similar internal control system.

C. Alternatives:

There are no viable alternatives that meet the mission requirements. Any number of manufacturers would be able to provide DOAS units; however, no other brand-name is able to provide the systems requirements as listed in para B above. Finally, given an alternate system, substantial amount of redesign would be required to ensure the mechanical system operates sufficiently.

D. Impact:

If the J&A is not approved and a different DOAS brand-name is selected instead of SEMCO mission requirements to award this FY that consists of an efficient / reliable mechanical system would not be met. Specifically, the entire mechanical system would need to be redesigned and incorporated into the bidding documents leading to schedule and cost impacts.

6. EFFORTS TO OBTAIN COMPETITION:

The brand name product has been published as required by FAR 5.201, a Notice of Intent (NOI) to determine sources for this system was synopsized on 13 December 2024. No responses were received for the Notice of Intent. The brand name justification and approval will be posted with the solicitation.

7. ACTIONS TO INCREASE COMPETITION:

This J&A supports a discrete requirement that will end when the project is complete. Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.
