About this file
This is an Insurance Requirements document for Volusia County, Florida, establishing mandatory coverage for a construction contractor engaged in stormwater improvements at Corbin Park in New Smyrna Beach. The project is funded through a U.S. Department of Housing and Urban Development Community Development Block Grant for Disaster Recovery (CDBG-DR) related to Hurricane Ian recovery efforts. The contractor must maintain comprehensive insurance coverage including Workers Compensation with waiver of subrogation, Commercial General Liability with limits of $1,000,000 per occurrence and $2,000,000 general aggregate, Auto Liability with $1,000,000 combined single limit, Excess Liability of $1,000,000 per occurrence/aggregate on a follow-form basis, Contractors Pollution Liability of $1,000,000 per incident/aggregate, and Installation Floater coverage for all materials and equipment installed. All policies must designate Volusia County as an additional insured or loss payee as applicable, provide primary and non-contributory coverage relative to county insurance, and include waivers of subrogation in favor of the county.
The contractor and all subcontractors and independent contractors must comply with these insurance requirements and maintain identical policy terms, conditions, and limits. All policies require thirty days written notice of cancellation provided to the County of Volusia Purchasing & Contracts Division, Risk Management Division at 123 W. Indiana Avenue, Room 302, DeLand, Florida 32720. As a federally assisted project, the contract is subject to Davis-Bacon Act prevailing wage requirements, the Copeland Act anti-kickback provisions, bonding requirements under 24 CFR 85.36, and Section 3 and Minority/Women-Owned Business Enterprise (M/WBE) provisions. The prime contractor bears full responsibility for wage compliance enforcement and supporting documentation throughout the project duration and may be held liable for wage restitution.
