FOR OFFICIAL USE ONLY – J&A No. 11- 019
United States Special Operations Command (USSOCOM)
Justification and Approval (J&A)
April 19, 2011
FOR OFFICIAL USE ONLY – J&A No. 11- 019
Justification for Other Than Full and Open Competition (J&A)
Authority: (10 U.S.C. 2304(c)(1), as implemented b y FAR 6.302-1
Project/Program Name: TACLAN Follow-on
Component/PEO/Other: PEO-C4
Estimated Contract Cost (including options): $400,000,000
Type J&A: (Individual or Class )
J&A No.
11 - 019
1. Agency and Contracting Activity: (FAR 6.303-2(a)(1))
United States Special Operations Command (USSOCOM), Directorate of Procurement, Headquarters Procurement Division (SORDAC-KI), 7701 Tampa Point Blvd, MacDill Air Force Base, FL 33621-5323.
2. Description of Action: (FAR 6.303-2(a)(2))
The purpose of this J&A is to provide transparency and document the decision to procure the current Tactical Local Area Network (TACLAN) v10.1 baseline and its family of systems (FOS) and the corresponding commercially available product items of the v10.1 configuration. FAR 11.105(a) requires that an agency justify the use of a particular product. A new indefinite delivery, indefinite quantity (IDIQ) TACLAN FOS contract is anticipated. It is planned that Fiscal Year (FY) 2011-2016 Research and Development, Procurement, and Operations and Maintenance funds shall be used. Funding shall be provided on individual delivery and task orders and not the basic contract.
3. Description of Supplies/Services: (FAR 6.303-2(a)(3))
The Government has decided to procure the current TACLAN v10.1 baseline and its FOS. This baseline configuration consists of specific commercially available products as defined in paragraph 5 below. As such, the Government must justify the use of these products; see paragraph 5 below for the actual justification. The estimated value of this J&A is $400M. The contract shall be an IDIQ with a three-year base ordering period and two one-year option ordering periods. As a note, this J&A only applies to the initial contract award and the current v10.1 configuration. Once awarded, all further changes due to end of life or parts obsolescence issues will be processed via the Special Operations Forces Information Technology Enterprise Contracts SITEC/TACLAN Configuration Control Board. There will be no updates to this J&A.
4. Authority Cited: (FAR 6.303-2(a)(4))
10 U.S.C 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1, and FAR 11.105(a).
5. Reason for Authority Cited: (FAR 6.303-2(a)(5))
a. For continued real-time support to specific SOF communication needs, the Government has decided to use the v10.1 baseline configuration for TACLAN suites and its FOS. The primary reason for this decision is to ensure component commands in direct support of Overseas Contingency Operations (OCO), do not lose continuity, support, and access to a certified SOCOM deployable system of record. The TACLAN v10.1 will be the only known non-developmental configuration to have completed baseline acceptance testing (BAT) and will have the resultant authority to operate (ATO) on all three SOF Information Enterprise networks.
Moreover, this configuration is in compliance with the current Configuration Control Board (CCB) approved design. The CCB process relies on existing user requests; USSOCOM directives; and end-of-life and obsolescence issues. This structured process strives to achieve increased system modularity, flexibility, and scalability; improve transportability, supportability, performance, training, design stability, security; and lower total ownership costs.
b. To introduce a next generation TACLAN with a completely new layout and software would result in the lack of standardization, interoperability, and compatibility with existing equipment.
In addition, New Equipment Training (NET), additional sparing, and increased maintenance capabilities would be required for non-standard TACLAN equipment and/or software, which would increase costs to the government.
c. The Government currently has v10.1 Version Description Document (VDD), the Software Requirements Specification and the Software Product Specification. The VDD contains all of the hardware and software required for the V10.1. In addition, Attachment 19, of the Request for Proposal, is a complete Bill of Materials for the V10.1 SIPR, NIPR, and JWICS segments.
d. The remaining documents, which are the Operations and Maintenance Manual (O&MM), the System Administration Guide (SAG) and the Installation Manual (IM), will be available by the end of April 2011. The proposal due date will be extended for two weeks after the remaining documents are added to the solicitation. The two week extension is considered reasonable since the vast majority of information needed to propose is contained in the VDD. The O&MM, SAG, and IM should have minimal impact on an offeror’s proposal.
6. Efforts/Actions to Increase Competition: (FAR 6.303-2(a)(6))
a. A notice has been publicized as required by FAR 5.2.
b. Acquisition History: The original TACLAN contract H9222-08-D-0017 was competed with the Capability Production Document (CPD) and TACLAN System Specification (TSS). For the reasons cited in paragraph 5 above, the Government must use the v10.1 configuration baseline.
Robust competition is expected at the prime level. A Pre-Solicitation Conference was held on March 30, 2011 and over 75 companies attended.
7. Market Research: (FAR 6.303-2(a)(8))
Market research is conducted on an ongoing basis. Specifically, the TACLAN Program Office routinely attends briefings and trade shows, reviews trade journals, and conducts Internet searches. The Technical Industrial Liaison Office (TILO) and Office of Small Business Programs (OSBP) databases were reviewed as a part of this market research. Moreover, the Directorate IDIQ database was reviewed for contracts/contractors eligible to meet the requirements as a part of this market research.
8. Interested Sources: (FAR 6.303-2(a)(10)&(11))
SORDAC-K received a letter from a potential offeror. In this letter, the offeror recommended that the Government pursue an R&D effort by procuring the next generation TACLAN. For the reasons cited above, this is impractical.
Several small businesses, along with their partners, have expressed great interest in this contract and robust competition is expected at the prime contract level.
9. Other Authorities/Factors: (FAR 6.303-2(a)(9))
This is a Small Business Set Aside at the prime contractor level. Competition is being restricted at the component level for specific brand names.
