The Technical Proposal shall include the information requested below for the non-price factors described in Section V.G.
II.C.1
It is the intent of the Government, in accordance with FAR Part 15.3, to make an award to the responsible contractor whose offer conforms to the solicitation and is most advantageous to the Government cost or price and technical factors listed in the solicitation considered. For this solicitation, the combined weight of the technical evaluation factors is of equal importance to price. The award may be made without negotiation of proposals; therefore, offerors will be requested to submit initial proposals to the Government on the most favorable terms from a technical and price standpoint. The factors to be utilized are:
1. Past Performance
2. Relevant Corporate Experience
3. Key Personnel
4. Small & Disadvantaged Business Participation Plan
Technical Proposal
The Government will evaluate technical proposals based on the following evaluation criteria (listed in descending order of importance):
1. Past performance. (Defined as the quality of services rendered in performing prior projects) (Weighted 40%)
2. Overall Corporate Experience. (Defined as the breadth, depth, and relevance of the offeror’s experience in performing similar projects to the current solicitation) (Weighted 40%)
3. Key Personnel. (Defined as the quality of experience of the project team) (Weighted 15%)
4. Small Disadvantaged Business Participation Plan (Weighted 5%) The evaluation factors selected were based on GSA internal experience in acquiring similar services in the past. For past performance, experience with existing and/or prior projects submitted by the offerors will be examined for quality of past performance in terms of timeliness, cost control, quality of product and project management.
For the purpose of this Source Selection by GSA’s Source Selection Evaluation Board (SSEB), % weights will be given to the technical factors in conjunction with price to select the Offer who provides the best value to the Government.
The technical evaluation factors shall be evaluated as follows:
1.)
Past Performance Past Performance was deemed to be a critical element in evaluation of proposals. The SSB determined that the evidence of successful past performance is vital for the success of this project. Therefore, Offeror’s will be required to provide references for all projects worked on in the 3 preceding years (October 1, 2007-2010); as well as the name and phone number of the owner’s representative who may be contacted by GSA for phone interview of the contractor’s past performance. Offerors are cautioned that the owner’s representative listed in the proposal must be an individual with the owner organization who has worked closest with the Offeror in completing the project. If such person is no longer available at the organization where the project was completed, provide the name and phone # of the person who has the most knowledge of the offeror’s work performance with the project.
The Government will attempt to contact a minimum of 3 of the offerors’ submitted references for past projects. Offerors without any previous projects for similar work or that cannot be contacted will be given a neutral rating for overall corporate experience.
Letters of commendation or appreciation from owners of the offeror’s submitted projects, although not required, would be favorably evaluated if included. The Government may use past performance information obtained from sources other than those identified by the Offeror and such information will be used for both the responsibility determination and best value decision.
This is a matter of judgment and the total assessment will be used to evaluate past performance in connection with the requirement set forth in this solicitation. Relevance and quality have approximately equal importance in assessing past performance. Past performance information obtained from sources other than those identified by the Offeror may be used to determine a rating for past performance The offeror’s past performance will be evaluated based on the following categories:
Timeliness of Performance
Did the contractor complete the project on schedule?
To what extent did the contractor adhere to contract delivery schedules at significant milestones?
How responsive was the contractor in addressing unforeseen conditions?
Cost Control
Did the contractor submit reasonably priced change proposals?
How responsive was contractor in submitting proposals for owner initiated changes?
How reasonable were contractor initiated changes?
Quality Product
How well has the contractor complied with contract requirements?
Did they conform to standards of good workmanship?
Does the contractor have the ability to adapt to changing requirements while maintaining a desired level of quality?
Project Management
How well did the contractor work with the owner and the owner’s technical representatives?
Was the contractor cooperative, businesslike, and concerned with the interests of project related third party entities (i.e. end users)?
Did the contractor maintain a consistent on site management/project team throughout the duration of the project?
Minimum standards: The minimum standard for past performance is met when the offerors’ submission of past projects reflects overall satisfactory past performance. The minimum standard will have been met if no more than one project submitted by the offeror is deemed less than satisfactory by the SSB in the above noted elements
2. Overall Corporate Experience/A similar project is defined as: renovation or restoration of an occupied commercial, industrial or governmental building including one or more of the following work items: mechanical, plumbing, drywall, HVAC, stonework, electrical work, window installation, painting, carpet installation, environmental sustainability, plaster work, and overall general construction experience.

o Project Superintendent
· Experience/Qualification Requirements for the Project Superintendent: One individual with experience as a project superintendent on projects that are similar to those projects defined under Factors 1&2, Relevant Past Performance/Corporate Experience.
Note 1: The qualifications of individuals identified as key personnel will be reviewed during proposal evaluation and incorporated into the contract at the time of award. Consequently, these key personnel must be maintained during the pendency of the contract. After award, requests for substitution of such personnel must be submitted to the Contracting Officer for review and approval. The Contractor shall provide the same information as required by this solicitation for all proposed substitutes, and any additional information requested by the Contracting Officer. The qualifications of the individual(s) offered as a substitute must be similar to the experience and qualifications of the key personnel previously incorporated into the awarded contract. In addition, an explanation of the necessity for the change shall accompany the request for substitution. No substitution shall be made without prior written approval by the Contracting Officer. Note that no increase in the contract price will be made as a result of substitution of Key personnel.
4. Small And Disadvantaged Business Participation The extent of participation of Small Disadvantaged Business (SDB) concerns in the performance of construction contracts expected to exceed $1,000,000 is a FAR 19.202-2 requirement for all solicitation issued on an unrestricted basis. As this project meets the FAR requirement, this factor measures the extent to which the offeror will utilize small disadvantaged business concerns in the performance of the contract. The proposal will be evaluated on the extent to which SDB firms are specifically identified and the extent of planned participation of SDB concerns in terms of the value of the total acquisition. SDB concerns, and the work they are to perform, shall be specifically identified in the offer.
Minimum Standard: The minimum standard for the project is met when the Small Disadvantaged Business Participation factor is identified according to the criteria set forth, including the SDB firms and the extent of work to be performed.
A. Commitment to Small Business Concerns: GSA is committed to providing to the maximum extent practicable for these socio-economic businesses to receive federal contracting opportunities. This factor is designed to ensure that this GSA commitment is brought to the attention of the prospective offerors. This factor measures the extent to which the offeror will perform contract requirements utilizing small business concerns in the NAICS Code 236220. This portion of the proposal will be evaluated on the extent of planned participation of small business concerns in terms of the value of the total acquisition. Small Business Concerns may perform work with their own forces or subcontract work to other small businesses to demonstrate their commitment to small business. Offerors will also be evaluated on their proposed outreach efforts that will be taken to assure their commitment to small business.
Submission Requirement: Offerors shall submit a Subcontracting Commitment Goals and Outreach Efforts Plan, with their proposal.
B. Commitment to Equal Employment Opportunity for Construction: Federal Acquisition Regulation (FAR) Provision 52.222-23 — Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity for Construction (Feb 1999) sets goals for minority and female participation for the Contractor's aggregate work force in each trade on all construction work. For this project, the goals are as follows:
Goals for Minority Participation for Each Trade: 6.3% Goals for Female Participation for Each Trade: 6.9%
Submission Requirement: In narrative format, describe the efforts that will be taken to meet these goals for minority and female participation in construction trade work.
B.
Price:
In accordance with FAR 15.304 (c) (1), Price or cost to the Government shall be evaluated in every source selection (10 U.S.C. 2305(a)(3)(A)(ii) and 41 U.S.C. 253a(c)(1)(B)). Cost or price will not be assigned a numerical weight or point score.
For award purposes, prices will be evaluated based on the total estimated construction cost of the contract including options. In accordance with FAR 15.305, FAR 15.404, and FAR 15.405, price and/or cost analysis will be used to determine price reasonableness and the offeror’s understanding of the work and ability to perform the contract.
For this solicitation, the technical evaluation factors are of equal importance to price. The approach to the source selection for this procurement will be pursuant to the best value concept. The objective is to select the proposal that offers the best value for the funds expended, not necessarily the lowest price. As the selection of a firm will be based on the best value concept, GSA may pay more for demonstrated technical experience.
PROPOSAL EVALUATION:
Technical proposals will be evaluated and rated, using adjectival ratings, based on the evaluation criteria established in the solicitation as detailed in this Plan. Price proposals will also be evaluated based on the pricing formula detailed in the solicitation. The proposals considered within the competitive range in terms of their rating and price will further be evaluated in accordance with the best value concept.

(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or
(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.
(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.
(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.
(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.
(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall—
(1) Mark the title page with the following legend:
This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed—in whole or in part—for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of—or in connection with—the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and
(2) Mark each sheet of data it wishes to restrict with the following legend:
Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
(f) Contract award.
(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.
(2) The Government may reject any or all proposals if such action is in the Government’s interest.
(3) The Government may waive informalities and minor irregularities in proposals received.
(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.
(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government’s best interest to do so.
(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government. (f)(4) The Government intends to evaluate proposals and award a contract after conducting discussions with offerors whose proposals have been determined to be within the competitive range. Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint.
(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.
(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.
(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(i) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.
(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(iv) A summary of the rationale for award.
(v) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(Applicable to solicitations resulting in construction contracts in excess of $10,000.)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:
[Note: Locality goals can be found at http://www.dol.gov/ofccp/TAguides/ctaguide.htm in Appendix E of Construction Contractors Technical Assistance Guide.]

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
