Part 2 - Questions and Responses – 8 March 2019
1. Question:
In regards to CE compliance, In order to meet the design and construction requirements stated in 3.3 of PD15WRWNZEA05 and 2016/C272/01 Official Journal of the European Union Appendix IV. Module G, at what stage of the design review must the offeror explicitly declare that the qualification design meets Conformite Europeenne requirements and produce a Certificate of Registration in order for the “CE” marking to be properly affixed? Are any subassemblies or parts explicitly excluded from CE conformance requirements?
Answer:
The offeror must meet the CE requirement prior to First Article approval. The first article will not be approved without CE certification. The trailer design process is not complete until approval of all first articles.
CE certification applies to the “End-Item” trailer only. The Government has levied no requirements in the PD or SOW for sub-components/assembles to be CE certified. Also, part of the solicitation is for the contractor to develop an Integrated Master Schedule (IMS) which will set the actual First Article Government Acceptance date, SOW paragraph 3.1.5.
The below PD and SOW excerpts point to CE certification as part of and due at First Article (FA) Acceptance:
In the Purchase Description PD15WRWNZEA05. Refer to 4.2, First Article Inspection, all requirements as described in 4.6. Refer to 4.6, Test Methods and 4.6.2 Certification, TABLE VIII. Required Certifications; 3.3 Design and Construction; Required Certification: “Contractor certification that the trailers are designed, constructed, and tested in accordance with the PD. Contractor certification that the production trailers shall be built and released to the same standards as the first article trailers. Contract Certification that the trailers have CE declaration of conformity.”
The Statement of Work (SOW) paragraph 3.5.1.3 states “Testing and verification shall be performed in accordance with Section 4.0 of PD. Paragraph 3.5.1.3.3 “Completed analysis, Certification, Inspection and Demonstrated results shall be presented with test data requirement. Paragraph 3.5.1.4 “First Article approval shall not be granted until satisfactory completion and Government approval of all testing and associated analysis and reporting.”
