2, Q#10 Does the 1st paragraph of the Government’s answer to Question #10 mean that the contractor and its subcontractors will not be the Importer of Record (IOR) or Exporter of Record (EOR) for any hardware imports or exports?

Correct, the contractor and its subcontractors will not be the IOR or EOR for any hardware imports or exports.

The Freight forwarder (in most cases) holds the import/export license for the Country. The repair/procured items will be shipped to/from the freight forwarder using the LOA as the import/export license/agreement.

There are countries (2 currently) who do not have contracted Freight Forwarders (FF), they have their items shipped to Dover or other locations using the LOA as the import/export license and then utilize MIL- AIR for final delivery to country.

This will be included in shipping instructions for each delivery order.

Does the 2nd paragraph of the Government’s answer to Question #10 mean that the contractor and its subcontractors will not have to export any export-controlled technical data directly to the foreign countries, that all technical data exports will be handled directly by the

USAF?

Correct. There will be no export of technical data directly to foreign countries. If required, export would be handled by the

USAF.

The USG use Technical Order Distribution Office (TODO) / Technical Order Management Agency (TOMA) to control technical data through International Digital Technical Order(s) Delivery (IDTOD) system. Country TODO’s obtain access to the technical data identified particular to their country. The awardee will need to obtain access to IDTOD system to upload technical data created.

Can the Government clarify how the FFP rates will be applied to the CPFF CLINs for E&TS and DMSMS? Since the FFP rates are fully burdened labor rates that include profit, how will the FFP rate be adjusted on the CPFF task orders to determine

The CPFF labor rates were inadvertently omitted from the TEP workbook. An amendment to the RFP will be issued as soon as possible to include a revised TEP workbook, Section L, and Section M to request pricing for CPFF Labor Rate Build Up. The

government intends to extend the proposal due date with that amendment to 12 September 2023 to allow offerors time to review and make appropriate changes.

If a specific DMSMS or E&TS RFP requires contractor support that does not fall into the contract labor categories specified in the IDIQ RFP (either because of position and/or qualifications), is the Contractor able to include additional labor categories / rates to proposed future DMSMS or E&TS Task Orders?

If not, is it the Government’s intent that only personnel who fit within the required qualifications (i.e., no personnel with less than the required minimum level of experience detailed in the TEP Duties/Responsibilities) will support the program?

The Government identified those labor categories most likely to be utilized on this effort. Offerors are not to propose any additional labor categories in the proposal.

The Government expects these labor categories to cover a majority of the work completed.

However, if there is a specific DMSMS or E&TS requirement that does not fall into the contract labor categories, that labor rate would be discussed/negotiated/included on that particular IDIQ RFP. Any additional labor rates proposed on a future DMSMS/E&TS effort would need to be justified.

DMSMS and E&TS will potentially be utilized with currently unknown requirements, the Government recognizes that if/when that happens there may be a need for additional labor categories due to the unknown nature of future requirements.

We understand that the Government is not including contract financing clause FAR 52.232-32 Performance-Based Payments for the repairs, however we respectfully request that the Government incorporate the clauses FAR 52.232-16, Progress Payments and FAR 52.232-32 Performance-Based Payments, into the IDIQ contract for potential future use on E&TS and DMSMS task orders.

No. The Government does not foresee the need for contract financing in this requirement.

These clauses will not be incorporated.
