Performance Work Statement
For
F-16 FMS Product Support Integrator (PSI) Basic

1. SCOPE AND PURPOSE
1.1. This Performance Work Statement (PWS) describes the tasks required under the F-16 Foreign Military Sales (FMS) hybrid Product Support Integrator (PSI) contract to support the Foreign Military Sales (FMS) F-16 Weapon system. The primary role of the PSI is for the USG and the contractor to integrate support for FMS partners to drive down costs and increase supportability to FMS partners. Support is available to the FMS customers operating the F-16 Weapon System including but not limited to: the airframe, all configurations and blocks, support equipment*, all peculiar airborne vehicle equipment, and all weapon system subsystems. The PSI contract implements a centralized ordering process whereby orders may be placed by the F-16 Foreign Military Sales (FMS) Branch, Hill AFB, UT. The primary objective of this contract is to provide F-16 FMS Post-Production Support (PPS) inclusive of a myriad of engineering and sustainment services necessary for the continued operation and improvement of the F-16 weapon system. These efforts shall include, but are not limited to:
• Repair and Return (R&R)
• Engineering and Technical Support (E&TS) Resolution
• Diminishing Manufacturing Sources and Material Shortages (DMSMS)
* The scope of this PWS does not include the acquisition of new production aircraft nor initial spare/parts or Support Equipment (SE) covered by other contracts.
2. GROUND RULES
2.1. This Basic PWS is to be used in conjunction with all other PSI PWSs.
2.2. The PWS shall be applicable to all FMS F-16 blocks and configurations of aircraft and associated assets.
2.3. This contract allows for a wide range of pricing arrangements, dependent upon the requirement, and may include the establishment of separate incentive arrangements.
2.4. Contractor shall have the technical capability to complete work within the scope of each delivery order and the basic contract in its entirety.
2.5. Kick-Off Meeting: The contractor shall prepare and host a program kick-off meeting within 10-calendar days after contract award to ensure all parties to review the contract.
Kick off meeting shall occur in person at the contractor’s facility with virtual call-in capabilities. USG and Contractor will coordinate an agenda.
2.6. Initial Transition/Phase in: Contractor shall be prepared to perform entire scope of contract no later than 30 calendar days after contract award.
2.7. Task/Delivery Order Issuance: RFP and task/delivery order issuance will be addressed in each specific PWS.
2.8. This will be a 10-year Indefinite Delivery and Indefinite Quantity (IDIQ) contract.
3. ROLES AND RESPONSIBILITIES
3.1. CONTRACTING
3.1.1. A Procurement Contracting Officer (PCO) at Hill Air Force Base, Utah will be responsible for contract management of the PSI contract and any Order initiated under it. Only a PCO from this organization can approve changes affecting the PSI contract, any Orders issued under it, and this PWS. The contractor shall accept no direction, implied or explicit, received from any other government representative that may affect performance of tasks under this contract or associated Orders, or have a material impact on costs incurred in association with this contract. Such instances shall be brought to the immediate attention of the PCO for resolution.
3.1.2. The Contractor shall provide a Contracts Point of Contact (POC) for the purpose of managing the PSI program.
3.2. CONTRACT ADMINISTRATION
3.2.1. Contract administration will be accomplished by Defense Contract Management Agency (DCMA).
4. PROGRAM MANAGEMENT
4.1. F-16 Foreign Military Sales (FMS) Branch will be responsible for management of this program.
4.2. The Contractor shall provide all personnel, materials, and facilities necessary to perform the tasks specified in the Orders issued under this contract.
4.2.1. The selection, hiring, assignment of duties, reassignment of duties, transfer, supervision, management, control, and termination of contractor employees in performance of this PWS shall be the responsibility and prerogative of the contractor.
4.2.2. The Contractor shall establish processes and assign appropriate resources to effectively administer the Orders issued under this contract.
4.2.3. The Contractor shall provide for the management and support of personnel, to include training, guidance, and supervision of qualified personnel to accomplish the Orders issued under this contract.
4.2.4. The contractor shall provide professional and technically qualified personnel to perform assigned taskings. The contractor shall provide total task management and contractor personnel supervision. The contractor shall designate a primary point of contact for all technical aspects of the required work.
4.2.5. The government has set a minimum overall small business subcontracting goal (first tier) of 12% of the total subcontracted amount and 14% of the total contract value.
5. DESCRIPTION OF TASKS
5.1. Repair and Return (R&R): Submittal and return of unserviceable items to the Contractor for repair and return to customer IAW the R&R PWS
5.2. Diminishing Manufacturing Sources and Material Shortages (DMSMS): Provide analysis and resolution of DMSMS items IAW the DMSMS PWS.
5.3. Engineering and Technical Support (E&TS): Provide technical support and solutions including cost share opportunities not covered by other contracts. Efforts can include Supply Procurement, Minor Modifications, In-Country Support Studies, etc. IAW the Engineering and Technical Support PWS.
6. SECURITY
6.1. This PWS requires a Department of Defense (DD) Form 254, Department of Defense Contract Security Classification Specification. The Contractor shall comply with the requirements specified in the DD Form 254 and this PWS regarding handling, transportation, dissemination, storage, and protection of any classified date/material/equipment developed or handled under this PWS. Contractor and Subcontractor shall maintain the appropriate Facility Clearance Level (FCL) to complete the work.
6.2. Security Classification Guide (SCG)
The contractor shall follow the F-16 Multi-Mission Fighter Security Classification Guide and all security classification guides of systems/information associated with the program for derivative classification, identification of the level and duration of classification for specific information elements, and public release requirements.
6.3. Personnel Security
6.3.1. The Contractor shall ensure applicable Contractor personnel have security clearances at the SECRET level for proper accomplishment of contract/order requirements. The security clearance shall be obtained in accordance with the DD Form 254, Department of Defense Contract Security Classification Specification.
Contractor personnel whose clearances have been suspended or revoked shall immediately be denied access to classified information and/or CUI and classified items.
6.3.2. USG will not be financially responsible for granting security clearances, upgrades to clearances, etc.
6.4. Security Incidents and Violations
The Contractor shall notify the Defense Counterintelligence and Security Agency (DCSA) within 48 hours of any incident involving the actual or suspected compromise/loss of classified information to enable the Government to conduct immediate assessments of potential impact pending formal inquiry/investigation. Actual or suspected compromise of Covered Defense Information will be reported IAW DFARS Clause 252.204-7012.
6.5. Reporting Requirements
Contractor personnel shall report to an appropriate authority, any information, or circumstances of which they are aware that may pose a threat to the security of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. Contractor employees shall be briefed by their immediate supervisor upon initial assignment and as required thereafter.
6.6. Proprietary Information
Performance under this PWS may generate Government proprietary data categorized as Controlled Unclassified Information (CUI) or protected under the Privacy Act of 1974.
The Contractor shall not divulge, or release data or information developed or obtained under performance of this contract, except by authorized Government personnel or upon written approval of the F-16 SPO. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend.
6.7. Confidentiality of Information
Unless otherwise specified, all financial, statistical, personnel, and/or technical data furnished, produced, or made available to the Contractor during the performance of this contract is considered confidential business information and shall not be used for purposes other than performance of work under this contract.
6.8. Freedom of Information Act (FOIA)
The Contractor shall comply with DoD Manual 5400.07_AFMAN 33-302, DoD Freedom of Information Act Program, requirements. The regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding of Controlled Unclassified Information (CUI) material.
6.9. Communications Security (COMSEC)
6.9.1. The Contractor and Sub-contractors shall establish a COMSEC account and appoint a COMSEC custodian. The Contractor shall request, maintain, and store all COMSEC material as needed.
6.9.2. The Contractor shall use only secure communications methods and/or equipment to transmit or otherwise transfer classified and/or controlled unclassified information in accordance with F-16 Multi-Mission Fighter Security Classification Guide and other applicable Government security regulations.
6.9.3. The Contractor shall ensure the security of automated information systems at the Contractor’s facility to preclude potential security incidents or violations including potential unauthorized disclosure or compromise of classified and/or controlled unclassified information.
6.10. Foreign Government Information
Foreign Government Information (FGI) is information provided to the U.S. by a foreign government or governments, an international organization of governments, or any element thereof with the expectation, expressed or implied, that the information, the source of the information or both, are to be held in confidence; or produced by the U.S.
pursuant to, or as a result of, a joint arrangement with a foreign government or governments, an international organization of governments, or any element thereof, requiring that the information, the arrangement, or both are to be held in confidence.
6.11. Access to Classified Information
6.11.1. The contractor will establish policies, procedures, and practices for the effective protection of classified information, including foreign government information.
6.11.2. The contractor requires access to classified source data up to and including SECRET in support of the work effort. All classified information received or generated will be properly stored and handled according to the markings on the material.
6.11.3. The contractor must provide adequate storage for classified hardware and materials to the level of SECRET which exceeds 2 cubic feet and is of size and quantity that it cannot be safeguarded in a General Service Administration (GSA) approved security container.
6.12. Defense Technical Information Center (DTIC
The contractor is authorized to use the services of the Defense Technical Information Center (DTIC). The contractor must prepare a DD Form 1540, Registration for
Scientific and Technical Information Services, for GCA submittal. The contractor may submit a DD Form 2345, Military Critical Technical Data Agreement, (after registration with DTIC) to the Defense Logistics Services Center for access to unclassified, militarily critical technical data from other DoD sources. The GCA must be involved in certifying need-to-know for contractors to utilize DTIC.
6.13. Operations Security (OPSEC)
The contractor shall ensure OPSEC is incorporated into the appropriate area of the contract IAW DoD Directive 5205.02E, DoD Operations Security (OPSEC) Program and AFI 10-701, Air Force OPSEC Program. The Contractor shall flow down all OPSEC requirements to subcontractors that handle Critical Information (CI). CI is defined as specific facts about friendly intentions, capabilities, or activities needed by adversaries to plan and act effectively against friendly mission accomplishment.
6.14. Controlled Unclassified Information (CUI)
6.14.1. Controlled Unclassified Information is any information that law, regulation, or government wide policy requires to have safeguarding or disseminating controls, excluding information that is classified under Executive Order 13526, Classified National Security Information, December 29, 2009, or any predecessor or successor order, or the Atomic Energy Act of 1954, as amended.
6.14.2. Controlled Unclassified Information (CUI) is information that requires safeguarding or dissemination controls pursuant to and consistent with applicable law, regulations, and government-wide policies but is not classified under Executive Order 13526 or the Atomic Energy Act, as amended.
6.14.3. The National Archives and Records Administration (NARA) CUI Registry (http://www.archives.gov/cui/registry/category-list.html) identifies approved CUI categories and subcategories, provides general descriptions for each, identifies the basis for controls, and sets out procedures for the use of CUI.
6.14.4. The contractor shall guard against unauthorized disclosure of CUI. They must include the following measures among the reasonable precautions:
• Establish controlled environments in which to protect CUI from unauthorized access or disclosure and make use of those controlled environments.
• Reasonably ensure that unauthorized individuals cannot access or observe CUI or overhear conversations discussing CUI.
• Keep CUI under the authorized holder's direct control or protect it with at least one physical barrier, and reasonably ensure that the authorized holder or the http://www.archives.gov/cui/registry/category-list.html physical barrier protects the CUI from unauthorized access or observation when outside a controlled environment.
• Protect the confidentiality of CUI that agencies or authorized holders process, store, or transmit on contractor information systems.
• In accordance with DFARS Subpart 252.204-7012, contractors and subcontractors will safeguard covered defense information that resides in or transits through contractor information systems by applying specified network security controls and will report cyber incidents. Contractors are prohibited from releasing unclassified information to the public without approval of the contracting activity.
7. GOVERNMENT FURNISHED DATA/PROPERTY
7.1. Data and information furnished by the United States Government shall not be released to any other government without the specific written approval of the respective service, department, or government agency of the United States. The information shall be afforded the same degree of security protection as that afforded to it by the respective service, department, or government agency of the United States.
7.2. The Contractor shall be responsible for Government Furnished Property (GFP) in accordance with the Federal Acquisition Regulation (FAR), DFARS and GFP clauses included in the contract.
8. TECHNICAL DATA ACCESS
8.1. Contractor shall be responsible to obtain access to Technical Data needed to perform the requirements under this contract. The USG will assist as needed.
8.1.1. In order to access USAF technical orders, the Contractor shall establish a Technical Order Distribution Office (TODO) account and Enhanced Technical Information Management System (ETIMS) account. Instructions to obtain access to these systems are detailed in TO 00-5-1.
8.1.2. Access to Country Specific Technical Orders (CSTO) documentation would require access to the International Digital Technical Order(s) Delivery System (IDTODS). If needed, access will be evaluated and coordinated by the USG.
9. DATA RIGHTS
9.1. Rights to data generated under this contract will be captured in DFARS clauses 252.227- 7013 or 252.227-7014 and shall be maintained and disposed of per AFI 23-111, Management of government Property in Possession of the Air Force.
9.2. Proprietary Data - If government furnished data or information of a proprietary nature is furnished to the Contractor, it shall not be used or disclosed in any manner likely to prejudice the right of the originator to obtain patent protection in respect thereof without prior approval of the respective service department or government agency of the United States.
10. QUALITY REQUIREMENTS
10.1. The Contractor shall provide quality services/products and management oversight of all processes and comply with the quality standard(s) listed in the Orders issued under the contract. (IAW FAR 46.311, DFARS 246.202-4(1)). The Contractor shall implement and conduct a quality assurance program in accordance with ISO-9001 and AS-9100 series certifications or equivalent quality management systems.
10.2. The contractor shall support government quality assurance surveillance to periodically evaluate the contractor’s performance in accordance with the government’s Quality Assurance Surveillance Plan (QASP).
11. SAFETY
11.1. The Contractor shall follow any safety provisions. The contractor shall comply with all safety provisions, technical specifications, and technical publications and with Federal Occupational Safety and Health Standards (Title 29, Code of Federal Regulations, Part 1910). If there is no applicable Occupational Safety and Health Administration (OSHA) standard, the contractor shall use other applicable nationally recognized sources of safety, health and fire prevention standards requirements as required.
12. CONTRACT DATA REQUIREMENTS LIST (CDRL)
12.1. Deliverable Contract Data Requirement List (CDRL) data generated in the performance of Orders shall be submitted IAW the applicable DD Form 1423. CDRL requirements will be specified in the specific Order PWSs.
