SOLICITATION No. FA4890-14-R-0024 CN & GT Training Support Services
No
REFERENCE
COMMENT/QUESTION
GOVERNMENT RESPONSE
1
Scenario 1 Para 1.1.4 & 1.8.1
Please clarify the apparent contradiction: Para 1.1.4 states “All students will possess the required clothing and equipment required to successfully complete the specified training”, however Para 1.8.1 Contractor-provided. states “The Contractor shall provide Aviation Life Support Equipment (ALSE) items for the flight training personnel that meet US military standards, as follows:”
Who provides the required flight equipment 1.students and 2. Contractor personnel There is no contradiction here. Paragraph 1.1.4 states that the students will already have the required items specified in that paragraph, and paragraph 1.8.1 describes the items that the contractor shall provide the specified items for contractor personnel.
2
Scenario 1 Para 1.2.2
All students shall receive comprehensive ground and flight evaluation prior to course graduation from a US Army authorized Flight Examiner. Who is responsible for performing Flight Examiner duties?
A US Army authorized Flight Examiner is responsible for performing these duties.
3
Scenario 1 Para 1.3
Program of Instruction (POI). “The Contractor shall develop a POI based on DoD/US Army Helicopter training standards …” Will the government provide a copy of the DoD/US Army training standards or provide specifics such course length, number of flight hours, ground instruction time, etc?
DoD/US Army Helicopter training standards are readily available on-line.
4
Scenario 1 Para 1.7.1
Flight Training Personnel. states. “These flight training personnel shall also be qualified and current in the OH-58A platform”. Given the OH58A aircraft are not readily available/obsolete and similar aircraft – B206B series helicopter, OH58C, and TH57/67 are available can they be used to demonstrate qualification and currency? These are single engine basic aircraft derivative.
Now paragraph 1.4.1 – Updated to state, “These flight training personnel shall also be qualified and current in the OH-58 /TH-67 (B206) platform at performance start.”
5
Scenario 1 Para 1.7.2
Safety Officer. states “The Contractor shall provide a qualified DoD trained Aviation Safety Officer to supervise and ensure that all flight training adheres to established OH-58A flight and maintenance safety standards.” Please confirm if this is a dedicated non-flying position or collateral position?
Now paragraph 1.4.2 - Offerors may propose to meet all qualifications stipulated in the scenario and may successfully do so with variant proposed approaches.
6
Scenario 1 Para 1.7.2
Safety Officer. states “. The Aviation Safety Officer shall be proficient, both oral and written, in the English language, DoD trained and experienced as a US Military Squadron Aviation Safety Officer.” Infers that a non US citizen can fulfill this position – please clarify?
Now paragraph 1.4.2 - Offerors may propose to meet all qualifications stipulated in the scenario and may successfully do so with variant proposed approaches.
7
Scenario 1 Para 1.8.2
Colombian Government-provided. The COLMIL will provide: “….. Necessary aviation assets to support training, to include OH-58A aircraft meeting airworthiness directives and requirements per applicable technical manuals; these aircraft will come properly maintained, fueled and with the applicable ground support services necessary to conduct flight operations. Any issues preventing the Contractor from meting…” Seems the last sentence was cut off, please complete
Now paragraph 1.5.2 - Last sentence of bullet removed.
8
3.0 Additional Requirements (APPLY TO BOTH SCENARIOS
Para 3.2.1
Value Added Tax (VAT), Customs, Duties. “The Contractor shall be responsible for all associated taxes (e.g. Value Added Tax (VAT)), duties and customs fees, and other related charges. Historically Kazakhstan has had very high (est. 20%) customs fees and taxes for the importation and delivery of material that is not accepted as locally or regionally produced. At this time, waivers or exemptions are not available to preclude the payment of the VAT tax. Waivers or exemptions shall be documented before shipment if they become available.” I believe this paragraph was pasted from another RFP since Kazakhstan is not in either scenario, recommend the paragraph be revised and secondly is contractor exempt in Columbia and Nigeria?
Removed references to Kazakhstan (removed two (2) sentences).
9
3.0 Additional Requirements (APPLY TO BOTH SCENARIOS
Para 3.3
Para 3.3 Mobilization. “For each requirement (paragraphs 1.0 and 2.0), the Contractor shall identify the necessary mobilization period required to initiate required in-country support at specified locations. This period shall include staffing, required country clearance processing, US Embassy RSO background checks, completion of any appropriate technical assistance agreements/export licensing, actual mobilization, and any other requirements necessary to satisfy these requirements. The mobilization effort shall be documented in the Task Order Management Plan and Master Schedule. In-country performance shall commence upon completion of the mobilization period.” The request is vague given the USG does not specify a performance start date, or detail those processes the contractor cannot control such as country clearance processing, US embassy RSO background checks, for example. Please clarify an anticipated start date for the efforts. Or at least state the expected clearance processing and RSO background check times since this is a government function and we cannot control
A specified performance start date is not necessary. The Government needs to assess each Offeror’s proposed approach and understanding of OCONUS processes. Contractors would not be held accountable for Government processing times (or any related delays).
10
Scenario 2, Para2.8 (added 4 Jan 15)
Government Furnished Items. Transportation and security will be provided by NDLEA personnel. The Contractor shall remain on the academy grounds throughout the deployment period. The Contractor shall coordinate transportation and security requirements with the Government in-country representative for approval as required. Please clarify who is responsible for lodging and/or cost?
This is specified in the ID/IQ contract.
11
RFP L-9.1.1 (added 4 Jan 15)
L-9.1.1 Labor Rates. ..Multipliers based on yearly utilization are included to more easily distinguish among Offerors’ proposed prices. Please clarify exactly what a multiplier is and/or who applies the percentage?
The multiplier cells/columns have been populated by the Government. The multiplier is 1,920 for CONUS (hourly) Rates (based on 4 weeks off (2 weeks of federal holidays and 2 weeks of vacation time)) and 240 for OCONUS (daily) Rates (also based on 4 weeks off per previous). The updated Table B-1 has been posted to FBO.
12
10102014 Draft RFP Section L, Attachment 1, Scenarios
Will the two scenarios (LE Training for Nigeria and OH-58A Helicopter Flight Training for Columbia) be used for evaluation purposes only as basis for the ID/IQ award, or will they also be evaluated for actual award as two of the first Task Orders under the ID/IQ?
See RFP paragraph L-7.3.4.
13
N/A – Industry Day Information
When will the Bidder’s Library be available? Is it possible to make the Bidder’s Library available before Final RFP release?
The Government stated in the Industry Day that it would not have a traditional Bidder’s Library and that we would only post historical PWSs, which was done on 16 Jan 15.
14
PWS paragraph 3.4
Comment: The Government COR will utilize the Quality Assurance Surveillance Plan (QASP) to evaluate Contractor performance and ensure PWS compliance.
Question: Will the Government please provide a copy of the current and/or proposed QASP with solicitation documents.
The QASP will be provided with the final RFP.
15
PWS paragraph 3.2
Comment: The section provides “The Contractor shall develop a Quality Manual that demonstrates how the Contractor shall maintain an inspection system acceptable to the Government covering services under this contract. See paragraph 3.4.4.6 for deliverable requirements.”
Question: There is no paragraph 3.4.4.6 , however there is a paragraph 3.5.4.6 that discusses Quality Manual requirements. Please confirm and/or adjust this reference.
The correct PWS reference is paragraph 3.5.4.7.
16
PWS paragraph 3.1
Comment: XX company is ISO: 9001 compliant and has many projects and entities are that ISO certified and/or registered.
Question: Do these certified entities comply with the Government requirements?
Question: In case these certified entities do not comply with the Government requirements, do we need to certify the bid entity, the project, or the company at the corporate level?
Offerors shall be compliant in accordance with PWS paragraph 3.1.1. Please note the changes to this paragraph.
17
Section H-5 Small Business Subcontracting Goals
Comment: In the draft RFP, Section H-5 Small Business Subcontracting Goals, it states “For large businesses in the F&O Competition Pool, the Contractor’s small business subcontracting plan shall ensure a minimum of TBD % of the total annual awarded contract value is subcontracted to small businesses.
Section 52.219-9 of the FAR provides the requirements for a Small Business Subcontracting Plan. Establishment of Small Business goals is defined In FAR 52.219-9(d)(1) as follows: "Goals, expressed in terms of percentages of total planned subcontracting dollars, for the use of small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns as subcontractors. The offeror shall include all subcontracts that contribute to contract performance, and may include a proportionate share of products and services that are normally allocated as indirect costs."
Further, the SBA Final Rule dated 7/16/2013 added 125.3(a)(2) to the Code of Federal Regulations as follows: “Subcontracting goals required under paragraph (c) of this section must be established in terms of the total dollars subcontracted and as a percentage of total subcontract dollars. However, a contracting officer may establish additional goals as a percentage of total contract dollars.”
Question: Given that both the FAR and CFR regulations require Small Business Subcontracting goals as a percentage of subcontracted dollars, will the Small Business goal requirement for this solicitation be modified accordingly to measure Small Business goals as a percentage of subcontracted dollars?
This contract is set aside for small businesses, and FAR 52.219-9 does not apply to small business concerns.
This RFP does not include a Section H paragraph regarding Small Business Subcontracting Goals (that is only included in the Operations and Logistics Support RFP).

Tab Year 1(23 Dec 15-22 Dec 16) Question: May additional rows be added to the Indirect Cost section? For example, if some Labor Categories require a higher DBA rate than others. OR should this be an average of all DBA?
The Government has added two “Optional” columns for Offerors to accommodate various disclosed practices of price build up for labor. See RFP paragraph L-9.1.1. However, the Government is not allowing for additional rows to be added to the Indirect Rate(s) sections.

Tab Year 1(23 Dec 15-22 Dec 16) Section G&A Cost in Indirect Rates Question: The formula for G&A is multiplying the G&A rate by the Multiplier instead of the OH Cost. We assume that this should be using the OH Cost column. Is this a correct assumption?
The Government has reviewed any cells containing a formula and believes all items reference the correct cells.
Please note that per RFP L-9.1, “…the burden of providing mathematically accurate and complete pricing proposals (total overall evaluated price) using the format provided in Section B, Table B-1 rests with each Offeror).”

Tab Year 1(23 Dec 15-22 Dec 16) Total for Indirect Rates section Question: The formula for the Total of Indirect Rates is adding across the whole row and includes the multiplier in the total. We are assuming that the multiplier column should not be included in the total.

Tab Year 1(23 Dec 15-22 Dec 16) Cell L63 Question: The formula for the Total CONUS labor adds the column for the Total cost of OCONUS labor. We are assuming that this should be pulling from Column I, Total Cost CONUS.

Pricing Table and Performance Work Statement
Reference/Comment: CN>_exhitbit_1,_Table_B-1 Pricing_Table.xlsx
Tab Year 1(23 Dec 15-22 Dec 16) & PWS Paragraph 2.5.1 Duty Hours states:-”If required, the Contractor shall provide service and support for 24 hours a day/7 days per week as directed by the responsible CO or written designee.”
Question: As stated in the Pricing instructions, OCONUS rates are daily unit rates. Is this daily unit rate to be priced assuming a 10 hour workday, 12 hour workday, 24 hour workday? Please provide direction.
The Government will not provide the number of hours per day expected for the OCONUS (daily) labor rates. This is a performance-based requirement; therefore, the Government expects that offerors will propose varying approaches and therefore propose varying hours based on those approaches.

Tab Year 1(23 Dec 15-22 Dec 16) Column B Question: We have assumed that the columns labeled “Multiplier” on the Indirect Rate(s) Table represents the combined totals of the CONUS and OCONUS Labor Rate Table for all rows in the Indirect Rate(s) Table. Is this correct?
No. The information in the Indirect Rate(s) section of each worksheet is independent of the labor section.

RFP paragraph L-5.3.6
Can you please confirm whether the requirement to verify ISO 9001 registration is still under consideration for the subject Training solicitation, or if a decision has been made regarding 'registration vs compliance'?
Section L-5.3.6 of the most recent draft RFP states a requirement to provide ISO registration verification - identical to the previous (23 Dec) draft ("L-5.3.6 Pages Not Included in Page Count. The organizational chart, acronym list, ISO registration verification, ..."). In the previously released Q&A, Question 48 and other ISO Registration-related questions were answered, " The Government is still considering its approach for ISO registration vs. ISO compliance."
The way this requirement is stated in the Training RFP (#-24) is not consistent with the way the identical requirement is (and was previously) stated in the Ops/Log RFP (#23).
In the Ops/Log RFP (#-23), the ISO 9001 registration requirement is specifically stated in 4 places:
1) L-5.3.6 (consistent with #24), but also...
2) the table in L-7.3 (Tech Volume requirements),
3) L-7.3.1.3 (QMS requirements, part of Tech Vol), and
4) M-3.2.1.3 (QMS evaluation methodology).
For the Training Support Services ID/IQ, Offerors shall comply with PWS paragraph 3.1.1, which is different than this same paragraph in the Operations and Logistics Support ID/IQ.
31
Draft RFP, Section M, M-1.2
The Government intends to award the CN> Training Support Services multiple award ID/IQ contract to a target of eight (8) Small Businesses Contractors. This is a total small business set-aside under NAICS 541330, . . .
a) What is the rationale for making this a total Small Business set-aside award, vice Full & Open and SBSA multiple award like Operations & Logistics?
b) For the past 3 years the approach for the Training award has been a mixed award (Large and Small businesses). Why the last minute change to a total Small Business set-aside award?
a) Market research proved that there are capable small businesses to do a Small Business Set-Aside.
b) The Government, specifically ACC AMIC, determined that it was in the best interest of the Government to conduct their own Market Research and not rely on data that is over three years old.
In the November 2013 Industry Day held by Army Contracting Command, it was briefed that no exclusive teaming arrangements would be recognized. With the procurement now under AMIC, is that guidance still correct?
No, please review the FINAL RFP that has been posted. Please be aware the information that the Army Contracting Command provided was for the old solicitation that has been canceled and has no bearing on FA4890-14-R-0024.
The selection of the NAICS code for Engineering Services seems non-intuitive as compared to the draft PWS. There is no mention of engineering services in the PWS and only one of the 14 labor category families is engineering related. Recommend a consideration for 541690 as the NAICS code for the TSS IDIQ.
The Government believes the NAICS 541330 provides a better fit with a higher size standard, which will allow for better competition.
What is your plan if any or all of the Small Business awardees get acquired by larger companies. I know there are several companies currently pursuing the TSS IDIQ that are openly looking to be acquired. Is your plan to allow them to continue to bid and win task orders?
If a company is acquired, the Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. Refer to FAR 52.219-28.
