SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
INSTRUCTIONS TO OFFERORS
INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS
1.0 General Information
a. This is an all-electronic solicitation release. Hard copies are not available. The Government will post all information pertaining to this solicitation and award of this requirement to the Federal Business Opportunities
(FBO) website, www.fbo.gov. It is the responsibility of each offeror to review the web pages for postings of updates, amendments, changes etc. to current information.
b. All prospective offerors are highly encouraged to attend the pre-proposal site visit. All offerors are reminded that any questions must be submitted to the following points of contact in writing to johnathan.anderson.2@us.af.mil and barry.jundt@us.af.mil by a date and time to be specified. Failure of a prospective offeror to submit any questions or attend the conference will be construed to mean that the prospective offeror fully understands all requirements of the solicitation. Answers to questions will be posted to the FBO website on a date specified following the final site visit. All prospective offerors are advised that this solicitation will remain unchanged unless it is specifically amended in writing. If an amendment is issued, normal procedures relating to the acknowledgment and receipt of any such amendment as described in FAR Clause 52.215-1, Instructions to Offerors—Competitive Acquisition shall apply.
c. The Contracting Officer (CO) will promptly notify offerors of any decision to exclude them from the competitive range; whereupon, they may request and receive a debriefing in accordance with FAR 15.505. Offerors excluded from the competitive range may request a pre-award debriefing or they may choose to wait until after the source selection decision to request a post-award debriefing. However, offerors excluded from the competitive range are entitled to no more than one debriefing for each proposal. The CO will notify unsuccessful offerors in the competitive range of the source selection decision in accordance with FAR 15.506. Offerors desiring a debriefing must make their request in accordance with the requirements of FAR 15.505 or 15.506, as applicable.
d. If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale as well as the remedies the offeror is asking the CO to consider as related to the omission or error. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion. This reservation includes matters of additional or substitute pages of the initial proposal.
e. Exchanges of source selection information between Government and offerors will be controlled by the CO.
Email may be used to transmit such information to offerors only if the email can be sent and received encrypted and includes “Source Selection Information – See FAR 2.101 & 3.104” in the Subject line. Otherwise, source selection information will be transmitted via https://safe.amrdec.army.mil/safe/.
2.0 General Instructions
a. The offeror's proposal must include all data and information requested by this Instructions to Offerors
(ITO) and must be submitted in accordance with these instructions. The offer shall be compliant with the requirements as stated in the Statement of Work (SOW). Non-conformance with the instructions provided in this
ITO may result in an unfavorable proposal evaluation.
b. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements but rather shall provide convincing rationale to address how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience and will base its evaluation on the information presented in the offeror's proposal.
c. Elaborate brochures or documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired.
d. The proposal acceptance period is specified in Section A of the model contract/solicitation. The offeror shall make a clear statement in Section A of the proposal documentation volume that the proposal is valid through this date.
e. In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
f. The seed project (initial task order) price proposal plus contract forms (Part I) and past performance information (Part II) shall include documentation as listed under Specific Instructions. The price proposal must be based on the offeror’s proposal for the seed project as set forth in the task order solicitation documents attached to the solicitation. The Government will evaluate the proposal in accordance with Section M, Evaluation Factors for
Award. Offerors shall submit 1 original and 1 copy of Part I, Price Proposal and Part II, Past Performance
Information.
g. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of two (2) separately bound parts, Part I - Price
Proposal, and Part II - Past Performance Information.
h. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.
i. Joint Venture Offerors: If the offeror is a joint venture, the offeror shall provide all required solicitation information for all parties including a copy of the joint venture agreement with proposal. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the joint venture. If the joint venture is comprised of 8(a) firms, the Small Business Administration (SBA) must approve the joint venture agreement prior to award. Past performance information may be submitted on behalf of the joint venture by either party to the joint venture. Joint venture past performance will be evaluated and rated on the basis of either party’s past performance. Joint Venture Agreements must be received by the SBA prior to proposal due date and approved before award of a resultant contract. No corrections and/or changes are permitted after the time for submission of offers.
j. Teaming/Partnering Offerors: If the offer is based on a teaming/partnering relationship, the offeror shall provide all required solicitation information for all parties, including a copy of the teaming/partnership agreement.
The agreement shall include information, which identifies the responsibilities for each entity under this contract.
The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the teaming/partnering relationship.
3.0 Specific Instructions:
3.1 – PRICE PROPOSAL - Submit original and one (1) paper/hard copy
a. Complete blocks 14, 15, 16, 17, 18, 19 ( if applicable), 20A, 20B and 20C of the RFP Section A of the
SF1442, In doing so, the offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. These sections constitute the model contract.
b. Insert proposed unit prices for the seed project on the Seed Project Task Order Price Schedule (see
Attachment 6, Seed Project Task Order RFP Request Package).
c. Complete the necessary fill-ins and certifications in Sections C through K. Sections G and K shall be returned in their entirety. For Sections C through I, the offeror shall submit only those pages that require a fill-in.
d. If applicable, provide a letter from the SBA showing proof of Section 8(a) status.
e. Submit teaming arrangements/agreements documentation. Teaming agreements/joint ventures must fully comply with legal requirements and must also be fully disclosed in Section K, Representations and Certifications, as to Business Size Standards. The joint venture/new business entity must be registered in the System for Award
Management (SAM.gov) prior to the date set for receipt of proposals. Offerors are advised to review the penalties prescribed for making false representations under Title 10 U.S.C. 1001.
3.2 – PAST PERFORMANCE INFORMATION - Limited to no more than 5 pages per contract listed. Only references for same or similar type contract desired. Submit original and one (1) paper/hard copy.
a. Quality and Satisfaction Rating for Contracts Completed in the Past Three years: Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contract. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc. Past
Performance Questionnaires are also requested. These should be forwarded by the offeror to previous customers for completion and submission to the 19th Contracting Squadron not later than ten (10) days prior to the due date for proposals.
b. Performance Surveys: The government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this RFP. The government will use information submitted by the offeror and other sources such as other Federal Government offices and systems (i.e. Past Performance Information Retrieval
System, PPIRS.gov) and commercial sources, to assess performance. Provide a list of up to ten (10) of the most relevant contracts performed for Federal agencies and/or commercial customers within the last three (3) years.
Relevant performance includes performance of efforts that are similar or greater in scope, magnitude and complexity to the seed project described in this solicitation. A relevancy determination of the offeror’s present and past performance, including joint ventures, subcontractors and/or teaming partners will be made. The offeror must provide the name of the company or Government agency, point of contact and phone number for each reference.
The Government may contact these organizations and individuals to verify information and/or gather additional information. In determining relevancy for individual contracts, consideration will be given to the effort, or portion of the effort being proposed by the offeror, teaming partner, or subcontractor whose contract is being reviewed and evaluated. Higher relevancy will be assessed for those contracts that are most similar to the effort, or portion of the effort, for which that contractor is proposing. The Government is not bound by the offeror’s opinion of relevancy.
The following relevancy definitions apply:

Complexity is defined as the ability to perform and manage several large design-build project task orders at the same time and/or ability to successfully perform and manage multi-disciplined task orders of a similar or higher magnitude than described by this solicitation.
The evaluation of past performance information will take into account past performance information regarding predecessor companies, key personnel who have relevant experience, major subcontractors, and teaming contractor/partner that will perform major or critical aspects of the requirement will be considered as highly as past performance information for the principal offeror. Furnish the following information for each contract listed:
(i) Company/Division name
(ii) Product/Service
(iii) Contracting Agency/Customer
(iv) Contract Number
(v) Contract Dollar Value
(vi) Period of Performance
(vii) Verified, up-to-date name, address, FAX & telephone number of the contracting officer
(viii) Comments regarding compliance with contract terms and conditions
(ix) Comments regarding any known performance deemed unacceptable to the customer, or not in accordance with the contract terms and conditions.
c. Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. (This letter will not be counted towards the five (5) page limit per contract as stated under paragraph 3.2 of this document.)
d. – RESPONSIVENESS DETERMINATION
a. Documents submitted in response to this RFP must be consistent with the following to be determined responsive:
(i) Requirements of the RFP (Contract Line Items Numbers (CLINs), Specifications and Statement of Work
(SOW), and government standards and regulations pertaining to the SOW.
(ii) Evaluation Factors for Award in Section M of this RFP.
(iii) Any limitation on the number of proposal pages. Pages exceeding the page limitations set forth in this
Section L will not be read or evaluated, and will be removed from the proposal.
(iv) Format for proposal Part II shall be as follows:
(1) A page is defined as one face of an 8 ½” x 11” sheet of paper containing information.
(2) Typing shall not be less than 12 pitch.
INFORMATION REGARDING SUBMISSION OF PROPOSAL: All proposals must be either hand carried or mailed (i.e. USPS, FEDEX, DHL, UPS etc.) directly to the 19th Contracting Squadron, 642 Thomas Avenue, Little
Rock AFB, AR 72099-4971. The sealed envelope/package used to submit your proposal must show the time and date specified for receipt, the Solicitation Number, and the name and address of the offeror. Faxed or emailed proposals WILL NOT be accepted.
Offerors are cautioned that Little Rock AFB, AR has visitor control procedures requiring individuals not affiliated with the installation to obtain a visitor pass prior to entrance. SOME DELAY SHOULD BE ANTICIPATED
WHEN HANDCARRYING PROPOSALS. Offerors should allow sufficient time to obtain a visitor pass and arrive at the 19th Contracting Squadron PRIOR to the time specified for receipt. Late proposals will be processed in accordance with FAR 15.208(b) “Submission, Modification, Revision, and Withdrawal of Proposals.”
