QUESTIONS AND ANSWERS

SOLICITATION FA4416-08-R-0010

27 JUNE 2008

Question 1: Technical Exhibit 1 starting on page 57 of the Specifications lists several design analysis items (e.g., Civil, Architectural/Structural, Mechanical, Electrical etc.) that are to be included in the coefficient. The cost and unpredictability of the necessity for design analysis will require the contactor to increase its coefficient to account for the possibility of this requirement, thus increasing the cost to the Air Force for every task order, whether or not design analysis is required. To reduce both the risk to the contractor and the cost to the Government, would the Government consider removing design analysis from the coefficient and instead including it, as needed, in individual delivery orders? If this is not possible, can the Government provide an estimate of how much of the work will require design analysis for the various disciplines?

Answer 1: The government is in agreement. Design should NOT be included in the coefficient. Design costs will be covered on a project by project basis.

Question 2: Based on the response to Question 27 during Industry Day, projects assigned under the SABER will “require minimum design; typically not exceeding 35%”. In order to provide the most cost-effective coefficient, will the Government provide an estimate of the number of task orders that will require this level of design or should the contractor anticipate in their cost and schedules, the delivery of 35% design documents on all projects under the SABER program?

Answer 2: Greater than 35% design is only required in approximately 10% of SABER projects.

Question 3: Under section “FURNISHINGS”, 12.1 notes that the information counter must “support two computers and monitors”. Question 13 answer notes for support of “three computers”

Should the information counter support 2 or 3 computers? Does the number of computers imply the number of workers at the information counter? The number of workers will affect the design (furniture, comm., elec.) and cost of the information counter.

Answer 3: The information counter should support 2 computers and monitors and two workers.

Question 4: My firm would like to know the incumbents coefficient(s) for the base and option years for each facility. We are requesting this info from you because doing so under the FOI Act procedures would prevent us from receiving the info in a timely manner.

Answer 4: In accordance with the Freedom of Information Act (FOIA) it is encouraged that the Government make available to the public information and all records. However, as established by Canadian Commercial Corp. v. U. S. Air Force, Court of Appeals for the District of Columbia, 29 Jan 08, the FOIA release exemption of (b)(4) “Trade secrets and commercial or financial information obtained from private source which would cause substantial competitive harm to the source if disclosed”, applies to all unit item prices (or coefficients) and therefore, can not be released.

Question 5: Does the Joint-Venture, Teaming, or Partnership arrangement have to be approved before bid date...regulation says no...before award but we would like clarification.

Answer 5: In accordance with the Small Business Act 13 CFR 124.513(e) “Prior approval by SBA. SBA must approve a joint venture agreement prior to the award of an 8(a) contract on behalf of the joint venture”. The joint venture has to be approved prior to the award of the contract not the proposal due date. Please refer all 8(a), joint venture, teaming, partnering questions to the SBA.

Question 6: Is the offeror required to name key personnel & submit key personnel resumes with the original copy of the Tech Proposal (& four redacted copies) or is it preferred that the offeror identify the key positions only by job description and position qualifications in the proposal and submit resumes after time of award for approval prior to NTP?

Answer 6: Resumes are NOT required prior to award because specific personnel are subject to change. In accordance with Volume II, Subfactor 1 of the solicitation offerors shall address their management organization, including a description of functions, authorities and credentials of key management personnel fulfilling at a minimum the personnel requirements specified within the contract specification paragraph 2.1.

Question 7: Is past performance only supposed to cover contracts and the contract value within the past three years?

Answer 7: The intent is to evaluate JOC or SABER contracts with some or all of the performance occurring during the last three years, considering the total value of the contract which would include all option years’ prices.

Question 8: Will the date response to the RFP are due change from July 3rd, 2008?

Answer 8: No, the due date for proposals remains 3 July 2008. In accordance with amendment 1 of the solicitation posted 3 June 2008, “the required response/proposal due date for past performance questionnaires is hereby changed from 16 June 2008 04:00 PM DST to 3 July 2008 04:00 PM DST,” and “the required response/proposal due date for volumes I, II, III, and IV is hereby changed from 23 June 2008 04:00 PM DST to 3 July 2008 04:00 PM DST.”

Question 9: The RFP requires 4 volumes – can volumes 1-4 be included in one three ring binder with tabs to separate the volumes for the original of a team’s response to the RFP?

Answer 9: No, the volumes are to be submitted independently of the others. Please follow the guidance stated on page 39 of 55 of the solicitation “Section L, PREPARATION OF PROPOSALS, paragraph D. Preparation instructions:”.

Question 10: It appears that three additional copies of Volume 1, one additional copy of Volume 4, and 4 additional redacted copies of volumes II and III are required. Would the government consider requiring non-redacted copies of volumes II and III and also requiring the same number of copies of all 4 volumes so that they could be provided in one 3 ring binder for each copy?

Answer 10: No, please provide “copies” as dictated in Section L, PREPARATION OF PROPOSALS, paragraph D.6. Copies:”.

Question 11: Bid Bond- In numerous locations the RFP indicates that no bid bond is required followed by a statement that a bid bond is required – is this correct?

Answer 11: In accordance with the solicitation, page 16 of 55, Bid Bonds are not required with the proposal. However, a bid guarantee in the form of a firm comitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier’s check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States will be required in the amount of 20 percent of the contract minimum or $40,000; whichever is less.

Question 12: Technical Exhibit 1: Para 3.3.2.4.1.4 – We are asked to carry subcontractor cost as part of our coefficient. Please clarify. Should this be carried as NPI?

Answer 12: No, subcontractor cost should not be kept as a non-priced item.

Question 13: Technical Exhibit 1: Para 3.3.2.5.3 – We are asked to carry subcontractor cost as part of our coefficient. Please clarify. Should this be carried as NPI?

Answer 13: No, subcontractor cost should not be kept as a non-priced item.

Question 14: For how long should we maintain the project records/files after it is completed?

Answer 14: In accordance with FAR 52.222-8 “Payrolls and Basic Records”, Payrolls and basic records relating thereto shall be maintained by the Contractor during the course of the work and preserved for a period of 3 years thereafter for all laborers and mechanics working at the site of the work.

Question 15: Technical Exhibit 2- What is the purpose of this form?

Answer 15: Tech Exhibit 2 is a record form that the contractor will use to submit to the government for the purpose of keeping track of all equipment that are purchased/ installed for each project; this form will be submitted to the CO within 10 days of final inspection, per spec 5.2.6.6. This form doesn’t replace any warranty/ guarantee paperwork that they are to submit as well.

Question 16: Will the Government reconsider the requirement to apply a proposal coefficient to the demonstration project estimate?

Answer 16: The demonstration project estimate shall not be used to determine the contractor’s price. It is used to determine the contractor’s ability to correctly apply the city cost index and coefficient to typical SABER type projects/delivery orders. The contractor’s coefficient is the single determinate in the price evaluation. The Government will not reconsider the requirement to apply a proposal coefficient to the demonstration project estimate.

Question 17: On page 40 of the original solicitation it states "each offeror is limited to provide no more than ten (10) past performance references". In the case of a Joint Venture and/or Prime Subcontractor, is the requirement still a total of 10 (for all participants) OR is it limited to 15 pages?

Answer 17: Each offeror is limited to provide no more than ten (10) recent and relevant past performance references for each party to the Joint Venture or Teaming partner and no more than ten (10) recent and relevant past performance references for any significant subcontractors that will perform major critical aspects of the requirement.

Question 38: I noticed on page 41 of the solicitation that if a teaming arrangement is contemplated, our teaming party would also need to provide a list of past and present relevant contracts (no more than 10). We are working closely with a design consultant for this proposal and would like to include some of the firm's relevant contracts. My question regards the page count for Volume 1. Do we each have a 15-page maximum for Volume I or do we have a 15-page maximum combined?

Answer 38: The 15 page limitation is per offer and should contain all applicable information the offeror wishes to submit.

Is it the Air Force’s intent that this is a copy of the official Joint Venture or Teaming agreement, or just an explanation describing the offeror? If it is a copy of the agreement, would the Air Force please consider excluding this from the page limitations, as the agreement may exceed 15 pages, and inclusion will prevent the offeror from submitting any additional information, and will put any JV or teaming arrangement at a significant disadvantage.

Answer 40: A copy of the official Joint Venture or Teaming agreement is required. This documentation will not count against the 15-page limitation for Volume I of the proposals.

Question 41: Section L, Item III, in the instructions for the Demonstration Project, the Solicitation indicates that the Offeror should apply the “applicable co-efficient” to their estimate. This will result in the Offeror’s price being revealed prior to the evaluation of the Pricing volume. Would the Air Force consider instead requiring an estimate for the Demonstration Project utilizing a coefficient of 1.0 for evaluation purposes?

Answer 41: No, part of the evaluation is verifying that each offeror accurately applies their unique coefficient to the demonstration project estimate. This evaluation will have no bearing on the evaluation of price.

Question 42: Please supply a list of general contractors for this project. We would like to explore sub-contracting opportunities.

Answer 42: No, a list of offeror’s is not available.

Question 43: On page 3 of Attachment 5, the questions in "Section II Timely Performance" are exactly the same as the questions in "Section IV Compliance with Labor Standards" on page 4. Is this correct?

Answer 43: Yes, please use the Past Performance Questionnaire posted in Amendment 1.
