SECTION H - SPECIAL CONTRACT REQUIREMENTS
The following have been modified:
SPECIAL CONTRACT REQUIREMENTS
Section H – Special Contract Requirements
H-1. CLAUSES INCORPORATED BY FULL TEXT
1. Clauses and provisions from the Federal Acquisition Regulation (FAR) and supplements thereto are incorporated in this document by reference and in full text. Those incorporated by reference have the same force and effect as if they were given in full text.
1. Clauses and provisions in this document will be numbered in sequence, but will not necessarily appear in consecutive order.
1. Sections K, L and M will be physically removed from any resultant award, but will be deemed to be incorporated, by reference, in that award.
H-2. REQUIRED INSURANCE (IAW FAR 28.306(b))
In accordance with FAR 52.228-5, the Contractor shall maintain insurance coverage as prescribed by the laws of the State in which this contract service is to be performed.
H-3. CONSERVATION
The SP shall actively participate in all energy conservation efforts and programs and shall instruct employees in utilities conservation practices, including but not limited to:
(a) Lights shall be used only in areas where and when work is actually being performed.
(b) Mechanical equipment controls for heating, ventilation, and air conditioning systems shall only be adjusted by maintenance personnel.
(c) Water faucets or valves shall be turned off after required usage has been accomplished.
H-4. CONTRACTING OFFICER'S AUTHORITY
The Contracting Officer is the only person authorized to approve changes in any of the requirements under this contract and notwithstanding any provisions contained elsewhere in this contract, the said authority remains solely in the Contracting Officer. In the event the contractor effects any such change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority.
H-5. WAGE PASS THROUGH ADJUSTMENT COSTS
This contract is subject to the requirements of the Service Contract Act as amended, and attention is invited to the obligations of the SP under Section 4(c) of the amended Service Contract Act. Any questions regarding the extent to these obligations should be addressed to the Department of Labor.
All wage pass through costs will be processed in accordance with FAR 52.222-43, Fair Labor Standards Act and Service Contract Act-Price Adjustment (Multiple Year and Option Contracts). The addition of a "not to exceed" amount wage adjustment line item will be added by modification to the basic contract. The SP will be required to submit on a monthly basis an itemized billing and certify its accuracy. Labor categories shown on the billing shall be covered by the Service Contract Act (Department of Labor Wage Determination) or a conformable wage agreement in writing in the basic contract. Salaries of project managers, non-working supervisors, and other indirect salaried employees are excluded.
H-6. MOBILIZATION AND SERVICE PROVIDER CHANGEOVER
Phase-In/Orientation Period
The SP will not be relieved from assuming responsibility resulting from improperly estimating the difficulties or the cost of performing the services required because of failure to investigate the conditions or to become acquainted with all information concerning the services to be performed.
The SP shall begin phase-in only after post award conference and in accordance with the requirements contained in the submitted mobilization plan. The SP is expected to be at full performance at the completion of the mobilization period.
To ensure a smooth transition in the change of work effort from incumbent SP to new SP, the new SP shall begin an orientation to:
Become thoroughly familiar with work requirements and work procedures.
Finalize development of necessary work plans and procedures.
Complete personnel requirements (work force) including the hiring of personnel to assure satisfactory performance beginning on the contract start date.
Obtain security clearances, if required.
Complete training requirements and accomplish necessary training of new SP employees.
Finalize the development of quality control plans and procedures.
Immediately after award and prior to performance, the SP’s representative and the Quality Assurance Personnel (QAPs) shall make an on-site, in-depth review of the total job requirements. The SP will be allowed access to the facilities to familiarize supervisors, key personnel, and staff with equipment, reporting, work scheduling and procedures (including operations, priorities, safety, security, etc). To preclude interference with work production efforts of the current personnel, arrangements for access to Government facilities will be made with the Contracting Officer or Administrative Contracting Officer.
The SP shall make provisions for all required building, material, and equipment inventories to be conducted during the last ten (10) working days of the mobilization period. The SP shall coordinate these inventories with the QAPs so those appropriate representatives may be present for all inventories. The SP shall sign receipt for the items upon completion of the inventory. Responsibility for performance of the services covered shall also pass to the SP at that time. A proposed schedule for the inventories shall be included in the mobilization plan.
Phase-Out Period
The Government reserves the right to conduct site visits in all SP-operated facilities in conjunction with the solicitation of offers for any follow-on contracts. In the event a follow-on contract is awarded to other than the incumbent, the incumbent SP shall cooperate to the extent required to permit an orderly change over to the succeeding SP. This includes reasonable recruitment access to incumbent employees. A recruitment notice may be placed in each facility.
If there is a change in SP, the incumbent SP will provide orientation familiarization to the follow-on SP as described herein. During the phase-out familiarization period, the incumbent SP will be fully responsible for contract service.
The SP shall schedule all inventories to occur within fifteen (15) working days prior to exercise of options or the termination of the contract. The SP shall coordinate these inventories with the QAP so those appropriate representatives may be present. The incumbent SP shall provide sufficient numbers of personnel to conduct a joint inventory of all Government furnished equipment (GFE), Government provided facilities, publications, accounts, records, etc. with the successor SP and Government personnel to ensure inventories/accounts are accurate and complete. The incumbent SP shall ensure shortages, equipment/tool condition issues and other contract requirement issues are rectified prior to relinquishing GFE accounts to the Government. All official files, manuals, charts, records, drawings, and other official documentation are the property of the Government and shall remain on location. Prior to expiration/termination of this contract, and after selection by the Government of a successor SP, the SP shall work with the successor SP to develop a mutually agreeable transition plan detailing the procedures necessary between the outgoing and incoming SPs to ensure continuity of operations. The incoming SP shall meet all requirements established for the changeover of operations. This work shall include, but is not limited to, providing personnel for training in key operations, obtaining licenses and permits and completing inventory of facilities, materials, equipment, etc. All services required under this contract shall be maintained during this period. Transition requirements will be negotiated among the SP, the successor SP and the Government. Within five (5) days after completion of this contract, or as otherwise directed by the Contracting Officer, the SP shall remove all SP owned vehicles, equipment, tools, supplies, material or other items from Tyndall AFB, FL. The Government reserves the right to dispose of items remaining after the stated period, in accordance with Federal property regulations.
H-7. FEDERAL HOLIDAYS
The Federal holidays listed are holidays granted to Federal employees. In the event that any of these holidays occur on a Saturday or Sunday, they shall be observed by the SP per the practice observed by the Government. The SP shall develop and maintain a strike contingency plan that establishes procedures to cope with labor disputes among its workforce. One copy of the SP’s Strike Plan shall be provided to the Administrative Contracting Officer for acceptance not later than 30 days preceding the mobilization start date. Changes to the plan shall be submitted to the Administrative Contracting Officer within 45 days of occurrence.
H-10. TECHNICAL LIBRARY
The Government is incorporating the use of a Technical Library. The information contained within the Technical Library includes informational and workload data that Offeror’s will need to assist with the development of proposals. The Government will incorporate the information/data listed in the technical library into the PWS at a later date, and the information will use for negotiating changes to this contract.
H-11. NATURAL AND TECHNOLOGICAL DISASTER, EMERGENCY, MAJOR ACCIDENT, WAR RESPONSE AND RECOVERY
The Air Force (MAJCOM) has determined that natural disaster, major accident and war response and recovery times and associated activities for real world events will vary and post disaster and emergency recovery will vary with the degree damage. These events or times cannot be estimated for real world events, therefore there is no workload associated for these requirements. In the event that these events occur during the life of the contract, the Air Force (MAJCOM) expressly reserves the right to incorporate cost reimbursable CLINS to fund the support and completion of these requirements. Workload data located in PWS Sections 2 and 11 (Workload Estimates Data-Appendix B) for respective sections identifies those areas that are included in this Clause. Surge work generated by these real world emergency situations will be subject to separate negotiation. The separate negotiation would be for required overtime, additional materials, and longer-range recovery efforts. The SP shall, in accordance with government direction, reduce operations in non-critical Base Operating Support (BOS) areas and direct resources to meet surge requirements in response to disasters. If such a change should become necessary, the appropriate adjustments will be incorporated by the Administering Contracting Officer under the authority of FAR Clause 52.243-1.
H-12. STRATEGIC SOURCING INITIATIVES
The Air Force has several on-going Strategic Sourcing initiatives to meet their Custodial, Ground Maintenance, Landscaping, Refuse and Recycling needs. The requirements under this contract as defined by the Performance Work Statement (PWS) may be impacted by these efforts; however, to the extent to which the PWS would be affected cannot be determined at the time of this solicitation. Any workload changes caused by these initiatives will be incorporated via bilateral modification and workload specifics to each functional area affected will be adjusted accordingly upon implementation.
H-13. THE MEDICAL TREATMENT FACILITIES (MTF)
The Medical Treatment Facilities (MTF), one of AETC reimbursable customers, have requested approval to manage and provide services to maintain real property and real property installed equipment (RPIE) under their control via a service contract funded through their respective activity. Should a final decision be rendered to approve this initiative, the Government reserves the right to remove any or all of these requirements from the Base Operating Support (BOS) contract. Any workload changes caused by these initiatives will be incorporated via bilateral modification; workload specifics to each affected functional area will be adjusted accordingly upon implementation.
H-14. CONTRACTOR'S ACCOUNTING SYSTEM
Contractor agrees to maintain essentially the same accounting system during the period of this contract and any subsequent contracts awarded pursuant to the extended contractual coverage resulting from this solicitation. This accounting system will also meet the requirements of Public Law 87-653 and Cost Accounting Standards under Public Law 100-679 in supporting contract pricing proposals.
H-15. REIMBURSABLE CLINS
No overhead, G&A or Profit will be paid in support of CE Travel/Training, Minor Services, and Work Order Supplies & Materials.
H-16. MINOR SERVICES
In the event the Service Provider determines that a minor service within the scope of the contract requires performance by another vendor, the service provider shall obtain quotes from at least three vendors and present its proposal for that minor service to the QAP. The QAP shall present the proposal to the ACO for review and approval. Any approved proposal will be processed in accordance with Clause H-16, Reimbursable CLINs.
H-17. REPAIR AND REPLACEMENT OF GOVERNMENT FURNISHED PROPERTY (GFP)
The Government will turn-over the existing inventory of GFP, as listed in appendices F, and in accordance with the mobilization plan. Existing parts and materials will be provided at the start of full contract performance, to include, but not limited to raw and processed material, parts, components, assemblies, and supplies, that may be consumed in normal use in the performance of the contract. Materials also include CEMAS consumable items used in construction and maintenance such as lumber, hardware, cement, asphalt, environmental items. The service provider will not be required to maintain the same dollar value, types, and quantities of inventory throughout contract performance. The Government does not require the service provider to return the same level of initial inventory at completion of performance. The Government will only reimburse the Service Provider for repair, replacement, parts, and material as indicated in Section B and the PWS. Equipment Authorization Inventory Data (EAID) is listed in PWS appendices 11-FB, and non-EAID is listed in appendices 11-FC. Procurement of all new or replacement Government Furnished Property (GFP) necessary in the performance of this contract shall be by the service provider and funded against CLINS H-0017 with no fee, G&A and applicable overhead will be negotiated on each purchase. The service provider must obtain contracting officer approval prior to making any purchase.
H-19. CONTROL AND RELEASE OF INSPECTOR GENERAL REPORTS
The contractor shall not release any part of an Air Force or Major Air Force Command Inspector General report without the contracting officer’s written permission. The contractor shall promptly forward any Freedom of Information Act (FOIA) request related to an Air Force Inspector General report to the contracting officer for a release determination.
H-20. FUEL PRODUCTS
Government fuel products may be available for use by the service provider in service provider owned or leased vehicles and equipment and shall be used by the service provider in government owned or leased vehicles and equipment to perform the PWS requirements. Government fuel products that are issued to service provider owned or leased vehicles and equipment will be charged (based on the current DESC Price Bulletin + surcharge) to the service provider through the use of a ""T"" DoDAAC. Government fuel products that are issued to government owned or leased vehicles and equipment used by the service provider will be charged to the government. To obtain use of government fuel products, the service provider shall obtain a “T” DoDAAC by contacting DESC-RRR at Defense Logistics Agency Energy, Retail Management Division, DESC-RRR, 2261 Hughes Avenue, Suite 128, Lackland AFB, TX 78236-9828 COM (210) 925-4887 or DSN 945-4887.

1. VOLUME I – PRICE PROPOSAL: See Section E – General Information/Instruction. The Price Proposal shall be prepared according to these instructions and will be evaluated in accordance with the evaluation criteria in Section M of the Request For Proposal (RFP) for the Price Factor. Compliance with these requirements is mandatory and failure to comply may result in rejection of your proposal. Note that unreasonably low or high proposed prices, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the Offeror does not understand the requirement or has submitted an unreasonable proposal. The price proposed for mobilization should correspond to efforts described in the technical proposal for the mobilization approach; therefore, a very low price or a price of zero may be considered unreasonable. Additionally, unbalanced pricing poses an unacceptable risk to the Government and may be a reason to reject an Offeror’s proposal. Data beyond that required by this instruction shall not be considered or evaluated. The Volume I Price Proposal shall contain the following:
a. PRICE INFORMATION. The source selection will be conducted with the expectation of adequate price competition for this acquisition per FAR 15.403-1(c)(1)(i); therefore, certified cost or pricing data are not required per FAR 15.403-1(b)(1). However, because data is unavailable from the Government or other secondary sources to determine a fair and reasonable price, and in order to evaluate competing approaches and ensure each Offeror understands the Government’s requirements, the Offeror will be required to submit data other than certified cost or pricing data per FAR 15.402 and 15.403-3 as specified below. If at any time during this competition the Contracting Officer determines that adequate price competition no longer exists or that price reasonableness cannot be determined, Offerors may be required to submit certified cost or pricing data or additional data other than certified cost or pricing data, as appropriate, for the Contracting Officer to determine price reasonableness. The proposed prices shall be based on the Offeror’s own technical approach submitted in the Technical Proposal (Volume II) and the Government’s Performance Work Statement (PWS) requirements at Attachment 1.
(1) COST/PRICE MODEL. The Offeror shall complete the Cost/Price Model, IAW instucitons contained therein, provided at Attachment 5 of this RFP and submit (two) 2 hard copies and one e-version with the Volume I Price Proposal. Under no circumstances shall this data and documentation be included elsewhere in the proposal. For each performance period, which includes the base period plus four option periods, a unit price, rounded to two decimal places, shall be proposed and inserted for Firm- Fixed-Price (FFP) Contract Line Item Numbers (CLINs) X001 – X011 and 0015. Additionally, the Offeror shall complete the worksheet included in the Cost/Price Model to provide information on labor hours, labor dollars (burdened and unburdened), vehicles, and Other Direct Costs for each FFP CLIN for each performance period.
(2) SECTION B. The Offeror shall propose and insert a unit price, rounded to two decimal places, for each FFP CLIN of the Base Period and each Option Period. The extended amount must equal the unit price multiplied by the number of units. The prices proposed in Section B must correspond with the prices proposed in the Cost/Price Model at Attachment 5. If there is a price discrepancy between the Cost/Price Model and Section B, the price proposed in Section B will take precedence.
b. CONTRACT FORMS. Designate on the volume cover which proposal package contains the original, executed copy of the RFP. Include on each proposal cover letter or proposal cover page: name, office phone and fax number (and if applicable, cell phone number), and email address for each proposal point of contact. The Offeror must complete the following and include in Volume I:
(1) SF 33, Blocks 13-18, of the RFP Section A. In completing these blocks, the Offeror accedes to the contract terms and conditions as written in the RFP Sections A through K. See paragraph c(4) for Exceptions to Terms and Conditions.
(2) All necessary clause fill-ins in Sections I through K, Representations, Certifications and Other Statements of Offerors. Ensure compliance with RFP requirements if using the annual representations and certifications electronically via the Online Representations and Certifications Application (ORCA) website at http://orca.bpn.gov . If the Contracting Officer is unable to access the ORCA website to retrieve an Offeror’s annual representations and certifications, that Offeror may, upon request by the Contracting Officer, be required to submit a hard copy of their annual representations and certifications. This request will not be construed as communications or discussions with an Offeror IAW FAR 15.306.
(3) Submit a letter, signed at the vice-president level or equivalent or higher, that identifies the individual(s) with the authority to obligate or otherwise bind your company to the resulting contract and, if necessary, future contract modifications.
c. OTHER CONTRACTING CONSIDERATIONS
(1) Statement of Compliance with the Service Contract Act (SCA) and Collective Bargaining Agreement (CBA). The SCA Wage Determination (WD) provided at Attachment 2 and the CBA provided at Attachments 3 and 4 are applicable to this requirement. The Offeror shall provide a statement acknowledging that:
(a) they are in compliance with the requirements of the SCA WD and CBA,
(b) the prices proposed for labor covered by the SCA WD and CBA were formulated using the minimum wage and benefit rates specified in those documents as required for covered contractor personnel;
(c) the minimum wage and benefit rates specified in the SCA WD and CBA are not escalated beyond the basic period of performance (FAR 52.222-43(a) and (b)).
(d) The Offeror is also required to indicate what steps will be taken to ensure that, in the event a follow-on CBA is entered into, wages, fringe benefits, and periodic increases agreed to will not vary substantially from those prevailing for similar services in the same locality (FAR 22.1013); and
(e) The Offeror shall also verify that the proposed prices for each CLIN demonstrate a logical correlation to the staffing (e.g., Full Time Equivalents/man-years and man-hours, labor categories, skill mix) proposed in the Technical Proposal at Volume II.
(2) RESPONSIBILITY DETERMINATION. To assist in determining contractor responsibility in accordance with FAR Part 9.104, the Offeror shall explain how they plan to maintain adequate financial resources for a contract of this magnitude and length. Address fiscal plan for covering mobilization, unexpected or emergency situations, and initial performance costs prior to recoupment in the form of monthly invoice payments. Offerors must provide complete financial statements for one fiscal year and year-to-date financial information through the last quarter available. The year-end financial statements must be certified by an independent accounting firm, if practicable, or at least by an authorized officer of the organization. If the Offeror intends to rely on internally available working/operation capital, evidence of availability must be submitted. If the Offeror plans to rely on financial support from other sources, evidence of availability and the maximum lines of credit that may be available must be identified and must be based upon the inclusion of this contract effort. Evidence of external funding must be provided in the form of a dated letter from the external source. Documentation to support the amounts must also be included.
(3) TEAMING ARRANGEMENTS AND/OR LETTERS OF INTENT. If a teaming arrangement is contemplated, provide complete, verifiable information as to the arrangement, including any relevant and recent past performance information on previous teaming arrangements with same partner. Submit information relative to the formation, organization and operation of the business unit. Additional information that should be submitted shall include cost and revenue sharing agreements and any other information which describes the business arrangement. Disclose existing or planned agreements between and among the principals, each company’s responsibility for financial management of the venture, the business systems contemplated for use by the entity and their location. If this is a first time joint effort, each party to the arrangement must provide a list of relevant contracts.
(4) EXCEPTIONS TO TERMS AND CONDITIONS. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or sub-factors. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale in support of the exception, fully explaining its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation.
2. VOLUME II – TECHNICAL PROPOSAL: See Section E – General Information/Instructions.. Volume II shall be prepared in accordance with these instructions and Paragraph E of this section and will be evaluated in accordance with the evaluation criteria in Section M of the RFP for the Technical Factor. Volume II shall contain the following:
a. TECHNICAL APPROACH: This sub-factor evaluates the Offerors’ plan to sustain compliant contracted mission support with a trained workforce and in an environment that identifies and corrects deficiencies. The Offeror shall:
1) Provide an acceptable approach of how the PWS requirements will be accomplished.
2) Provide an acceptable approach to provide Contractor Provided tools and equipment (acceptable quantity and type) to accomplish the requirement of the PWS.
3) Provide an acceptable approach that addresses procedures to manage and update with accuracy AF CE legacy systems to include Automated Civil Engineer System (ACES), Interim Work Information Management System (IWIMS), etc. to accomplish the requirements of the PWS.
4) Provide and acceptable approach to meet the standards for managing the Bird/Airstrike Strike Hazard (BASH) program.
5) Address any risks that are considered to have an adverse impact to cost, schedule and performance relating to this factor and its sub elements. The proposal shall effectively identify risk mitigating strategies in a detailed plan to eliminate or reduce the risk.
b.MOBILIZATION APPROACH: This sub-factor evaluates the Offeror’s mobilization approach and ability to be prepared to achieve full performance on the first day of contract operations without degrading the 325 FW mission. The Offeror shall:
1) Provide a detailed description that adequately addresses recruiting, training, certifying, and qualifying personnel during the 45-day mobilization period that results in a sufficient number of fully qualified employees by contract start date.
2) Lists materials, equipment and vehicles (quantity/type) for which the service provider is responsible to provide and the plan to have referenced material and equipment available for use on the first day of the basic contract period.
3) Provide a time-line schedule with sound rationale, which addresses the start and completion of each event (e.g., interviewing, hiring, human resource actions, training, and start work dates).
4) Address any risks that are considered to have an adverse impact to cost, schedule and performance relating to this factor and its sub elements. The proposal shall effectively identify risk mitigating strategies in a detailed plan to eliminate or reduce the risk.
c. PROGRAM MANAGEMENT AND STAFFING APPROACH: This sub-factor evaluates the adequacy of the Offeror’s proposed staffing by shift, skill classification and work unit for the basic contract period and all option years. The proposal must demonstrate an organizational structure that the company will employ while performing this effort. It must address lines of authority, details of onsite personnel by skill mix, function and numbers. The proposal must provide rationale used to develop the organizational structure. The Offeror shall:
1) Provide an organizational structure which shows Full or Part Time Equivalents sufficient to accomplish the projected workload provided in the PWS detailed to the “shop/function” level and how you will maintain a qualified work force.
2) Demonstrate the approach that will be used to develop, manage and execute an effective Recurring Work Program (RWP).
3) Demonstrate the approach to manage and maintain the power production, Industrial Control Systems (ICS), utility service, fire protection and airfield lighting systems.

6) Demonstrate the approach for continuous operations support to meet the mission during peacetime, contingency, and strike situations.
7) Provide a plan for continuous coverage of one-deep positions.
8) Provide the calculations and rationale used to arrive at the proposed structure including productive hour calculations that correspond with the Attachment 6 “Manpower Matrix”.
9) Provide a plan which describes how the offeror will use manpower with appropriate skill levels and skill mix, including workforce composition broken out as follows:
a. A completed Staffing/Manpower Matrix (Section J, Attachment 6).
b. Number of full time staff-month equivalents hires.
c. Part-time or temporary staff-year equivalent hires.
d. Specialty skill mix by Service Area.
e. Staffing calculations to reflect the proposed number and percentage of direct, indirect, and overhead labor for each option period.
f. Actual staff-years programmed to be in the workforce (each contract period) including lapse.
g. Total staff-years priced as indicated in the cost proposal. NOTE: The staff-years priced in the technical and cost proposals must match. If not, the cost proposal data will have precedence.
h. Anticipated lapse rate percentage (each contract period). A lapse rate factor is comprised of pricing/staffing figures to compensate for personnel turnover, excess sick leave, excess annual leave, etc.) NOTE: A zero lapse rate is unrealistic since it assumes that no employee will quit, retire, die, or require excess sick leave or annual leave without a trained replacement being in place.
i. Number of overtime staff-hours.
10) Provide a description of the teaming arrangements with any subcontractors or joint ventures including the organizational relationship and the responsibilities between the prime and subcontract employees.
11) Demonstrate a proposed sufficient Quality Control organization, including lines of authority that will successfully evaluate compliance, find and document problems and monitor corrective actions ensuring successful and timely problem resolution and explains how recurring problems will be prevented.
12) Address any risks that are considered to have an adverse impact to cost, schedule and performance relating to this factor and its sub elements. The proposal shall effectively identify risk mitigating strategies in a detailed plan to eliminate or reduce the risk.
3. VOLUME III – PAST PERFORMANCE INFORMATION: See Section E – General Information/Instruction. Volume III shall be prepared in accordance with these instructions and Paragraph E of this Section L. Each Offeror’s proposal will be evaluated in accordance with the evaluation criteria in Section M. Volume III shall contain the following:
a. Contents. The Offeror shall submit a Past and Present Performance Volume containing the following:
1) Table of Contents
2) Summary Page describing the role of the Offeror and each subcontractor, teaming partner, and/or joint venture partner that the Offeror is required to provide Past Performance Information Sheets in accordance with paragraph 3.
3) Past Performance Information Sheets. Submit information on no more than seven (7) contracts (including proposed major sub-contractors, teaming partners, joint venture partners) that you consider relevant in demonstrating your ability to perform the proposed effort. The Offeror shall submit Past Performance Information Sheets in accordance with the format contained in Attachment 8. This information is required on the Offeror and subcontractors, teaming partners, and/or joint venture partners proposed to perform the proposed effort based on the total proposed price, or perform aspects of the effort the Offeror considers critical to overall successful performance. The Offeror shall submit Past Performance Information Sheets identifying active or completed contracts, either Government or commercial, for each prime, teaming partner, and/or joint venture partner (within the same division or cost center) and for a subcontractor performing meaningful or critical work. Each relevant contract shall have been performed during the past three (3) years from the date of issuance of this solicitation, except that ongoing programs must have begun no less than three (3) months from issuance of the RFP. The Past Performance Information Sheet for each contract is limited to five (5) pages. The Government will use data provided by each Offeror in this volume and data obtained from other sources in the evaluation of past and present performance. The following may be provided as part of the Past Performance Information Sheet(s), as applicable:
a) Quality and Satisfaction Rating for Contracts Completed in the Past Three (3) Years: Provide any information currently available (letters, metrics, customer surveys, independent surveys, etc.) which demonstrates customer satisfaction with overall job performance and quality of completed product for same or similar type contracts. In addition, explain corrective actions taken in the past, if any, for substandard performance and any current performance problems such as cost overruns, extended performance periods, numerous warranty calls, etc.
b) Submit information on contracts that you consider relevant in demonstrating your ability to perform the proposed effort. Include rationale supporting your assertion of relevance. For a description of the characteristics or aspects the Government will consider in determining relevance, see Section M, paragraph C(3)(B)(2). Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort, and to what aspects of the proposed effort they relate. To clearly link the past performance information to the technical capability sub-factors, the Offeror should identify which contracts are relevant indicators of performance against a technical capability sub-factor. Categorize the relevance information into the specific evaluation sub-factors used to evaluate the technical proposal:
Sub-factor 1: Technical Approach Sub-factor 2: Mobilization Approach Sub-factor 3: Program Management and Staffing Approach
4) Specific Content. Offerors may include a discussion of efforts accomplished by the Offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. Merely having problems does not automatically equate to a Limited or a No Confidence rating, since the problems encountered may have been on a more complex program, or an Offeror may have subsequently demonstrated the ability to overcome the problems encountered. The Offeror is required to clearly demonstrate management actions employed in overcoming problems and the effects of those actions, in terms of improvements achieved or problems rectified. This may allow the Offeror to be considered a Substantial Confidence or Satisfactory Confidence candidate.
5) Subcontractor Letters of Consent and Client Authorization Letters.
a) Subcontractor Letters of Consent. Past performance information pertaining to a subcontractor cannot be disclosed to the prime Offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor. Consent Letters executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing the release of past performance information so the Offeror can respond to such information.
b) Client Authorization Letters. If applicable, Offeror must also include Client Authorization Letters for each identified effort performed for a commercial customer, authorizing release to the Government of requested information on the Offerors performance.
6) Organization Structure Change History. Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant present or past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this acquisition. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of your company. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance evaluation/performance confidence assessment. Since the Government intends to consider present and past performance information provided by other sources as well as that provided by the Offeror(s), your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
7) Questionnaires. The Government will send out a Past Performance Questionnaire to each of the POC identified in the Past Performance Information Sheets. Ensure the POC provided is available and knowledgeable of the service provided under contract. The POC will be asked to submit completed questionnaires directly to the Government. Once the Past Performance Questionnaire is completed by the POC and submitted to the Contracting Officer, the information contained therein shall be considered sensitive and shall not be released to the Offeror.
