About this file

This is an Insurance Requirements exhibit for the Texas Health and Human Services Commission (HHSC) Department of Family and Protective Services (DFPS) Child Protective Post Adoption Services contract (RFP No. HHS0016376). The exhibit establishes comprehensive insurance coverage mandates that contractors must maintain throughout the contract term, which extends from the anticipated September 2026 start date through the initial four-year term and any subsequent one-year renewal extensions. All insurance policies must be delivered to the System Agency prior to contract award and updated upon expiration, with failure to maintain required coverage potentially resulting in work suspension or payment withholding. Contractors must obtain certificates of insurance from authorized insurers rated A or better by A.M. Best Company, and policies must include provisions for 30-day cancellation notice to HHSC, designation of HHSC as an additional insured, and waiver of subrogation in favor of HHSC.

The specific insurance requirements include Workers' Compensation coverage per Texas statutory requirements with employer's liability limits of $1,000,000 each accident and disease; Commercial General Liability with $1,000,000 per occurrence and $2,000,000 aggregate limits including an Abuse and Molestation Endorsement; Comprehensive Automobile Liability with $1,000,000 combined single limits; Cyber/Privacy Liability Insurance with $5,000,000 claim and aggregate limits covering data breaches and regulatory penalties; Professional Liability Insurance of $5,000,000; Umbrella Liability Insurance of $5,000,000 with drop-down coverage; and Crime Insurance of $1,000,000 per occurrence covering employee dishonesty with HHSC listed as loss payee. Contractors must extend identical insurance requirements to subcontractors either through individual policies or by including subcontractors as additional insureds on primary coverage, with certificates retained for the contract duration plus seven years. HHSC reserves the right to consider alternative insurance methods upon contractor request with detailed justification for inability to obtain standard coverage.
