About this file
This is a Declaration of Eligibility to Contract form required by the City of Pasadena for the Construction Manager at Risk (CMAR) with Guaranteed Maximum Price project for the Transit Operations Maintenance Facility. The declaration certifies that the bidding contractor is not debarred or ineligible to perform work on California public works projects under Labor Code Sections 1777.1 and 1777.7, and confirms compliance with Public Contract Code Section 6109 requirements. The contractor must affirm that it has investigated the eligibility of all intended subcontractors and determined that none are ineligible to perform work on the project. The mandatory pre-proposal meeting is scheduled for April 28, 2026, with questions due by May 22, 2026, and proposals due June 8, 2026 at 2:00 PM; interviews are tentatively scheduled for June 22-25, 2026. Phase 1 preconstruction services are estimated to commence in July 2026 and complete by January 2027, while Phase 2 construction is estimated to commence in March 2027 with substantial completion required by June 2028 and final completion by July 2028, with liquidated delay damages assessed at $19,000 per day if Phase 2 substantial completion is not achieved.
The contractor must be licensed by the California Contractors State License Board (Class A or B) with a minimum of five years of business experience and completion of at least three prevailing wage public contracts in California. Proposers must demonstrate three similar projects exceeding $70 million in value within the preceding ten years and maintain bonding capacity exceeding $60,000,000. Insurance requirements for Phase 1 include $1,000,000 Commercial General Liability, $1,000,000 Automobile Liability, Workers' Compensation with statutory limits, and $2,000,000 Professional Liability; Phase 2 substantially increases to $30,000,000 Commercial General Liability, $5,000,000 Automobile Liability, and Builder's Risk coverage. All contractors and subcontractors must be registered with the California Department of Industrial Relations and comply with prevailing wage requirements. The project is partially funded by the Measure R Mobility Improvement Grant administered by the Metropolitan Transportation Authority. Evaluation criteria are weighted as follows: experience and references (20%), organization and key personnel qualification (20%), project approach and methodology (30%), financial strength and stability (5%), safety record/Experience Modification Rate (5%), local Pasadena business preference (5%), small or micro-business certification (5%), CMAR price proposal (10%), and interview performance (50 additional points). The estimated direct construction cost is $60,000,000, exclusive of preconstruction services, general conditions, contingency, bonds, and insurance.

DECLARATION OF ELIGIBILITY TO CONTRACT
[Labor Code Section 1777.1; Public Contract Code Section 6109]
The undersigned, a duly authorized representative of Contractor, certifies and declares that:
The undersigned contractor is aware of Sections 1777.1 and 1777.7 of the California Labor Code, which prohibit a contractor or subcontractor who has been found by the Labor Commissioner or the Director of Industrial Relations to be in violation of certain provisions of the Labor Code, from bidding on, being awarded, or performing work as a subcontractor on a public works project for specified periods of time.
The undersigned Contractor is not ineligible to bid on, be awarded or perform work as a subcontractor on a public works project by virtue of the foregoing provisions of Sections 1777.1 or 1777.7 of the California Labor code or any other provision of law.
The undersigned contractor is aware of California Public Contract Code Section 6109, which states:
A public entity, as defined in Section 1100 [of the Public Contract Code], may not permit a contractor or subcontractor who is eligible to bid or work on, or be awarded, a public works project pursuant to Section
1777.1 or 1777.7 of the Labor Code to bid on, be awarded, or perform work as a subcontractor on, a public works project. Every public works project shall contain a provision prohibiting a contractor from performing work on a public works project with a subcontractor who is ineligible to perform work on the public works project pursuant to Section 1777.1 or 1777.7 of the Labor Code.
Any contractor on a public works project entered into between a contractor and a debarred subcontractor is void as a matter of law. A debarred subcontractor may not receive any public money for performing work as a subcontractor on a public works contract, and any public money that may have been paid to a debarred subcontractor by a contractor on the project shall be returned to the awarding body. The contractor shall be responsible for the payment of wages to workers of a debarred subcontractor who has been allowed to work the project.”
The undersigned contractor has investigated the eligibility of each and every subcontractor the undersigned contractor intends to use on this public works project, and determined that none of them is ineligible to perform work as a subcontractor on a public works project by virtue of the foregoing provisions of the Public Contract Code, Sections 1777.1 or 1777.7 of the Labor Code, or any other provision of law.
The undersigned declares under penalty of perjury under the laws of the State of California that the foregoing is true and correct. Executed this _____ day of ___________, _______ at _____________________________________, California.
