About this file
This is a Public Contract Code Disclosure document required for bidders on a Construction Manager at Risk (CMAR) project for the City of Pasadena, California to construct a Transit Operations Maintenance Facility. The document establishes mandatory certification and attestation requirements that all bidders must complete under penalty of perjury as part of their bid submission. The CMAR delivery method is structured in two phases: Phase 1 covers preconstruction and design-assist services, with Phase 2 as an optional construction phase subject to City authorization. The City will select up to five finalists from all proposals received for shortlisting, interviews, and final scoring based on established evaluation criteria including project experience, team composition, project approach and methodology, financial strength, and safety record.
The disclosure document requires bidders to certify under Public Contract Code Section 10285.1 whether they have been convicted within the preceding three years of fraud, bribery, collusion, conspiracy, or antitrust violations in connection with public works contracts. Additionally, bidders must complete a questionnaire under Public Contract Code Section 10162 disclosing whether they or their officers or proprietary interest employees have ever been disqualified or prevented from bidding on or completing federal, state, or local government projects due to violations of law or safety regulations. A third certification under Public Contract Code Section 10232 requires contractors to attest that no more than one final unappealable finding of contempt of court by a federal court has been issued against them within the preceding two years for failure to comply with National Labor Relations Board orders. The final contract award will be determined on a best value basis considering qualifications, organization and team composition, technical proposal, financial strength, safety record, local and small business status, price proposal, and interview scores.
