About this file
This is a modified AIA Document A133-2019 Standard Form of Agreement for Construction Manager at Risk services between the City of Pasadena and a selected contractor for the Transit Operations Maintenance Facility project located at 2180 East Foothill Boulevard, Pasadena, California. The project comprises a two-phase delivery process: Phase 1 preconstruction/design-assist services estimated to commence in July 2026 with completion by January 2027, and an optional Phase 2 construction phase commencing in March 2027 with substantial completion required by June 2028 and final completion by July 2028. The contractor must hold a valid California Class A general engineering or Class B general building contractor license and provide comprehensive preconstruction services including preliminary program evaluation, cost estimation, constructability consulting, project scheduling, and design-assist support. A mandatory pre-proposal meeting is scheduled for April 28, 2026, with a question submission deadline of May 22, 2026, and proposal submission deadline of June 8, 2026 at 2:00 PM. Interviews are tentatively scheduled for June 22-25, 2026. The Owner's budget for the Final Guaranteed Maximum Price is $60,000,000, excluding preconstruction services, general conditions, contingency, bonds, and insurance costs. Liquidated delay damages are assessed at $19,000 per day if Phase 2 substantial completion is not achieved within the contract time.
The contract establishes a Cost Plus Guaranteed Maximum Price structure with fixed percentage rates for the Construction Manager's indirect costs including General Conditions, General Requirements, Bonds, Insurance, Overhead/Profit & Fees, and Contingency, to be finalized in the GMP proposals. Phase 1 preconstruction services are compensated on a lump-sum basis with additional hourly billing rates available for design-assist services. The City grants a 40/60 project cost savings split to the CMAR (40%) and Owner (60%) if the final contract sum is less than the Final GMP. Evaluation criteria include experience and references (20%), organization and key personnel qualification (20%), project approach and methodology (30%), financial strength and stability (5%), safety record/Experience Modification Rate (5%), local Pasadena business preference (5%), small or micro-business certification (5%), CMAR price proposal (10%), and interview performance (50 additional points). Phase 1 insurance requirements include Commercial General Liability of $1,000,000 per occurrence, Automobile Liability of $1,000,000 per accident, Workers' Compensation with statutory limits, and Professional Liability of $2,000,000 per occurrence; Phase 2 substantially increases requirements to $30,000,000 Commercial General Liability, $5,000,000 Automobile Liability, and Builder's Risk coverage equal to completed project value. The project is partially funded by the Measure R Mobility Improvement Grant administered by the Metropolitan Transportation Authority. The contractor must demonstrate bonding capacity exceeding $60,000,000 and provide reviewed or audited financial statements showing profitability, liquidity, and positive net worth over the past three years.
