About this file
This is Amendment No. 1 to Contract No. BS135, a professional engineering services contract between the Florida Department of Environmental Protection and multiple contracted firms. The amendment was executed on March 27, 2024, by the Department and involves six primary contractor firms: Mott MacDonald Florida, LLC; Comak Group, Inc.; ESA Scheda; Southeastern Surveying & Mapping; Coastal Resources Group, Inc.; and Stantec. The contract renews an existing indefinite delivery vehicle that was originally effective March 29, 2019.
The amended contract renews the existing agreement for a five-year period beginning March 29, 2024, and ending March 28, 2029. The contract provides professional engineering services including civil and coastal engineering, geology, petroleum engineering, landscape architecture, surface water hydrology and hydrogeology, biology, land management, restoration and reclamation, mapping, geographical information systems, and construction management. The renewal rate schedule (Attachment B-1) establishes labor billing rates for various professional classifications across the contracted firms, with total multipliers ranging from 2.80 to 3.23. Mott MacDonald Florida, LLC maintains the primary contact role. The amendment incorporates updated compliance requirements including Section 287.058 of Florida Statutes, E-Verify employment eligibility verification, a one percent MyFloridaMarketplace transaction fee, corrective action plan procedures, audit access requirements, and a Truth-in-Negotiation Certificate. All other terms and conditions of the original contract remain in effect.

3. The following provision is hereby added to the Contract as a new paragraph 37.A.:
Rev. 12.27.21
SECTION 287.058 REQUIREMENTS. The requirements contained within section 287.058(1), F.S. are hereby incorporated by reference where applicable, unless superseded by provisions within the agreement.
4. Paragraph 39.B., “DISQUALIFICATION”, is hereby deleted in its entirety and replaced with the following:
EMPLOYEE ELIGIBILITY. Contractor is required to use the U.S. Department of Homeland Security’s E-Verify system to verify the employment eligibility of all employees used by the Contractor under this Contract, pursuant to section 448.095, F.S. Also, the Contractor shall include in related subcontracts, if authorized under this Contract, a requirement that subcontractors performing work or providing services pursuant to this Contract utilize the E-Verify system to verify employment eligibility of all employees used by the subcontractor for the performance of the Work.
The subcontractor must provide the Contractor with an affidavit stating that the subcontractor does not employ, contract with, or subcontract with an unauthorized alien. The Contractor shall maintain a copy of such affidavit for the duration of the Contract. If the Department has a good faith belief that a subcontractor knowingly violated §448.095(1), F.S. and notifies the Contractor of such, but the Contractor otherwise complied with this statute, the Contractor shall immediately terminate the contract with the subcontractor.
5. Paragraph 47, “MYFLORIDAMARKETPLACE TRANSACTION FEE”, is hereby deleted in its entirety and replaced with the following:
MYFLORIDAMARKETPLACE TRANSACTION FEE.
A. Pursuant to section 287.057(22)(c), F.S., all payments shall be assessed a Transaction Fee of one percent (1.0%), which the Contractor shall pay the State unless exempt pursuant to Rule 60A-1.031, F.A.C.
B. For payments within the State accounting system (FLAIR or its successor), the Transaction Fee shall, when possible, be automatically deducted from payments to the Contractor. If automatic deduction is not possible, the Contractor shall pay the Transaction Fee pursuant to Rule 60A-1.031, F.A.C.
C. Contractor shall submit any monthly reports required pursuant to Rule 60A-1.031, F.A.C. By submission of these reports and corresponding payments, the Contractor certifies their correctness. All such reports and payments shall be subject to audit by the State or its designee.
D. Contractor shall receive a credit for any Transaction Fee paid by the Contractor for the purchase of any item(s) if such item(s) is/are returned to the Contractor through no fault, act, or omission of the Contractor.
Notwithstanding the foregoing, a Transaction Fee is non-refundable when an item is rejected, returned, or declined, due to the Contractor’s failure to perform or comply with specifications or requirements of this Contract.
E. Failure to comply with these requirements shall constitute grounds for declaring the Contractor in default and recovering re-procurement costs from the Contractor in addition to all outstanding fees. CONTRACTORS THAT
ARE DELINQUENT IN PAYING TRANSACTION FEES MAY BE EXCLUDED FROM CONDUCTING
FUTURE BUSINESS WITH THE STATE.
6. The following provision is hereby added to the Contract as a new paragraph 63:
CORRECTIVE ACTION PLAN. In the event that deliverables are unsatisfactory or are not submitted within the specified timeframe, the Department Contract Manager may, by letter specifying the failure of performance under the Contract, request that a proposed Corrective Action Plan (CAP) be submitted by the Contractor to the Department.
All CAPs must be able to be implemented and performed in no more than sixty (60) days.
A. A CAP shall be submitted within ten (10) calendar days of the date of the letter request from the Department. The CAP shall be sent to the Department Contract Manager for review and approval. Within ten (10) calendar days of receipt of a CAP, the Department shall notify the Contractor in writing whether the CAP proposed has been accepted. If the CAP is not accepted, the Contractor shall have ten (10) calendar days from receipt of the Department letter rejecting the proposal to submit a revised proposed CAP. Failure to obtain the Department approval of a CAP as specified above shall result in the Department’s termination of the Contract for cause as authorized in the Contract.
Rev. 12.27.21
B. Upon the Department’s notice of acceptance of a proposed CAP, the Contractor shall have ten (10) calendar days, or longer if specified in the approved CAP, to commence implementation of the accepted plan. Acceptance of the proposed CAP by the Department does not relieve the Contractor of any of its obligations under the Contract. In the event the CAP fails to correct or eliminate performance deficiencies by the Contractor, the Department shall retain the right to require additional or further remedial steps, or to terminate the Contract for failure to perform.
No actions approved by the Department or steps taken by the Contractor shall stop the Department from subsequently asserting any deficiencies in performance. Contractor shall continue to implement the CAP until all deficiencies are corrected. Reports on the progress of the CAP will be made to the Department as requested by the Department Contract Manager.
C. Failure to respond to a Department request for a CAP shall result in suspension or termination of the Contract.
7. The following provision is hereby added to the Contract as a new paragraph 56.C.:
ADDITIONAL REQUIREMENT RELATED TO AUDITS. In a contract for services, Contractor shall provide access and documentation to the Department, within 10 business days of a request, to inspect the following:
a. Financial records, papers, and documents of the contractor that are directly related to the performance of the contract or the expenditure of state funds.
b. Programmatic records, papers, and documents of the contractor which the public agency determines are necessary to monitor the performance of the contract or to ensure that the terms of the contract are being met.
8. Attachment B, Rate Schedule, is hereby deleted in its entirety and replaced Attachment B-1, Renewal Rate Schedule.
9. Attachment K, Truth-in-Negotiation Certificate, is hereby added to the Contract.
10. All other terms and conditions of the Contract remain in effect. If and to the extent that any inconsistency may appear between the Contract and this Amendment, the provisions of this Amendment shall control.
The parties agree to the terms and conditions of this Amendment and have duly authorized their respective representatives to sign it on the dates indicated below.
