About this file
This Civil Litigation History Certification form is required by the City of Pasadena for bidders and proposers responding to the Construction Manager at Risk (CMAR) with Guaranteed Maximum Price opportunity for the Transit Operations Maintenance Facility project. The certification requires bidders to disclose any civil litigation arising from construction contract performance within California during the five to ten years preceding proposal submission in which the bidder, company officers, managers, owners, or the qualifying licensed contractor was named as a plaintiff or defendant in lawsuits brought by or against the owner. Bidders must either provide a certification of no civil litigation history or complete detailed information on all cases, including case names, court identification numbers, jurisdictions, and litigation outcomes. The mandatory pre-proposal meeting is scheduled for April 28, 2026, with questions due by May 22, 2026, and proposals due June 8, 2026 at 2:00 PM; finalist interviews are tentatively scheduled for June 22-25, 2026. Failure to provide accurate and complete civil litigation history information may result in the bidder being deemed non-responsive or not responsible.
The certification form does not address pricing, set-asides, or funding sources, as it serves solely as a qualification and responsibility document. Bidders must declare under penalty of perjury that all civil litigation information is accurate and complete. The form requires execution by the owner, officer, manager, or licensed contractor responsible for proposal submission and must be notarized with the date and location of execution.
