About this file
This is a standard form Construction Manager at Risk (CMAR) agreement template document issued by the City of Pasadena, California for the Transit Operations Maintenance Facility project. The City seeks a CMAR contractor to provide preconstruction and design-assist services in Phase 1, with an optional Phase 2 for construction services at the facility located at 2180 East Foothill Boulevard. The project scope includes demolition and grading, MEP systems, fire life safety systems, electrical infrastructure, Battery Electric Bus charging equipment, stormwater management, solar panels, and off-site improvements. Phase 1 preconstruction services are estimated to commence in July 2026 with completion by January 2027, while Phase 2 construction is estimated to begin in March 2027 with substantial completion required by June 2028 and final completion by July 2028. The mandatory pre-proposal meeting is scheduled for April 28, 2026, with a question submission deadline of May 22, 2026, and proposal submission deadline of June 8, 2026 at 2:00 PM; interviews are tentatively scheduled for June 22-25, 2026. Liquidated delay damages are assessed at $19,000 per day if Phase 2 substantial completion is not achieved.
Qualified contractors must hold an active California Contractors State License Board license (Class A or B), demonstrate a minimum of five years of business experience, have completed at least three prevailing wage public contracts in California, and provide evidence of three similar projects exceeding $70 million in value within the preceding ten years. The estimated direct construction cost is $60,000,000, exclusive of preconstruction services, general conditions, contingency, bonds, and insurance. Contractors must maintain bonding capacity exceeding this estimate and demonstrate financial strength through reviewed or audited financial statements showing profitability, liquidity, and positive net worth over three years. Evaluation criteria are weighted as follows: experience and references (20%), organization and key personnel qualification (20%), project approach and methodology (30%), financial strength and stability (5%), safety record and Experience Modification Rate (5%), local Pasadena business preference (5%), small or micro-business certification (5%), CMAR price proposal (10%), and interview performance (50 additional points). Phase 1 insurance requirements include Commercial General Liability of $1,000,000 per occurrence and Professional Liability of $2,000,000 per occurrence, while Phase 2 substantially increases requirements to $30,000,000 Commercial General Liability and Builder's Risk coverage equal to completed project value. The project is partially funded by the Measure R Mobility Improvement Grant administered by the Metropolitan Transportation Authority, and all contractors and subcontractors must be registered with the California Department of Industrial Relations and comply with prevailing wage requirements under California Labor Code.
