About this file
This is a Facility Use Agreement and Covenant executed between the County of Santa Clara, a property owner, and a lessee operating a licensed adult residential facility or board and care home. The agreement establishes use restrictions on the property to ensure it continues serving qualified residents under the Community Care Expansion (CCE) Program, which was established by Assembly Bill 172 to fund capital projects and promote sustainability of residential adult and senior care facilities. The covenant requires the property to be maintained in good condition and repair in accordance with all applicable laws and regulations. The agreement runs with the land and binds the owner and all successors in interest for the duration of the Grant Agreement term, with covenants and restrictions benefiting the County of Santa Clara. The owner warrants it will not interfere with, terminate, or discontinue use of the property for licensed adult and senior residential care during the covenant term, and both parties must comply with all applicable federal, state, and local nondiscrimination laws including Title VII of the Civil Rights Act, the Americans with Disabilities Act, the Rehabilitation Act, and California Fair Employment and Housing Act.
The agreement specifies that County funds have been made available to the lessee for capital improvements and operating subsidy payments intended to improve security and service provision at the property. Qualified residents are defined as applicants and recipients of Supplemental Security Income/State Supplementary Payment or Cash Assistance Program for Immigrants, with particular emphasis on the prioritized population experiencing or at risk of homelessness. The covenant includes enforcement provisions granting the County rights to exercise remedies and maintain legal actions in the event of default, with cumulative rights and remedies available to all parties legally entitled to enforce the agreement. Notice requirements specify delivery to the County Executive at 70 West Hedding Street, East Wing, 11th Floor, San Jose, CA 95110, with a copy to the County Counsel's office at the same address.
