About this file

This is an attachment outlining contracting principles established by the County of Santa Clara Health System's Behavioral Health Services Department for the Independent Living Home Habitability Improvements Project in California. The project seeks to award forgivable loans to qualified operators of unlicensed independent living homes serving individuals with serious mental illness. Habitability improvements funded through this initiative may include ADA-compliant bathroom updates, painting and flooring, appliance repair or replacement (water heaters, air conditioning), fire system upgrades, kitchen and bathroom remodels, furniture and mattress replacement, and bed capacity expansion. The contract term commences upon agreement execution and extends through June 30, 2027, allowing time for completion of County-approved improvements, required inspections, and loan forgiveness verification. This represents a one-time funding opportunity with potential for multiple awards.

All contractors receiving contracts valued at $100,000 or more per budget unit per fiscal year must comply with specified contracting principles to be considered fiscally responsible entities. Contractors must comply with all applicable federal, state, and local rules, regulations, and laws; maintain financial records available upon request; provide copies of any completed financial audits during the contract term; and grant the County reasonable access to facilities, financial records, and employee records related to the contract purpose, except where prohibited by law. These requirements ensure accountability and fair treatment of employees across all contracting entities.

Contracting Principles

All entities that contract with the County to provide services where the contract value is $100,000 or more per budget unit per fiscal year and/or as otherwise directed by the Board, must be fiscally responsible entities and must treat their employees fairly. To ensure compliance with these contracting principles, all contractors must: (1) comply with all applicable federal, state and local rules, regulations and laws; (2) maintain financial records, and make those records available upon request; (3) provide to the County copies of any financial audits that have been completed during the term of the contract; (4) upon the County’s request, provide the County reasonable access, through representatives of the Contractor, to facilities, financial and employee records that are related to the purpose of the contract, except where prohibited by federal or state laws, regulations or rules.
