About this file
This is a California Public Records Act Confidential Information form appendix for the County of Santa Clara Behavioral Health Services Department's RFP-BHS-FY26-0513 for the Independent Living Home Habitability Improvements Project. The form serves as a mechanism for proposers to request confidentiality protection for specific sections of their proposals under the California Public Records Act. Proposers must identify the exact page numbers and sections they wish to keep confidential and provide a legal basis for the exemption request citing Government Code section 6250 et seq. The County emphasizes that blanket designations of entire proposals as "confidential" or "proprietary" are unacceptable, and proposers must demonstrate a valid legal exemption to qualify for protection. The form includes space for up to twelve separate confidentiality requests with corresponding explanations, along with signature lines for authorized representatives, agency names, and dates.
The form clarifies that listing information for confidentiality protection does not guarantee the County will honor the request, as the information must meet specific criteria under California Public Records Act exemptions. If a proposer does not complete the form or submits it without identifying specific confidential sections, the County will treat the entire proposal as public information subject to disclosure. This appendix is a procedural document designed to ensure compliance with state public records law while allowing proposers to protect legitimately confidential business information through proper identification and legal justification.
