About this file

This is a Facility Use Agreement and Covenant document executed between the County of Santa Clara and operators of licensed Adult Residential Facilities/Board and Care Homes participating in the Community Care Expansion (CCE) Program. The covenant outlines the terms and conditions for recipients of CCE grant funds awarded through a competitive application process to sub-grantees operating licensed board and care homes in Santa Clara County. The agreement establishes facility use restrictions requiring that properties receiving CCE funds continue to operate as licensed adult and senior residential care facilities serving Qualified Residents, defined as applicants and recipients of Supplemental Security Income/State Supplementary Payment or Cash Assistance Program for Immigrants, with priority given to individuals experiencing or at risk of homelessness. The covenant runs with the land and binds successors in interest, remaining in effect through the term of the underlying Grant Agreement between the County and the Owner.

The covenant imposes several substantive obligations on facility owners, including maintaining properties in good condition and repair consistent with all applicable laws and regulations, continuing service to the defined priority populations, and complying with all federal, state, and local non-discrimination and equal opportunity laws. The County retains enforcement rights and remedies for any breach, including the right to pursue reimbursement of grant funds. Capital improvements funded through the CCE program may include security upgrades and service enhancements, while operating subsidy payments support eligible expenses at the facilities. The agreement does not specify individual award amounts or pricing terms, as it functions as a restrictive covenant document rather than a procurement solicitation, and applies to multiple sub-grantees selected through the County's competitive grant application process.

CCE-FY23-XX

This Facility Use Agreement and Covenant (“Covenant”) is dated as of XXXXXX by XXXXXX (“Owner”) for the benefit of the County of Santa Clara, a political subdivision of the State of California (“County”) on the terms and conditions set forth below.

A. Owner is the owner of certain real property located at xxxxxx as more particularly described in the attached EXHIBIT A (“Property”). Owner owns and operates a licensed Adult Residential Facility/Board and Care Home known as the __________ (“____”).

C. The CCE Program Grant Funds are intended to immediately preserve and avoid the closure of licensed residential adult and senior care facilities serving “Qualified
