About this file
This is a federal representation form regarding telecommunications equipment and services compliance under Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019. The form requires contractors to represent whether they will provide covered telecommunications equipment or services to the government and whether they currently use such equipment or services in their operations. Contractors must complete two representations: (1) whether they will provide covered telecommunications equipment or services in contract performance, and (2) whether they use covered telecommunications equipment or services after conducting a reasonable inquiry.
If a contractor responds affirmatively to either representation, they must provide detailed disclosures including the entity that produced the covered equipment, specific equipment descriptions (brand, model number, OEM or manufacturer part number), and explanation of proposed use and permissibility under the prohibition. For covered services, contractors must identify the service type, provide maintenance-related equipment details if applicable, or supply the Product Service Code if unrelated to maintenance. The form also requires contractors to review the System for Award Management (SAM) exclusion list for entities excluded from federal awards for covered telecommunications equipment or services. This representation applies to the Soldier Virtual Training (SVT), Weapons Skills Development (WSD), and Joint Fires Trainer (JFT) solicitation issued by the Department of the Army Materiel Command Contracting Command Orlando Contracting Center.
