1.0 General Information.

1.1 Objective. The contractor shall provide delivery services to various fueling points, including but not limited to, 135 generators, boilers and other heating fuel storage tanks, to include garrison operated portable equipment as needed per Contracting Officer Representative (COR) discretion. on US Army Garrison, Dugway Proving Ground, UT (DPG) to include all DPG customers, and tenants.

Fuel tanks at DPG range in size from 25 to 21,000 gallons. A tank list is provided as TE-XXXX and provides information regarding delivery locations and capacities.

The Government reserves the right, during the life of the contract, to add and/or delete tanks of varying sizes as required. The Government will notify the Contractor of such changes via written electronic communication (email).

2.0 Description of Services.

2.1 Scope. The contractor shall provide all fueling and de-fueling services to include delivery of fuel in a sound, safe, and legal manner; to include fuel tank systems meeting fuel storage industry standards (U.S. Code, Title 42, Chapter 82, Subchapter IX). The contractor shall provide all personnel, equipment, supplies, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide fuel supply.

The contractor shall provide all equipment and tools, including but not limited to, services needed to provide safe and efficient fuel delivery to various locations, personal protective equipment. Bulk fuel to be delivered shall be provided by the Government. The contractor shall use the fuel storage facility located on Minookin Dr. to fill fuel truck for said deliveries. The contractor shall not be responsible for bulk fuel delivered to the fuel storage facility.

The contractor maintains useable fill level in Government owned fuel tanks. The contractor shall ensure fuel tanks are filled accurately and efficiently in accordance with standards identified in this PWS.

The Government shall require fuel levels no less than seventy-five percent (75%) of tank capacity in fuel tanks. Contractor provides accurate accounting, invoicing, reporting, etc., as required in the contract. There shall be no fuel outages on the installation unless outage(s) have been approved by the Contracting Officer (KO) or the Contracting Officer Representative (COR), to include emergencies, or to change out fuel tanks. The contractor shall ensure that all enclosures around fuel tanks are secure (all gates locked and no breach in enclosures). Any problems with the enclosures, including keys or locks, the contractor shall immediately notify the COR of the problem.

3.0 Government Furnished Equipment.

3.1 Fuel Truck. The Government shall provide the contractor with a fuel delivery truck for use to perform the duties of the contract. Fuel truck, fuel and services necessary to perform bulk fuel delivery, operating contractor’s equipment, hoses, and fittings.

3.2 Fuel Storage and Distribution Systems. The Contractor shall perform PM and repair the fuel distribution system that includes, but is not limited to, fuel distribution lines, underground and above ground fuel storage tanks listed in TE AAA, BBB, BBB-1. The Contractor shall contact the DPW for coordination with the utility provider.

Prioritization: All facilities listed in TE-ZZZZ shall be prioritized. Prioritized facilities shall be checked and filled before those not listed in TE-ZZZZ.

3.3 Protecting Existing Property and Conditions. Protecting existing property and conditions is the contractor's responsibility. Any damage to existing Government property or installed systems shall be repaired to the satisfaction of the COR, KO at the contractor's expense. At the completion of the work, the condition shall be equal to or better than that which existed before the damage occurred. Damage shall be reported immediately to the appropriate authority, COR, KO, and to the Safety Officer on Dugway Proving Ground via phone and electronically (email).

4.0 Reports and Compliance.

4.1 Monthly Delivery Report. A monthly delivery report shall be provided to the COR (via email) that identifies the deliveries of fuel that have been completed during the previous week. TE-YYYY contains an example of this report. The report shall be provided in Microsoft Excel format with the pages sequentially numbered. All attachments shall be identified and referenced in the text. All documents shall be legible and reproducible. The report shall include but is not limited to the amount of fuel loaded into the delivery truck from the bulk storage tank each time fuel is issued identification of each tank filled; date(s) each tank was filled; quantity of fuel delivered to each tank for each delivery; total amount of fuel delivered during the month; and the balance of fuel remaining to be delivered as compared to the SLIN total. The report shall be delivered to the COR and the Contract Administrator no later than COB the third business day of each month.

4.2 Annual Summary Report. An annual delivery report shall be provided to the COR (via email) that identifies the deliveries of fuel that have been completed during the previous year. The report shall be provided in Microsoft Excel format with the pages sequentially numbered. All attachments shall be identified and referenced in the text. All documents shall be legible and reproducible. The report shall include but is not limited to: the total gallons of diesel issued from the government, identification of each tank filled; quantity of fuel delivered to each tank for each delivery; and the total amount of fuel delivered during the year. The report shall be delivered to the COR and the Contract Administrator no later than COB the fifth business day of each October.

4.3 Environmental and Safety Compliance. The contractor shall comply with all State, Federal, and Local environmental regulations as applicable. This includes but is not limited to mandatory compliance with applicable parts of Title 40 Code of Federal Regulations (40 CFR); Presidential Executive Orders (EO); and Utah Administrative Codes (UAC).

4.4 Spill Cleanup. The Contractor shall comply with Environmental Laws and Regulations concerning spill cleanup. Any spill from truck pertaining to liquid on the ground shall be cleaned up immediately and contained within the area to prevent any liquid from running into any storm drains. The cleanup materials shall be disposed of properly and within the rules of Environmental Protection Agency/Utah Department of Environmental Quality (EPA/UDEQ). Any spill shall be reported to DPG dispatch immediately. Delivery vehicles shall be free of leaks, in good repair and unlikely to break down and release fluids. Drivers shall follow all traffic rules while on DPG and shall be required to receive a safety brief from the DPG Installation Safety Office, POC 435-831-5204.

4.5 Emergency Services. The contractor shall have competent personnel trained and capable of dealing with minor personnel injuries. The contractor and their employees shall immediately notify their supervisor of any accident requiring emergency medical treatment. The contractor shall, in turn, notify the KO or COR within thirty (30) minutes of employee report of the incident to contractor. Emergency medical treatment and services for contractor personnel is the responsibility of the contractor.

4.6 Safety. The contractor shall conduct operations following standard commercial fuel industry safety standards. The contractor shall report accidents to the COR immediately following employee report of the incident to contractor; the DPG Safety Office within twenty-four (24) hours; and if the accident occurs after hours, the DPG Police Desk shall be notified immediately. These include but are not limited to loss of life, critical injury and hospitalization, all property damage, or fire causing major damage to structures, equipment, or land. The contractor shall report all job-related injuries through the COR and KO to the DPG Safety Officer, using an applicable accident report form as determined by the contractor.

The contractor shall perform work in a safe manner as required by OSHA Safety and Health Requirements. Provide a verbal notification to the KO as soon as possible of each occurrence of damage to Government property or an accident resulting in death, injury, occupational disease, or adverse environmental impact. Provide a completed copy of required Accident Investigation Reports to the KO within two (2) business days of each occurrence.

4.7 Safety Protocols and Regulation. IAW 29 CFR 1910, 1926 and OSHA General Duty Clause 29 USC 654.

All contractors and their home organizations supporting DOD/Government operations, regardless of any safety provisions included in or absent from the contract, are responsible for ensuring that their employees comply with applicable provisions of OSHA standards, and DOD Army, Army Material Command (AMC), Federal, State, Local and Company safety and occupational health requirements – where requirements conflict, the most stringent shall apply.

The contractor is reminded that DPG is compliant to the United States Army Safety and Occupational Health Management System (ASOHMS).

4.8 Safety Policy. DPG’s safety policy and safety program: The contractor shall contact the Safety office to ensure all safety protocol and briefings are completed within the first two (2) business days with these documents and to comply with their contents. Contractor must be in compliance with DOT Regulations, NFPA 30- Flammable and Combustible Liquids Code, NFPA 385- Standard for Tank Vehicles for Flammable and Combustible Liquids, NFPA 395- Standard for the Storage of Flammable and Combustible Liquids at Farms and Isolated Sites, OSHA 1917.156. Also, if applicable, OSHA 1910.119(a) (1) (ii) and 1910.119(a) (1) (ii) (A) exempt if used solely for workplace consumption as fuel (e.g., Propane used for comfort heating). Any and all on site work at DPG shall be completed in accordance with applicable. OSHA, DOD, Army, and DPG Safety requirements. As a federal installation, additional requirements other than OSHA apply to contractors performing work at DPG.

Examples include full conformance to all applicable NFPA standards, ANSI standards, and other consensus standards for the industry covered by the subject contract. It is the responsibility of the contractor to be familiar with all applicable standards prior to starting work. Additionally, the contractor shall make themselves familiar with and comply with DPG's local safety regulation DPG-R 385-1 prior to the start of any work at DPG. All shipped material shall include a current product Safety Data Sheet (SDS) for any chemical products being shipped other than residue. This includes items like engine oil. Any and all safety messages or recalls related to the safe use of products produced by the contractor will be provided to the COR for the contract within five (5) days of Contractor’s awareness of the message or notice.

Accidents: Any and all accidents, including property damage and injury/illness, that occur as a result of the execution of this contract, on or off the DPG worksite, shall be reported immediately by the most expeditious means possible, but not more than one (1) hour, to the COR and the KO. Subsequent notification will then be immediately made to the DPG Safety Office and other applicable DPG entities such as the fire department and the Directorate of Public Works. The contractor will investigate all accidents resulting in property damage or injury/illness to determine a root cause. Immediate and appropriate action will be taken by the contractor to prevent recurrence. Objective evidence of the investigation and corrective action shall be maintained by the contractor and provided to the COR and KO upon request.

Special Qualifications: The Contractor shall ensure all employees possess all required licenses for operating any equipment used in the performance of this contract. Contractors must ensure that any personnel performing under a contract are fully trained, licensed, certified, and qualified for the position in which they shall be serving. Certifications and licenses shall be provided to the COR after award. When new employees are hired any licenses or certifications shall be provided to the KO/COR before the employee may work on Depot.
