About this file

This document is a VA Notice of Limitations on Subcontracting—Certificate of Compliance form for the 534-CSI-714 Cath Lab1 Site Prep project in Charleston, SC. The clause implements 38 U.S.C. 8127(k)(2) requirements applicable to general construction contracts awarded to Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) or Veteran-Owned Small Businesses (VOSBs). The contractor is required to certify compliance with a subcontracting limitation whereby no more than 85% of the government-paid amount may be subcontracted to firms that are not certified SDVOSBs or VOSBs listed in the SBA certification database. Any further subcontracting by similarly situated certified SDVOSB/VOSB subcontractors counts toward the 85% limit, while material costs are excluded from subcontracting calculations.

The offeror must acknowledge that the certification is subject to Title 18, United States Code, Section 1001, and false certification may result in criminal, civil, or administrative penalties including prosecution. The VA may require contractors to demonstrate compliance at any time during or upon completion of contract performance through submission of invoices, subcontracts, or task value documentation. Non-compliance or failure to provide requested documentation may result in remedial action by the Government. The document requires a formal certification to be completed, signed, and submitted with the bid or proposal, including the signee's printed name, title, signature, date, and company information. Offerors failing to provide this certification will be deemed ineligible for evaluation and award.

Evidence of compliance includes, but is not limited to, invoices, copies of subcontracts, or a list of the value of tasks performed.
