About this file
This document is environmental permits and authority to proceed guidance issued by 99 Civil Engineering Squadron/Civil Engineer Infrastructure Element (99 CES/CEIE) at Nellis Air Force Base, effective April 10, 2023.
The guidance establishes permit and authorization requirements across multiple environmental programs for construction and maintenance activities at Nellis AFB. Under the Air Quality Program, contractors executing work must obtain a Clark County Dust Permit from the Clark County Department of Environment and Sustainability for trenches of 100+ linear feet, disturbances of ¼ acre or greater (10,890 SF), or structural demolition of 1,000+ SF. An Authority to Construct (ATC) from Clark County DES, coordinated through the Nellis Air Quality Program Manager, is required prior to commencing construction involving boilers, cooling towers, baghouses, cyclones, fuel dispensing equipment, fuel storage tanks, asphalt batch plants, concrete batch plants, rock crushers, paint booths, media blasters, water heaters, HVAC heaters, generators, hush houses, degreasers, fuel cell maintenance, and woodworking equipment. Contractors are responsible for initiating the permitting process. The Water Program requires contractor submission of projects impacting drinking water to the Nevada Division of Environmental Protection Bureau of Safe Drinking Water prior to commencement. Construction storm water discharge permits with Storm Water Pollution Prevention Plans (SWPPP) are required for disturbances of one acre or more of land, with submission to the base Water Program Manager for approval and provision of Notice of Intent to NDEP. The Asbestos/Lead/Toxics Program requires contractor-obtained ACM surveys, abatement notifications (10 days prior to demolition), waste manifests, and lead-based paint surveys and abatement documentation. The Natural Resources Program mandates contractor compliance with Section 7 consultation with the U.S. Fish and Wildlife Service for desert tortoise presence, USACE permits for wetlands, and Migratory Bird Treaty Act nesting surveys from March 1 through September 1. The Petroleum, Oil, and Lubricants Program requires permit applications for underground and above-ground storage tank installations, upgrades, or repairs through the Southern Nevada Health District and AST/UST/POL Program Manager. All work clearance requests must be submitted via AF Form 103 to Nellis CE Customer Service, and if dust permits, ATC/OP, SWPPP, or NPDES permits are required, they must be provided with the AF Form 103 submittal. Contractors must include dust permit and SWPPP maps depicting all unpaved areas used for equipment driving or storage, and must incorporate equipment driving routes in project maps to account for protected desert tortoise areas.
