About this file
This addendum document issued by the City of Portland, Oregon's Procurement Services division modifies the specifications for ITB No. 00002676 for Elevator Modernization Services. The addendum was issued on January 16, 2026, with responses due by 4:00 pm on January 23, 2026. The document addresses six bidder-requested exceptions and deviations to the original contract specifications and indicates whether the City accepts or rejects each modification request. The addendum replaces Exhibit A with an updated version reflecting the City's decisions on these contract modifications and includes the pre-bid meeting attendance list as an attachment to the solicitation.
Of the six requested modifications, the City accepted three changes: updating Section 3.4.3 Late Delivery to include limitation of liability language for special, indirect, or consequential damages; removing Section 5.2 Grant Funding entirely; and modifying Section 6.1.1 Hold Harmless and Indemnification to specify that indemnification applies to wrongful actions, errors, or omissions. The City rejected three requests: declining to expand the Force Majeure definition in Section 1, refusing to add language exempting contractor confidential and proprietary information from inspection and audit under Sections 3.8-3.9, and declining the contractor's proposed modifications to Section 5.14 Ownership of Property. However, the City did modify Section 5.14 with its own revisions, adding provisions requiring the contractor to supply repairable and maintainable work products and to assist with system transitions and data migration if replacement occurs.
