PTAB CERTIFICATE PROCESSING:
ADDITIONAL GUIDELINES
The information in this bulletin will be included in the 2020 revision of DATA ENTRY MANUAL FOR NON-UTILITY PATENT DOCUMENTS, OTHER THAN PATENT APPLICATION PUBLICATIONS.
***This bulletin is effective immediately.***
See DATA ENTRY MANUAL FOR NON-UTILITY PATENT DOCUMENTS, OTHER THAN PATENT APPLICATION PUBLICATIONS, Section XIX. PATENT TRIAL AND APPEAL BOARD CERTIFICATES, Front-Page Bibliographic Data, Identification of Original Patent and Application.
The NOTE at the end of the Data Source information is superseded by what is shown below.
NOTE:
Only one data source for the four identifiers is expected to be present in a given TRIAL.CERT document. However, if it should happen that multiple data sources for the four identifiers are present in a given TRIAL.CERT document, the PaDaCap contractor will capture the four identifiers in accordance with the following hierarchy: (1) BIBLIOGRAPHIC DATA section of the TRIAL.CERT CHECKLIST FOR ISSUANCE OF AIA TRIAL CERTIFICATE, (2) attached copy of original patent’s front page as corrected/updated by any attached Certificate of Correction or Reexamination Certificate, (3) attached Abstract of Title.
The header of the TRIAL.CERT checklist is not a data source. In most instances, it should be of no concern when the header shows incorrect or incomplete information.
For example, the TRIAL.CERT checklist header above shows the original patent’s issue date as 4/22/2003, which is an impossibility for a patent with the number 8692126. However, inasmuch as the BIBLIOGRAPHIC DATA section of the TRIAL.CERT checklist provides the original patent number and application number and the attached Abstract of Title provides all four identifiers, the issue date error on the TRIAL.CERT checklist header may be disregarded.
See DATA ENTRY MANUAL FOR NON-UTILITY PATENT DOCUMENTS, OTHER THAN PATENT APPLICATION PUBLICATIONS, Section XIX. PATENT TRIAL AND APPEAL BOARD CERTIFICATES, Results of Trial (Second & Succeeding Pages), text of substitute claim(s).
The following NOTE is added at the end of the Data Source information, immediately before the heading Composition.
NOTE: It is acceptable for the parenthetical identifier to refer to multiple claims. For example:
19. (substitute for claims 10 and 11) The wired circuit board according to …
