About this file
This is a Questions and Answers document for RFQ Amendment 4 (89233126QNA000465) issued by NNSA Sandia Livermore for Environmental Assessment (EA) support services under the DOE-wide Master NEPA BPA. The solicitation is restricted to BPA holders only and is not open to all contractors; BPA rates apply to all proposals.
Key staffing and operational requirements clarify that vendors define their own key personnel positions and qualifications, provided they meet Statement of Work (SOW) requirements, with staffing evaluated on a pass/fail basis. Qualified legal counsel must be licensed and in good standing with a state bar and competent in NEPA-related legal review; a law degree alone is insufficient. For costing purposes, contractors should assume one Cooperating Agency and one Collaborating Entity, limited public interactions occurring primarily during scoping conducted virtually unless otherwise directed, and a virtual post-award/kickoff meeting. No specific modeling or field study requirements are prescribed; these will be determined during the data gap analysis phase, with potential contract modifications for additional studies beyond the original scope. The Option Period provides schedule flexibility and may be exercised at Government discretion, including if additional time is needed. Tribal consultation is not anticipated, and NNSA Sandia Livermore will not provide tribal contact lists. The GSA SIN field in the pricing spreadsheet is not required if it cannot be modified. Pricing in both Amendment 0003 and the original SF1449 form must be updated consistently, and all submitted pricing must be consistent throughout the proposal package to avoid ambiguities.

June 3, 2026 Attachment L-3 - Questions and Answers
RFQ Amend 4: 89233126QNA000465
# Question Answer First set of Questions and Answers Amend 1
1 Please identify the Key Personnel positions and their minimum education and/or experience requirements.
Attachment M-1 does not prescribe specific key personnel positions or minimum education/experience requirements. Under Factor 2 (Staffing Approach), vendors shall propose labor categories, hours, and key personnel (if applicable) with qualifications sufficient to meet the SOW. Evaluation is pass/fail; staffing is acceptable if it demonstrates the ability to meet all SOW requirements with no material omissions. Accordingly, key personnel positions and minimum qualifications are vendor-defined, provided they meet SOW requirements.
2 Please define the requirements for a "qualified legal counsel." For instance, would a staff member with a law degree qualify or does the legal counsel need to be an active member of the bar?
Section 11.0, Task 1 (Project Management) requires the Contractor to include legal review as part of its internal quality control and to provide qualified legal counsel (in-house or subcontract). The SOW does not explicitly define minimum qualifications; however, to ensure legal sufficiency of NEPA documentation and independent legal review, qualified legal counsel is interpreted as an individual who is licensed and in good standing with a state bar and competent to perform NEPA-related legal review. A law degree alone without bar admission would not meet this intent.
Second set of Questions and Answers Amend 2
3 1. For costing purposes, how many meetings/hearings regarding the public are anticipated based on DOE's new NEPA regulations which limit public participation to primarily scoping.
2. If meetings are required, should this be costed as virtual or in-person?
For costing purposes, the Contractor shall assume a limited number of public interactions consistent with current NEPA practices. It is anticipated that public engagement will primarily occur during scoping. The Contractor shall assume meetings will be conducted virtually unless otherwise directed by the Government. If in-person meetings are later required, this will be coordinated and authorized by the Government.

4 Please clarify if the intent is for the contractor to price for a single cooperating agency, even though up to four are listed.
For costing purposes, the Contractor shall assume one (1) Cooperating Agency and one (1) Collaborating Entity, as stated in the SOW.
5 For costing purposes:
1. Identify any specific modeling NNSA Sandia anticipates being required by the contractor (e.g., air quality modelling, noise modelling, radiological modelling).
2. Identify any specific field studies NNSA Sandia anticipates being required (e.g., wetland delineation, additional biological assessments, contamination, etc.).
3. For the above items, indicate whether a contract cost modification would be initiated for specific studies identified during the data gap analysis phase if the contractor is expected to complete these studies.
1. No specific modeling requirements are prescribed at this time. Modeling needs (e.g., air quality, noise, radiological) will be determined during the data gap analysis phase.
2. No specific field studies are prescribed. Field study requirements will also be identified during the data gap analysis.
3. If additional studies beyond the original scope are identified and required, the Government will evaluate the need for contract modification in accordance with contract terms.
6 For costing purposes:
1. Is the intent of the Option Period 1 to be activated as an extension to the period of performance if the EA effort takes longer than the 1-year period?
The Option Period is intended to provide schedule flexibility and may be exercised at the Government’s discretion, including if additional time is required to complete the effort.
7 For costing purposes:
Should this meeting be priced as virtual or in-person?
For costing purposes, the Contractor shall assume the post-award/kickoff meeting will be conducted virtually unless otherwise directed by the Government.
8 Does NNSA Sandia Livermore have a list of Tribes and up-to-date contacts to provide the contractor?
The Contractor shall be required to support coordination activities, including preparation of consultation letters, as part of overall NEPA support. However, it is not anticipated there will be a need for any tribal consultation. Therefore, NNSA Sandia Livermore does not have contacts to provide the contractor. The extent of this support will be directed by the Government as needed.
9 Please confirm whether or not the contractor is expected to assist in this effort (e.g., development of coordination/consultation letters).
Please see the response for question 8.
10 We are unable to enter in or modify the GSA SIN (Column E).
1. Please provide an updated costing sheet.
2. Or indicate this field is not required to be completed.
If the GSA SIN field cannot be modified, it is not required to be completed. The Contractor should proceed with completing all other required pricing information. Vendors need to use Attachment L-2 Task Order Price Quote as the spreadsheet of the RFQ.
Second set of Questions and Answers Amend 2
11 Amendment 0003 includes Items 00001 and 00002, which were included in the original SF1449 form Should we be updating the cost in both places or leaving the original submission cost in the SF1449 form and adding the new cost information in Amendment 0003?
The offeror should update the pricing in both locations. Please ensure all submitted pricing is consistent throughout your entire proposal package to avoid ambiguities.
12 The sentence that states “this RFQ is being issued under the DOE wide Master NEPA BPA” has been stricken out; however, the solicitation is still being issued under FedConnect connected with the BPA. The price quote spreadsheet also is unchanged regarding using BPA rates. Can you confirm whether the solicitation is being issued only under the BPA or whether it is amended to be open to all contractors?
If the solicitation is open to all eligible contractors, are the contractors under the BPA still required to adhere to the rates submitted with the original BPA proposal?
This solicitation is restricted to holders of the DOE-wide Master NEPA BPA and is not open to all contractors; therefore, BPA rates apply. The sentence in question was removed to eliminate redundancy, as this scope is already defined in the first paragraph of the RFQ instructions
13 Was the solicitation amended because there were no bids to be found acceptable when the proposals were submitted originally?
The solicitation was amended to clarify and update the Government's requirements. In accordance with procurement integrity guidelines, the Government does not disclose pre-decisional evaluation information or the status of submitted proposals during an active procurement.
