About this file
This is a Drug Free Workplace Certification form required by the Town of Palm Beach, Florida for contractors bidding on the Security Guard Services for TOPB Marina contract. The certification establishes mandatory drug-free workplace requirements that all awarded contractors must implement and maintain throughout the contract term. Contractors must publish statements notifying employees that unlawful manufacture, distribution, dispensing, possession, or use of controlled substances is prohibited in the workplace and must specify disciplinary actions for violations. Additionally, contractors are required to establish a drug-free awareness program educating employees about the dangers of drug abuse, the company's drug-free workplace policy, available counseling and rehabilitation resources, and potential penalties for violations. Each employee engaged in grant performance must receive a copy of the workplace prohibition statement and acknowledge that abiding by its terms is a condition of employment under the contract.
The certification further requires contractors to notify the Town of Palm Beach within ten days of receiving notice of any employee criminal drug statute conviction occurring in the workplace. Employees must report such convictions to their employer within five days of conviction. Within thirty days of receiving notice of a conviction, the contractor must either take appropriate personnel action, up to and including termination, or require the employee to participate in a drug abuse assistance or rehabilitation program approved by a Federal, State, or local health, law enforcement, or appropriate agency. The authorized agent of the firm must sign and certify full compliance with all stated requirements, including making a good faith effort to maintain a drug-free workplace through ongoing implementation of all specified provisions.
