BASIC ORDERING AGREEEMENT (BOA)

QUESTIONS & RESPONSES

January 28, 2022

1. Question: We understand that the excel spreadsheet shall be placed in Volume II. Please confirm that this shall be placed in Factor 3, and that it does NOT count against the page limit.

Response: You may include the Excel spreadsheet in Factor 3 or as separate file with your proposal.

2. Question: If an offeror intends to submit on two regions of one size category will that offeror be required to submit two separate proposals, one for each geographic region?

Response: If an Offeror is submitting a proposal for two different Service Areas, but the same size category they may submit one proposal. However, the Offeror must indicate the Service Areas along with the size category. The Offeror must address both Service Areas in the Excel spread hseet, indicating the states they are able to serve. For example, If an Offeror is submitting for the Medium BOA for the Eastern and Central Service Area the Offeror may submit one proposal.

3. Question: The most recent Q&A from January 19 had an inquiry from someone asking about “old teaming agreements.” Our understanding was that the intent is to provide a letter of intent or teaming agreement for this specific opportunity from someone we had partnered with in the past 5 years. Is the intent instead to provide an older teaming agreement from a past project. This would demonstrate a prior working relationship being from a previous project, but is not necessarily a commitment on this opportunity.

Response: Teaming agreements, letters of intent or other documentation demonstrating the Prime/Subcontractor relationship must be within the last seven (7) years. Teaming agreements, letters of intent or other documentation is not included in the page count.

4. Question: Factor 4 Key Personnel and Organization Chart has a 3-page limit. Proposers are to submit resumes (1 page limit per resume) for the Project Manager, Quality Control Manager, and Site Superintendent. This leaves no space for the organization chart. Would it be acceptable to include our Organizational Chart within Factor 1 Corporate Experience where we have space to accommodate it?

Response: The resumes submitted for Factor 4 Key Personnel and Organizational Chart are not included in the page count. The Organizational Chart must be included with Factor 4.

5. Question: Section L.2 (b) Submission Presentation format and Content states the font must be 12-point Times New Roman. Can the font in the header be smaller than 12-point font?

Response: The font in the header may be smaller than 12-point font as long as it is legible.

6. Question: Section L.8 (a) Offerors may submit a proposal for more than one BOA. If an offeror submits a proposal for the Medium BOA can the offeror choose more than one (1) service area?

Response: Offerors may submit a proposal for more than one Service Area.

7: Question: Section L.9 Volume I (a) The Table of Contents for the volume must list the full contents of the Offeror’s submission and include a list of all acronyms used and a glossary of terms that the Offeror considers unique to its proposal or the solution it has proposed. Can you provide a description of what is required in the Glossary of Terms for Volume I? If there are no “unique” terms contained within Volume I does a Glossary of Terms still need to be provided?

Response: If there are no acronyms or unique terms in Volume I then a Glossary of Terms is not required. However, Offerors must still list the full contents of the Offeror’s submission.

8. Question: Volume II - The Offeror must include a Title Page, Table of Contents, and Executive Summary. Has the requirement been removed to provide an Executive Summary for Volume II?

Response: The Executive Summary for Volume II has been removed.

9. Question: Can you please elaborate a little as to what the Phrase - Call Order Management is, that is identified within Section L, L.9, FACTOR 3, paragraph a.1. and b. on Pages 64 & 65.

Response: Call Orders are analogous to Task Order or Delivery Orders. Offerors must describe the management structure, techniques and internal processes from cradle to grave for managing requirements procured via Call Orders. If an Offeor has not managed Call Orders, Offerors may discuss their experience with Task Orders and/or Delivery Orders.

10: Question: In SIR section L9, as part of the listed requirements for Vol I states:

d. A financial capability letter from your financial institution to include the following: name, e-mail and telephone number of bank’s point of contact, number of years business has been conducted with each bank, types of open accounts (checking, loans, etc.) and a balance of current accounts (the banks will provide a ‘range of figures’ for this information, such as medium five-figures range). Is the above letter from banks mandatory or sending the provided Financial Capability Form will fulfill the Vol I requirement?

Response: Yes, the financial capability letter from an Offeror's financial institution is a requirement for Volume I.

11. Question: Does the geographic location of Alaska in the Medium submittal require a separate proposal submission?

Response: Alaska is considered its own Service Area. Please submit a separate proposal for Alaska. As stated in Factor 3 Offerors submitting on the Alaska BOA must be able serve all of Alaska.

12. Question: Will projects outside of the value range (i.e., more than $2 Million) for the Medium submittal be considered relevant and be evaluated similar to projects within the range?

Response: If a project submitted for either Factor 1 or Factor 2 is more than $2M for the Medium BOA it will be considered relevant. If project submitted for either Factor 1 or Factor 2 is more than $500K for the Small BOA will be considered relevant.

13. Question: Will design-build projects for the Medium submittal be considered relevant and be evaluated similar to projects that are bid-build?

Response: A Design/Build project submitted for Medium BOAs will be considered relevant if the project is within the last 7 years from the date of the solicitation and is similar in size and scope described in Attachment J-1 Statement of Work. Offerors submitting a proposal for the Medium BOA must still demonstrate experience in at least 3 Bid/Build disciplines for Factors 1 and 2.

14. Question: The table in Paragraph L.9 references “Statements of Bidder.” Please clarify what is required for this item.

Response: Please refer to Section K of 697DCK-22-R-00033. Section K must be completed and included with Volume I.

15. Question: Regarding Question #19 response, the FAA stated “Offerors may submit current projects that are substantially complete for Factor 1.” We ask that the FAA consider highly relevant projects that are on-going but not substantially complete, especially if the project has already received a CPARS evaluation for Factor 1 and 2. At a minimum the FAA should allow Design-Build projects that are 100% Design Complete but construction is on-going for the Nationwide BOA.

Response: Substantially complete for Factor 1 is a project that is 90% complete.

16. Question: Past Performance Forms: Will the FAA being sending out a form to be utilized? I did not see a form within the solicitation documents or under attachments. Or are we expected to develop our own form with the 5 roman numerals as shown?

Response: A Past Performance Questionnaire Form is included under attachments to the solicitation on www.SAM.gov.

20. Question: Factor 1: Corporate Experience for the National BOA, can we submit experience performed by our key subcontractors? For example, we are the Prime General Contractor – can we include project experience from our Architectural/Engineering Subcontractor who will be the designer of record on any design/build projects?

Response: Offerors may submit project(s) for subcontractors in which the Offeror was the Prime contractor for the project. Offerors may submit project(s) in which they were a subcontractor. Offerors must demonstrate experience in at least three (3) Bid/Build disciplines (i.e., electrical, mechanical, roofing, fire life safety upgrades, delegated design etc.) for mission critical facilities

21. Question: Volume II, Factor 2 a: My understanding of the PPQs is that the Offeror will submit Part 1 of the PPQs. Part 2: Respondent request will be sent directly by FAA to the respondents as identified in Part 1. I believe that this is the process the we used on previous ARTCC projects (CSA).

Response: Please include the completed PPQ form, to include both Part I and Part II, with your proposal.

22. Question: Will the FAA allow one (1) 11x17 size page for the Volume II: Factor 4 Organizational Chart? We understand the importance of this organizational chart clearly illustrating our team’s structure and the lines of authority/communication with the FAA. This information can become difficult to read with the current required page size, margin size, and font size/style.

Response: Please refer to Section L. Any and all changes are highlighted in red in Amendment 0001- 0004.

25: Question: Offerors are required to include completed and include Section K, Representations, Certification and other Statement of Offerors in our Volume I proposal. Including in Section K is 3.6.4-18 CERTIFICATION REGARDING STEEL AND MANUFACTURED PRODUCTS (APR 2021). This clause has two possible selections and appears to be more appropriate or specific to each Call Order. Thus it is hard to accurately answer this for the entire BOA. Can you please advise how this should be addressed?

Response: Offerors are not required to complete clause 3.6.4-18 CERTIFICATION REGARDING STEEL AND MANUFACTURED PRODUCTS (APR 2021) for this procurement. Clause 3.6.4-18 CERTIFICATION REGARDING STEEL AND MANUFACTURED PRODUCTS (APR 2021) will be applicable to future Call Orders.

Can the government please clarify the subcontractor Management section.

Response: The purpose of the teaming agreement, letter of intent or other documentation is to demonstrate the Prime contractor has experience managing major subcontractors within the last 7 years. You may include teaming agreements, letters of intent or other documentation for major subcontractors you intend to utilize.

31. Question: Factor 3- Subcontract Management- Is the documentation for subcontractors (i.e., Teaming Agreement, Letter of Intent, or other documentation) excluded from the page count? Teaming agreements typically would be 10 pages each.

Response: Teaming agreements, letters of intent or other documentation demonstrating the Prime/Subcontractor relationship must be within the last seven (7) years are excluded from the page count.

32. Question: Factor 3 Quality Control- The types of awards that are mentioned in this section are not typical for construction efforts.
