7.4 Stockpiled Soil or Other Erodible Materials

Stockpile management includes measures to minimize surface erosion and sediment transport from soil stockpiles or other erodible materials.

Locate erodible stockpiles away from drainages including storm sewer inlets and culvert inlets.

Locations of stockpiles are shown on the erosion and sediment control plan sheets in TAB 6.

D Not applicable to this project. Reason: Click here to enter text.

If applicable:

Control measure: Silt Fence

Implementation: The silt fence shall be functional before other land disturbing activities take place. Silt fence should be functional throughout the duration of construction and for a long enough duration following construction to allow disturbed areas to stabilize following revegetation and seeding. Please also refer to project schedule, contract, and plan set (Erosion Control section).

Maintenance requirements: Silt fences should be inspected periodically for damage (such as tearing by wind, animals, or equipment) and for sediment that has accumulated. Remove the sediment when it reaches one-half the height of the silt fence. In situations where access is available, machinery can be used. Otherwise, silt should be removed manually. The following are key elements to remember:

• The sediment deposits should be removed when heavy rain or high water is anticipated.

• The sediment deposits should be placed in an area where there is little danger of erosion.

• The silt fence should not be removed until adequate vegetative growth ensures no further erosion of the slopes. Generally, the fabric is cut at ground level, the wire and posts are removed, then the sediment is spread, seeded, and protected (mulched) immediately.

Inspection Requirements for NPDES Compliance

EPA Construction General Permit Part 4 inspection requirements for NPDES compliance:

Inspection Frequency: You must conduct inspections in accordance with one of the two schedules listed below.

You must specify in your SWPPP which schedule you will be following.

1. At least once every 7 calendar days, OR

2. At least once every 14 calendar days and within 24 hours of the end of a storm event of 0.5 inches or greater. (If this option is chosen, a rain gauge is required to be on-site~ The SWPPP should also include a daily rainfall log.)

Case-by-Case Red11cti01ts in Inspection Frequetzcy: You may reduce your inspection frequency to at least once every month if: ·

1. The entire site is temporarily stabilized, 2~ Runoff is unlikely due to winter_conditions (e.g., site is covered with snow, ice, or the ground is frozen), or

3. Construction is occurring during seasonal arid periods in arid areas and semi-arid areas.

Inspection Waiver for Frozen Cotzditions: A waiver of the inspection requirements is av~ilable until one month before thawing conditions are e.xpected to result in a discharge if all of the following requirements are met:

· 1. The project is located in an area where frozen conditions are anticipated to continue for extended periods of time (i.e., more than one month);

2. Land disturbance activities have been suspended; and

3. The beginning and ending dates of the waiver period are documented in the SWPPP.

Qualified Personnel: Inspections must be .conducted by qualified personnel (provided by the operator or cooperatively by multiple operators). "Qualified personnel" means a person knowledgeable in the principles and practice of erosion and sediment controls who possesses the skills to assess conditions at the construction site that could impact stormwater quality and to assess the effectiveness of any sediment and erosion control measures · selected to control the quality of stormwater discharges from the construction activity. ·

Scope of ltzspections: Inspections must include all areas of the site disturbed by construction activity and areas used for storage ofm!lterials that are exposed to precipitation. Inspectors must look for evidence of, or the potential for, pollutants entering the stormwater conveyance system. Sedimentation and erosion control measures must be observed to ensure proper operation. Discharge locations must be inspected to aseertain whether erosion control measures are effective in preventing significant impacts to waters of the United States, where accessible. Where discharge locations are inaccessible, nearby downstream locations must be inspected to the extent that such inspections are practicable. Locations where vehicles enter or exit the site must be inspected for evidence of off-site sediment tracking.

All reports required by tltis permit, including th"e SWPPP, S.WPPP amendnients, and inspection reports must be signed by a person described in Appendix G, Subsection 11.A (below) or by a duly authorized representative of that person.

1. For a corporation: By a responsible corporate officer. For the purpose of this Part, a responsible corporate officer ineans: (i) a president, secretary, treasurer, or vice-president of the corporation in charge .of a principal business function, or any other person who performs similar policy- or decision-making functions for the corporation, or (ii) the manager of one or more manufacturing, production, or operating facilities, provided, the manager is authorized to make management decisions which govern the operation of the regulated facility including having the explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental eompliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate information for permit application requirements; and where authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures.

2. For a partnership or sole proprietorship: By a general partner or the proprietor, respectiv~ly; or

· 3. For a municipality, state, federal, or other public agency: By either a principal executiv~ officer or ranking elected official. For purposes of this Part, a principal executive officer of a federal agency includes (i) the chief executive officer of the agency, or (ii) a senior executive officer having responsibility for the overall operations of a principal geographic unit 9fthe agency (e.g., Regional Administrator of EPA). ·

A person is a duly authorized representative only if:

The authorization is made ~n writing by a person described in Appendix G, Subsection 11.A;

The authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity such as the position of plant manager, operator of a well or a well field, superintendent, positfon of equivalent responsibility, or an individual or position having overall responsibility for environmental matters for the company. Hurricane Ridge Phase II - WA PRA OL YM 12(2) NEPA Re-Evaluation of Environmental Assessment and FONSI

Need for Protect:

The purpose and need of the current project (Phase II) remains as identified in the FONSl and EA which is to rehabilitate and resurface Hurricane Ridge Road from the intersection at Mount Angeles Road to the Hurricane Ridge Visitor Center. Phase I of the project has already been completed.

Selected Alternative:

As part of the EA two alternatives were evaluated. Alternative 1 was the no-action alternative and Alternative 2 the preferred alternative. The current project is Phase II of Alternative 2.

There are no substantial changes between what is currently proposed and what was proposed in the original NEPA documentation. This is addressed in further detail under Affected Environment.

Affected Environment:

Olympic National Park has completed a NEPA reevaluation as the NEPA Lead Agency. Refer to Appendix A for their reevaluation document. The information from their reevaluation document is summarized below.

NATIONAL HISTORIC PRESERVATION ACT SECTION 106

No change. The Preferred Alternative had previously been determined to have no effect on historic properties or any properties eligible for listing on the National Register. The current project does not result in any change to the previous determination.

ENDANGERED SPECIES ACT

The NPS prepared a Biological Assessment (BA) evaluating the effects of Alternative 2, , would have on the threatened northern spotted owl and marbled murrelet. The BA was submitted on May 20, 2004 and the US Fish and Wildlife Service (USFWS) issued its Biological Opinion (BO) on June 22, 2005 determining the proposed action will not jeopardize the continued existence of these species. Per an e-mail from USFWS (see Appendix B), no further consultation is required for the current project.

USDOT ACT OF 1966 - SECTION 4(f)

No change. As legislated in Moving Ahead for Progress for the 21st Century, Section 1119(c)(2), Section 4(f) does not apply to the current project as Federal lands transportation facility, as defined under 23 U.S.C. 101(a)(8), are exempt from Section 4(f); and Hurricane Ridge as part of the National Park System, qualifies as a "Federal lands transportation facility."

EXECUTIVE ORDER 11990 PROTECTION OF WETLANDS

In accordance with Executive Order 11990, Protection of Wetlands FHWA is directed to avoid to the extent possible the long and short term adverse impacts associated with the destruction

Hurricane Ridge Phase II - WA PRA OLYM 12(2) NEPA Re-Evaluation of Environmental Assessment and FONS!

or modification of wetlands and to avoid direct or indirect support of new construction in wetlands wherever there is a practicable alternative. Alternative 2 and the current project are both designed to remain within the roadway prism and wilf not have any impact on wetlands or other Waters of the United States.

Conclusion

The proposed action has also been evaluated for impacts to environmental resources and recreational experiences valued by NPS and visitors to Olympic National Park.

After analyzing the resource data previously collected by the NPS and WFLHD, no substantial or unusual project impacts are anticipated as a result of the currently proposed project.

Environmental concerns identified through interagency coordination can be addressed through appropriate contract restrictions and mitigation. The original NEPA review remains valid and no further environmental review is required.
