Summary of Special Terms and Conditions for General Engineering Consultant Services
This document comprises Special Terms and Conditions for RFQ Number 27-002 issued by the South Florida Regional Transportation Authority (SFRTA) for General Engineering Consultant (GEC) Services. SFRTA's Engineering and Construction Department seeks professional design and engineering services from individual consultants or consultant teams organized as prime consultants with subconsultants. The contract term commences upon SFRTA's issuance of a Notice to Proceed and extends for five years, with an optional extension period not to exceed ninety days beyond the contract expiration date. Work will be assigned through individual Work Orders, with no guarantee of minimum work volume; the contractor's lack of assigned work shall not constitute grounds for compensation or damages claims. Bidders must submit both a scanned copy and original Bid Bond (with raised seal on thicker stock) via their preferred delivery method by the due date specified in the Instructions to Bidders section, with the original bond required no later than the bid opening. Failure to provide the original Bid Bond before bid opening renders a submission non-responsive.
Pricing is structured through Work Orders, with fees calculated by multiplying average raw hourly rates by approved overhead multipliers and profit percentages, supplemented by direct-cost reimbursable expenses pre-approved by SFRTA. Work Orders are limited to a maximum not-to-exceed amount, with a threshold of $2,000,000 requiring separate procurement; contractors must notify SFRTA upon reaching 80 percent expenditure of authorized fees. The contractor must provide comprehensive insurance coverage including Commercial General Liability ($1,000,000 per occurrence), Workers' Compensation, Business Automobile Liability ($1,000,000), and Professional Liability ($1,000,000), with SFRTA and FDOT named as additional insureds. All insurance providers must maintain ratings of "A" or better by Best's, "AA" or better by Standard & Poor's, or "AA" or better by Moody's. Overhead profit rates are set at ten percent for engineering, design, and studies, and eight percent for administration and inspection activities. The contractor must maintain insurance certificates throughout the contract term and provide monthly progress reports detailing work completed, budget compliance, and Disadvantaged Business Enterprise participation.

If and when the applicable Chief Contracting Officer and Director of Strategic Planning make an Exceedance Determination, they shall promptly inform the Executive Director who shall initiate a separate procurement for the remainder of the Work in an expedited fashion. Nothing shall preclude Work from proceeding under the existing Work Order while the procurement is ongoing, as long as the Executive Director concludes that the Work must continue for financial, legal compliance issues or other significant issues, but such extension shall in no case exceed 6 months from the Exceedance Determination or exceed the $2,000,000.00 threshold by more than five percent or $100,000.
