About this file
This is Addendum No. 1 to Request for Qualifications (RFQ) No. 27-002 issued by the South Florida Regional Transportation Authority (SFRTA) for General Engineering Consultant (GEC) Services in Florida. The addendum modifies the original RFQ requirements for professional design and engineering services to be provided by individual consultants or consultant teams organized as prime consultants with subconsultants. The addendum clarifies qualifications, scope modifications, and procedural requirements for respondents submitting proposals to assist the SFRTA Engineering and Construction Department with various engineering projects and design services.
The addendum addresses specific revisions to the original RFQ terms, including potential modifications to submission requirements, evaluation criteria, or contractual provisions. Respondents must carefully review both the original RFQ No. 27-002 and this addendum to ensure full compliance with all current requirements. Proposers are advised to acknowledge receipt of Addendum No. 1 in their submissions to demonstrate awareness of all current solicitation documents and conditions governing the contract award and performance.

Section 22 Indemnification, paragraph (a) is revised as follows:
a) The Contractor shall indemnify and hold harmless SFRTA and FDOT, and its officers and employees, from liabilities, damages, losses, and costs, including, but not limited to, reasonable attorneys’ fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the Contractor and other persons employed or utilized by the Contractor in the performance of the Contract.
Section 23 Patent Indemnity is deleted in its entirety.
Article 48 is revised as follows:
48. PROFESSIONAL STANDARD OF CARE
The Contractor shall perform all Services in a timely, diligent, and professional manner and in accordance with generally accepted professional standards applicable to the Services performed.
The Contractor shall be responsible for the professional quality, technical accuracy, and completeness of all Services and deliverables. SFRTA review, approval, or acceptance shall not relieve the Contractor of its obligations or responsibility to meet the applicable professional standard of care.
RFQ 27-002 General Engineering Consultant (GEC) Services Questions and Answers 4
1 Question: Section 22 requires the Contractor to indemnify, defend, and hold harmless SFRTA and FDOT for losses arising out of or related to the performance of services under the Contract. Would SFRTA revise this provision so that the indemnity provision conforms to Florida Statute 725.08 by removing the duty to defend and limiting the indemnity obligation to claims, damages, losses, and expenses caused by the negligence, recklessness, or intentionally wrongful conduct of the Contractor or its subconsultants?
Answer: Please see Section 3.9 of the Special Terms and Conditions which modified Section 22 of the General Terms and Conditions.
2 Question: Because Contractor is providing professional design/consulting services and does not control construction means, methods, or project completion dates, would SFRTA agree to delete Section 39 (Liquidated Damages) in its entirety as inapplicable to professional services contracts? Any liability of the Contractor for delay or project impacts should be governed by applicable legal standards and limited to damages directly resulting from the Contractor’s negligent acts, errors, or omissions rather than predetermined liquidated damages amounts.
Answer: Please see Section 3.1 of the Special Terms and Conditions. The check box for marking Liquidated Damages as applicable is not checked.
3 Question: Section 48 warrants that all work will be free from defects. Because professional services are performed to a professional standard of care rather than warranting a perfect result, would SFRTA clarify that any professional services are performed consistent with the ordinarily accepted standard of care applicable to similarly situated professionals and are not subject to a guarantee or warranty of outcome?
Answer: Please see the replacement page in Addendum 1.
