1. Introduction
AECOM Technical Services, Inc. (AECOM), as the third party Government’s Environmental Consultant (GEC), was requested by the U.S. General Services Administration (GSA) to conduct a Pre-Alteration Assessment (Pre-Alt Assessment) including a limited asbestos-containing material (ACM) and lead-based paint (LBP) survey of the Milwaukee Federal Building & U.S. Courthouse (MFB) located at 517 East Wisconsin Ave, Milwaukee, Wisconsin, for the Fire & Life Safety (FLS) project (the Project). See Figure 1 Site Location map.
The ACM and LBP surveys were conducted on December 1, 2, 3, and 7, 2020 by an AECOM field team consisting of Mr. Dave Henderson, Mr. Tory Schultz, Mr. Garret Schacht, and Ms. Emily Sengstock. The field team’s State of Wisconsin, Department of Health Services (DHS), asbestos inspector license numbers are; Mr. Henderson AII- 111283, Mr. Schultz AII-184405, Mr. Schacht AII-268933, and Ms. Sengstock AII-258114. To facilitate site access, the survey team was escorted by Mr. Peter Jacobsen, AECOM’s FLS On-Site Project Manager. Copies of the field team’s DHS certification cards are provided in Appendix A.
Pre-Alt Assessment project background, document review summary, survey methods, and results are presented below.
2. Project Background
The FLS is a fire alarm system and fire suppression system update project. The Pre-Alt Assessment was conducted after the 15% FLS Concept Design Submission was reviewed by the GSA. The 15% design identified the main wiring routes and equipment locations for the Fire Alarm System (FA System) along with the main piping routes for the Fire Suppression System (FX System) i.e. sprinkler system. The 15% conceptual design drawings are incorporated into Figures 2 thru 21 as noted below.
A Pre-Alt Assessment Work Plan1 was reviewed and approved by the GSA. The work plan provided project specific details pertinent to the FLS Pre-Alt Assessment scope of work based on the 15% conceptual design. FA and FX System project details that guided the Pre-Alt Assessment are summarized and updated as follows:
FA System (See Figures 2 thru 11):
• FA System wiring will originate and terminate at a Fire Alarm Control Panel (FACP) in a Fire Command Center.
The original option for the Fire Command Center is room number (rm #) 192/194. Main wiring runs will be installed within conduit and there will be a minimum of two floor penetrations downward, from the Command Center into the basement level. The Fire Command Center may also require renovation to meet code requirements.
─ Pre-Alt Assessment includes: rm# 192/194. Note: during the Pre-Alt Assessment, the following two options were added as alternative locations for the Fire Command Center: rm#119 and rm#175. For all options the rooms were inspected for both renovation activities and floor penetrations.
• There will be floor/ceiling penetrations for the FA wiring in the basement and the sub-basement.
─ Pre-Alt Assessment includes:
Floor/ceiling penetrations from the basement up to the first floor in rooms B1045-parking garage/107E and B1090/134.
Floor/ceiling penetrations from the basement down to the sub-basement in rooms B1093 and B1090.
• FA wiring between the FACP in rm# 192/194 and the Transponder Panels (TPs) on floors 2, 4, and 6, will installed within conduits and include floor/ceiling penetrations at each floor. Additionally, FA wiring from the TPs to each floor it serves will also be installed within conduits specifically for the floor/ceiling penetrations.
1 Milwaukee Courthouse FLS – Pre-Alteration Assessment Work Plan, revision 1.1, AECOM, November 25, 2020
─ Pre-Alt Assessment includes:
Floor/ceiling penetrations for the FA wiring rise on the east side of the South Building, including the following rooms; 162, 239E, 337E, 439E, 537E, 634E, and 733E.
TP cabinet wall mounting (floors 2, 4, and 6) and floor/ceiling penetrations for the FA wiring rise on the west side of the South Building, including the following rooms; 134, 257E, 357A, 457E, 561E, 645E, and 739E.
• FA wiring from the TPs to the individual offices/rooms served, once installed past a floor/ceiling penetration, will be insulated wire or installed in conduit, either mounted above suspended ceilings (e.g. in the South Building) or possibly within soffits (e.g. the North Building). The wire/conduit is anticipated to penetrate wall structures to enter the individual offices/rooms/hallways served.
Additionally, FA monitoring and alarm devices will be mounted on walls or ceilings within the spaces they serve (i.e. offices, rooms, hallways, etc.) on each floor of each building.
─ Pre-Alt Assessment includes representative sampling of interior and exterior wall and ceiling materials for each floor of each building (i.e. the North and South Buildings).
• There will be ceiling/roof penetrations for the FA wiring/conduit from the 7th floor of the South Building up into the South Building penthouse rooms.
─ Pre-Alt Assessment includes: The South Building roof structure associated within penetrations up into the penthouse rooms.
• There will be FA wiring/conduit installed into the attic area(s) of the North Building.
─ Pre-Alt Assessment includes: a general assessment of the North Building attic areas to identify possible ACMs.
• Once the new FA system is operational, the existing FA system will be decommissioned and removed from service.
─ There are no Pre-Alt Assessment activities associated with the decommissioning of the existing FA system.
FX System (See Figures 12 thru 21):
The FX system work is noted as Options #1-11: New Sprinklers in Non-Sprinkler-Protected Areas in the 15% FLS Concept Design Submission. Each numbered option describes the addition of sprinklers to individual non-sprinklered spaces per floor of the building(s). At this stage of the project it is unknow if any or all FX System options will be built out. Therefore, the Pre-Alt Assessment included the work zones for FX System options #1-11.
The Pre-Alt Assessment scope of work anticipates that:
• All FX System piping (i.e. risers, mains, and branch lines) are uninsulated.
• No work will be conducted on the FX System vertical risers where they are in a pipe chase with other piping. In other words, the FX System work will not disturb other system piping (i.e. plumbing or heating) or HVAC ductwork that may be insulated with asbestos containing material (ACM).
FX System work will include connecting new branch lines, extended to serve non-sprinkler protected areas, to the existing horizontal FX System mains. It is possible that new horizontal mains may also be installed to serve new branch lines. It is expected that the new FX System
• work will not disturb other system piping (i.e. plumbing or heating) or HVAC ductwork that may be insulated with
ACM.
• New FX System piping, either mains or branch lines, will be installed above suspended ceilings (e.g. in the South Building) or possibly within soffits or exposed (e.g. the North Building). The piping is anticipated to penetrate wall structures to enter the individual offices/rooms/hallways to be sprinklered.
─ Pre-Alt Assessment includes representative sampling of interior wall and ceiling materials for each floor of each building (i.e. the North and South Buildings). NOTE: this scope is similar to the FA System Pre-Alt Assessment scope.
• There is no decommissioning or demolition of the existing FX system once the upgraded FX system is operational.
3. Document Review Summary
In preparation for the Pre-Alt Assessment, the GEC reviewed past environmental reports and historical zone documentation for the courthouse that are relevant to the FLS scope of work.
The following environmental reports were reviewed:
Asbestos-Containing Material and Lead-Based Paint Survey Summary Report, Federal Courthouse Building, 517 East Wisconsin Avenue, Milwaukee, Wisconsin; Carnow, Conibear & Assoc., Ltd., December 2005
Asbestos and Lead Paint Inspection, Federal Building & Courthouse (WI0044), 517 East Wisconsin Ave., Milwaukee, WI 53202; TRC, September 17, 2019
Limited Asbestos Containing Materials and Lead Based Paint Survey, Downspouts located in the Basement, Milwaukee Federal Building, 517 East Wisconsin Ave, Milwaukee, WI; AECOM, Revised May 22, 2020
The 2019 TRC report included results from the 2005 Carnow, Conibear & Associates (CCA) report along with TRC’s own supplemental limited asbestos testing and lead paint observations conducted on June 12, 2019.
The TRC report presented the combined TRC and CCA asbestos survey results on series of figures that noted the ACM on each floor of the building. The TRC and CCA inspection data have been incorporated into this FLS Pre-Alt Assessment report as summarized on Figures 2 thru 11, with reference to the FA system, and on Figures 12 thru 21, with reference to the FX system.
The TRC report also included LBP and lead containing paint (LCP) sampling results. The report identified ten CCA and two TRC sample locations. In summary, the results from all twelve sample locations indicated that the sampled paints were LBP, with lead content greater than 1.0 mg/cm2 or 0.5% by weight.
Contractors conducting work for the FLS project should review the TRC and CCA inspection reports in addition to the TRC and CCA asbestos information summarized on Figures 2 thru 21.
The AECOM inspection associated with the May 2020 report was focused to limited areas directly associated with a downspout relining project. The results of the report are anticipated to be of limited help to the broader FLS project.
Therefore, the results have not been incorporated into the FLS project inspection report. The May 2020 report is available to contractors upon request.
4. Historic Preservation
To prevent damaging historic finishes during the Pre-Alt Assessment the GEC began by reviewing historic designation drawings. The drawings identified historical zoning significance and historical integrity for the interior building areas. Then, during the Pre-Alt Assessment asbestos sampling, the following procedures were taken into consideration:
• Zone 1: Areas of high architectural and/or historical significance. The sampling team tried not to sample within a Zone 1 area. When sampling was necessary, the team identified a visually inconspicuous location to obtain a sample, i.e. above a ceiling, within a maintenance room/area, within a utility space, within a soffit, etc. Once a sample location was selected the sample team called the FLS historic preservation architect, Mr. Mark Kasprzyk with Harboe Architects and verbally confirmed that the sample location was appropriate.
• Zone 2: Areas of moderate architectural and/or historical significance. The sampling team did conduct sampling within Zone 2 areas. The samples were obtained of materials that did not visually appear to be historic and from locations that are not visually conspicuous.
• Zone 3: Areas of minimal architectural and/or historical significance. Sampling did occur in Zone 3 areas.
Samples were obtained, to the extent possible, from the visually least conspicuous locations.
With respect to preservation of historical finishes, the LBP survey was conducted using an X-Ray Fluorescence (XRF) field instrument that allowed collection of data without the structural damage associated with obtaining paint chip samples.
5. Asbestos Survey
5.1 Regulations
The Pre-Alt Assessment asbestos inspection was conducted in general accordance with GSA’s Region 5, Facilities Management & Services Programs Division, Pre-Alteration Assessments guidance document dated rev. February 2017, the Asbestos Hazard Emergency Response Act (AHERA) regulations, the US EPA’s National Emissions Standards for Hazardous Air Pollutants (NESHAP) regulations, the Wisconsin Administrative Code (WAC) Chapter NR 447 Control of Asbestos Emissions standards, and as modified below.
Under the EPA, OHSA, and WDNR regulations, ACM is any material, including building materials, that contain greater than (>)1 percent (%) asbestos as determined using the method specified in Appendix A, subpart F, 40 CFR part 763, section 1, Polarized Light Microscopy.
Regulated ACM (RACM) means (a) Friable asbestos material, (b) “Category I” non-friable ACM that has become friable, (c) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or
(d) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation activities.
Friable asbestos material means any material containing >1% asbestos that, when dry, can be crumbled, pulverized or reduced to powder by hand pressure.
Category I non-friable ACM are defined as asbestos-containing packings, gaskets, resilient floor covering, and asphalt roofing products containing >1% asbestos.
Category II non-friable ACM is defined as any material, excluding Category I non-friable ACM, containing >1% asbestos that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure.
Additionally, NESHAP defines threshold amounts of the materials that qualify as RACM. According to NESHAP, regulations must be followed for demolition or renovation of facilities with at least 80 linear meters (260 linear feet) of RACM on pipes, 15 square meters (160 square feet) of RACM on other subject building components, or at least one cubic meter (35 cubic feet) of subject building components.
Generally, Category I non-friable materials do not need removal prior to demolition or renovation because these materials do not release significant amounts of asbestos fibers, even when damaged. However this is not a rigid rule of NESHAP. If Category I materials have become friable or are in poor condition, they must be removed. Also, if you sand, grind, abrade, drill, cut or chip any non-friable materials, including Category I materials, you must treat the material as friable, if more than the threshold amount is involved. Furthermore, local or state requirements can be more stringent than NESHAP regarding the threshold limits and/or friability (e.g., all non-friable ACM may need to be removed).
Additionally, the Occupational Safety and Health Administration (OSHA) regulates employee exposure to asbestos under 29CFR1926.1101.
5.1 Asbestos Survey Methodology
The GEC used the guidelines of AHERA to conduct the asbestos survey of the interior of the subject building to identify suspect ACM. The inspectors walked through accessible areas of the subject building to identify suspect ACM. Locations and coverage of suspect ACM were recorded in field notes and/or on drawings or floor plans. The suspect ACM were grouped into homogenous sample areas (HAs). An HA, for sampling purposes, is one that contains material that appears to be similar by texture and/or color and was applied during the same general time period.
Once an HA of suspect ACM was identified, the inspectors qualified the materials for accessibility, friability, and condition, and collected samples of the suspect HA at random locations. The quantity of samples collected from each suspect HA was determined in general accordance with AHERA.
Bulk sampling of suspect ACM was conducted in accessible areas of the subject building. Destructive sampling methods were used but did not include large-scale demolition of building components to gain access to areas not readily accessible. It is possible that potential ACM will be present in areas that were not accessible during the survey. Where possible, samples were collected to the full depth of the potentially affected area or substrate and in areas where there was current damage. The inspectors used best efforts to minimize the potential for visual emissions to escape to the outside air during the collection (wetting, etc.), packaging, and transportation of bulk samples.
The samples were submitted under chain-of-custody for analysis by EMSL Analytical, Inc., Orlando, Florida, using polarized light microscopy (PLM) EPA method EPA 600/R-93/116. Results are reported as a percentage of asbestos in the total sample material. If a sample had multiple layers, the layers were analyzed as separate sub-samples of the original sample.
Point counting (PC) is required by the WDNR Bureau of Air Management to confirm the PLM bulk analytical results for materials that are reported to contain less than 10% asbestos unless the material is presumed to be asbestos containing material (i.e. PACM). Point count analysis was conducted using EPA method EPA 600/R-93/116 (400 point count).
The survey included the collection of 154 bulk samples of suspect ACM. Due to laboratory splits of bulk samples and re-analysis of two samples by point counting, a total of 262 samples were analyzed by the lab. A total of 82 HAs were identified during the inspection. The large number of HAs was due to the dissimilar construction found in the north and south buildings in combination with the similar construction and layout of the floors within each building. In general, HAs were defined for each floor of the two separate buildings. The suspect material was in good condition at the time of the survey.
5.2 Asbestos Survey Results
A summary of the suspect ACMs observed and sampled along with analytical results are presented in Table 1.
Asbestos sample locations are identified on attached Figures 22 thru 31. The laboratory analytical report with chain-of-custody forms are included in Appendix B. Representative photographs of the sampled materials are included in Appendix C.
Materials that tested positive for asbestos or presumed to contain asbestos are discussed below:
Drywall System: Of the 42 drywall system (i.e. drywall and joint compound) bulk samples, only two samples contained asbestos.
• Sample No: 1N-1D, located in rm119, Fire Command Center option 1, on the first floor of the north building, had a drywall result of None Detected, an initial joint compound result of 3% using PLM and a retest result of 0.89% using PC, with a composite sample result of <1% asbestos.
• Sample Nos: 5N-1C, located in the northwest corner on the fifth floor of the north building, had a drywall result of None Detected, an initial joint compound result of 2% using PLM and a retest result of 1.25% using PC, with a composite sample result of <1% asbestos
Since both samples had a composite result of <1% asbestos the material does not have to be abated if it is disturbed during renovation. OSHA regulations for worker protection for under 29CFR1926.1101 may apply if the material is disturbed during renovation or demolition activities.
Floor Tile, Linoleum, and Mastic: Floor tile with mastic or linoleum with mastic are present in multiple locations.
Sample No: 1N-4A represents the flooring in rm 192/194, Fire Command Center option 3 on the first floor of the north building. Sample Nos: 2S-5A, 2S-5B, 3S-5A, 3S-5B, 4S-5B, 5S-5A, 5S-7A, 6S-7A, 7S-7A, 7S-7B represent the flooring within utility rooms on floors two through seven in the south building. The flooring systems typically contain multiple layers of either tile/linoleum with mastics where one or more layer is reported to contain >1% asbestos by PLM. The tile/linoleum with mastic flooring is considered a Category 2 ACM in good condition. If the flooring will be disturbed during renovation it should be abated.
The following general comments can be made about the asbestos results:
• Plaster sampled from both the north and south buildings did not contain asbestos.
• Sampled concrete masonry units (CMU’s) and associated mortar did not contain asbestos.
• Sampled concrete did not contain asbestos.
• Sampled ceiling tiles did not contain asbestos.
Data Correction Note: The asbestos laboratory data has been corrected as follows: A sample of plaster was originally labeled sample No. 5N-3A and it was corrected to sample No. 5N-2B based on photo log and lab results. Sample 5N-3A, a CMU and mortar sample was not analyzed.
All quantities provided in this report were estimated by visual observation methods during the inspection. The quantities may or may not be accurate and should not be used for bidding purposes. All quantities should be verified before bidding by the abatement contractor.
6. Lead Based Paint (LBP) Survey
6.1 LBP Regulations
The U.S. EPA defines LBP, as a dried film, as having a lead concentration of >0.50 % (>5,000 part per million or ppm) or >1.0 milligrams of lead per square centimeter (mg/cm2), which can pose a lead hazard when disturbed. The OSHA, as it relates to construction worker protection, defines lead containing paint (LCP) as paint having any concentration of lead.
OSHA requires that all worker safety provisions be followed during LBP/LCP removal activities. As part of federal legislation enacted in October of 1992 (Residential Lead Based-Paint Hazard Reduction Act of 1992 or Title X), the Secretary of Labor was required to issue interim final regulations for occupational exposure to lead in the construction industry. OSHA promulgated the Interim Final Lead Standard for Construction in May 1993. The specific requirements of the standard can be found at 29 Code of Federal Regulations (CFR) 1926.62.
LBP/LCP waste that adheres to demolition/construction debris may be disposed of in a properly permitted solid waste landfill or sent to a facility that has a permit issued for storage, treatment, or recycling.
Peeling or damaged LBP/LCP removed from a surface, that contains more than 5.0 milligrams per liter (mg/l), or ppm, lead as determined by the Toxicity Characteristic Leaching Procedure (TCLP), must be disposed of as hazardous waste at a permitted hazardous waste facility.
6.2 Lead-Based Paint Survey Methodology
The GEC conducted a survey of the accessible areas of the buildings to visually identify painted surfaces and test them to determine the extent of LBP or LCP. The survey included representative interior areas of the buildings and the predominant paint types/colors present.
Lead content was tested using a Thermo Scientific brand, Niton XL3t model, XRF analyzer. The paint sample location, building component, paint color, substrate, and the lead content as measured in mg/cm2 was documented.
The use of an XRF field instrument to determine lead content allowed collection of data without the structure damage associated with obtaining paint chip samples. This was advantageous in areas of the building(s) with historical finishes. The use of the XRF also allowed for the collection of more data points within a shorter period of time.
For calibration testing, at least three calibration check readings were made each day before beginning the inspection.
Additional calibration check readings were made according to the manufacturer’s instructions. Calibration checks do not need to be done each time an instrument enters an automatic “sleep” state while still powered on.
The LBP survey included the testing of 565 locations.
6.3 Lead-Based Paint Survey Results
Sampling results are summarized in Table 2 and samples locations are shown in Figures 32 thru 41.
The following general comments can be made about the LBP/LCP results:
• Paint associated with the historic north building atrium were all LBP, including:
─ Tan on the walls, columns, and steel trusses.
─ Red on the walls.
─ Gray on the steel railings.
• LBP (sample Nos: SBS-440 and SBS-441, white on drywall) was only identified in the utility/computer room of the south building sub-basement. No other LBP was identified in the subbasement.
• No LBP was found in rms# 119, 175, and 192/194, the Fire Command Center options 1, 2, and 3 respectively, on the first floor of the north building.
• With the exception of the east stair well (sample No. 1EST-547, white on plaster), no LBP were identified on the 1st floor of the south building.
• No LBP was identified on the 6th floor of the south building and the 6th floor attic spaces of the north building.
• No LBP was identified on the 7th floor of the south building.
• No LBP was identified on the penthouses located on the roof of the south building.
• Paints on plaster substrates were more likely to be LBP.
• Very few paints on drywall substrates were LBP.
7. Assessment Exclusions
Exclusions generally refer to areas of the subject building that were not accessible or not surveyed during the inspection. Exclusions include the following:
• The scope of work for the Pre-Alt Assessment presented above was based on the 15% FLS Concept Design Submission. If future modifications substantially change the FA or FX System design including, but not limited to, rerouting of wiring or piping, additional assessment activities may be warranted.
• Only those materials that may be impacted by the FLS FA and FX Systems installation were included in the Pre- Alt Assessment. For example, no thermal system insulation (TSI) on existing piping systems, i.e. plumbing or heating, or HVAC duct work was sampled.
• The offices and courtrooms located in the southwest corner of the 1st floor, south building, (i.e. entry through rm#140) were not accessible at the time of the assessment.
• There were a limited number of small spaces/rooms that were not accessible to the survey team either due to security reasons or lack of keys to access the spaces.
• The GEC only inspected and sampled materials in areas of the buildings that could be safely accessed at the time of the survey. This included certain areas, including, but not limited to:
─ Roof areas including the north elevation tower.
─ Attic areas.
─ Elevator pits and shafts.
─ Confined spaces.
─ Energized electrical systems.
8. Conclusions and Recommendations
This Pre-Alt Assessment has revealed the following conclusions and recommendations:
• AECOM, acting as GSA’s GEC, conducted a Pre-Alt Assessment including a limited ACM and LBP/LCP survey of the U.S. Federal Courthouse in Milwaukee Wisconsin for the FLS project.
• The Pre-Alt Assessment focused on those materials that may be impacted by the FLS project as identified in the 15% FLS Concept Design Submission. If future modifications substantially change the FA or FX System design including, but not limited to, rerouting of wiring or piping, additional assessment activities may be warranted.
• Contractors conducting work for the FLS project should review the 2019 TRC and 2005 CCA inspection reports in addition to this report.
• During the Pre-Alt Assessment, ACMs and LBPs/LCPs were identified in materials that may be impacted during construction for the FLS project.
• Contractors should be aware that it is possible that potential ACM and LBP/LCP may be present in areas that were not accessible during the survey.
• Note that OSHA, 29CFR1926.62, defines LCP as paint having any concentration of lead as it relates to construction worker protection. Worker safety provisions as outlined by OSHA should be followed during lead containing paint removal activities. This would include notification of the presence of lead to the construction workers engaged in the renovation/demolition activities so that they may characterize their personal exposure levels and implement control measures, if necessary.
• All quantities provided in this report were estimated by visual observation methods during the inspection. The quantities may or may not be accurate and should not be used for bidding purposes. All quantities should be verified before bidding by the contractor.
