About this file

This is a Technical Questions Tracker documenting 80 questions and answers submitted by contractors during the solicitation period for a construction project at the VA facility in Jackson, Mississippi (Solicitation 36C77626B0023).

The project involves constructing a Clinical Learning Center residential neighborhood addition and includes structural work, mechanical/electrical systems integration, site utilities, asbestos abatement in connection areas, ICRA containment requirements, and approximately 29 drilled bell piers with minimum 3-foot embedment into competent clay. Key contractual requirements include: the project is a 100% set-aside for Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) with bonding requirements that must be met through SDVOSB or approved SBA/VA Mentor-Protégé partnerships; pricing is firm fixed price with no economic price adjustment clause; all state and local sales taxes are the contractor's responsibility; Notice to Proceed is anticipated within 90 calendar days of award; contractor personnel require VA PIV badging; design team members are precluded from serving as prime contractor, mentor-protégé partner, or subcontractor on the construction phase; and work occurs in two phases with potential after-hours utility connection outages. The tracker clarifies that drilled pier depths are not provided at bid but shall be determined per geotechnical report parameters; retaining wall design responsibility rests with the contractor for bidding purposes but final design parameters must be confirmed by the geotechnical engineer prior to construction; temporary HVAC and mobile SPS are not required; and unarmed guards are not required despite specification language.

PROJECT TITLE: Construct CLC, Jackson MS
#RECEIVEDANSWEREDCONTRACTOR QUESTIONVA RESPONSEA/E RESPONSE
1Will the government pay for materials stored per VAAR 852.232-70 and FAR 52.232-5? We have experienced PCAC Contracting Officers refusal to pay for materials stored on site during these periods of material shortages and the need to expedite procurement of materials when available to meet schedule obligations and prevent project delays. This is an important factor in preparing Price proposals. In accordance with contract terms and conditions, Contractors should not submit an offer assuming the Government will approve monthly progress payments for material and/or equipment procured by the Contractor and stored on the construction site, as space is available, or at a local approved location off the site. Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves.
2Please confirm that any designers or consultants who provided professional services for the construction documents, including reports, are precluded from pursuing this project as a Prime contractor, Mentor-Protégé partner, or subcontractor.Any member of the design team of this project is not permitted to be part of the construction team.
3Please confirm that this project is a competitive SDVOSB set-aside and that any bonding provided by a contractor must be through a SDVOSB or SBA/VA APPROVED Mentor-Protégé partnership under the SBA/VA Mentor- Protégé program in which the partnership has been approved prior to the due date. This project is set aside for SDVOSBs. The bonding requirements must be met for this project per the applicable clauses, provisions, and instructions to offerors.
4Please confirm that a large business not part of an SBA/VA APPROVED Mentor-Protégé team under the VA Mentor- Protégé program cannot provide a bid guarantee or a payment & performance bond for a SDVOSB.This project is set aside for SDVOSBs. The bonding requirements must be met for this project per the applicable clauses, provisions, and instructions to offerors.
506/18/2026When visiting the link, I noticed the project was “set aside for Service-Disabled Veteran Owned Small Business” – does this mean that General Contractors cannot bid the project unless they meet that requirement?Yes, this project is a 100% set-aside for SDVOSBs. The prime contractor submitting the offer must be certified as such in the SBA VetCert database.
606/18/2026Is this project tax exempt? If the project is sales tax exempt will the government/VA provide a sales tax exemption certificate? No. See Special Note regarding FAR 52.229-3 Federal, State, and Local Taxes in the solicitation. It is solely the responsibility of the offeror to include all state and local sales or use taxes for construction materials, and all other applicable taxes, in their bid or proposal price.
706/18/2026Will the Government provide detailed written requirements for contractor badging? Please clarify the process for obtaining PIV badges, including required documentation, background checks, and estimated processing timeframes.Regardless of affiliation, everyone working within VA facilities or requiring access to VA information systems requires a VA PIV Card. PIV badging requirements can be found at https://www.osp.va.gov/How_To_Get_A_VA_ID_Badge.asp

Immediately after the bonds are provided to the Government, the contractor shall immediately start working with the identified COR at the site to commence the VA PIV process for all known contractor personnel that will be working the project. All contractors must have a PIV Card in order to work on site.

806/18/2026How soon after award is NTP expected to be issued? The Government anticipates issuance within 90 calendar days after award.
906/18/2026Will the VA allow deviations to Buy American Act if the noted products are not available?See the solicitation for the pertinent RFO Compliant Buy American Act Clauses and Provisions
1006/18/2026Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin. This will be awarded as a Firm Fixed Price (FFP) contract and all escalation should be factored in your FFP. Additionally, FAR 52.216-4 “Economic Price Adjustment – Labor and Material” is not included in the solicitation and will not be added.
1106/18/2026There is a section in the specifications for asbestos abatement. We have been unable to find the location or extent of asbestos material to be abated. Please adviseAsbestos risk is limited to the connection areas in Phase II and demolition for the connection of Phase I to the existing structure. The VA can provide a current asbestos survey report.

6006/18/2026Please confirm that this project is a Design-Bid-Build procurement and all design is the responsibility of the Engineer of Record and no designs will be the responsibility of the contractor? This project is a design bid build project. Design has been accomplished By Apogee and they will be awarded a CPS option for post award construction period services through closeout.
6106/18/2026Placing the retaining wall design responsibility on the Contractor creates a significant and potentially unquantifiable risk that is inconsistent with the principles of fair and equitable competition in a Design-Bid-Build procurement. Under the current solicitation, offerors are required to provide a lump-sum price for a retaining wall that is a major project element without the benefit of an approved design, geotechnical-based engineering analysis, or sufficient design criteria to accurately determine the scope, type, dimensions, materials, and construction requirements of the wall. As a result, offerors are forced to speculate regarding the final design and associated construction costs. This approach creates several concerns:

The Contractor assumes substantial liability for the adequacy and performance of the retaining wall design despite the absence of sufficient design information at the time bids are due. Please clarify if the contractor is required to obtain Errors and Omissions insurance for the design?

Offerors cannot reasonably or accurately estimate the cost of the retaining wall prior to completion and approval of the design, resulting in widely varying assumptions and pricing methodologies. Therefore the lack of a defined design basis undermines the Government's ability to obtain comparable bids and the principles underlying sealed bidding procedures. The solicitation effectively transfers significant design risk to bidders without providing the information necessary to quantify that risk, forcing offerors either to include substantial contingencies or to underprice an unknown scope. Please provide the Government's justification for assigning retaining wall design responsibility to the Contractor while simultaneously requiring firm pricing prior to completion and approval of the design?

Additionally, please explain how this approach complies with FAR requirements for fair competition, adequate specifications, and the preparation of responsive and comparable bids in a Design-Bid-Build procurement? For bidding purposes only, the Contractor shall assume conservative retaining wall design parameters where wall-specific geotechnical parameters are not provided. Final retaining wall design parameters, including lateral earth pressures, soil shear strength, bearing capacity, settlement, drainage, reinforced fill requirements, and global stability, shall be determined by the delegated retaining wall engineer and confirmed by the project Geotechnical Engineer prior to construction. The segmented retaining walls are routinely "engineered" by the manufacturers, as they are the ones who understand the limitations of their system. The extents of the retaining walls are illustrated on the drawings, which gives these manufacturers adequate ability to provide a price to the Contractors.
6206/18/2026Please provide the VA Sustainable Practice Guidelines that must be followed in designing and installing the new Automatic Irrigation System?https://vatilms.va.gov/vatilms/reports/Sustainable%20Design
6306/18/2026The contract drawings and specifications identify at least 29 drilled bell piers; however, neither the drawings nor specifications provide the required pier depths, design loads, allowable bearing criteria, or pier schedule necessary for offerors to accurately estimate the cost of this work. The cost of drilled bell piers is highly dependent upon depth, subsurface conditions, groundwater conditions, casing requirements, concrete quantities, and reinforcing steel quantities. Without knowing the assumed depth of the pier offerors are forced to make assumptions regarding a significant scope of work that prominently impacts project pricing. Please provide the following:

Assumed depth of all piers? Design loads for each pier?

Allowable bearing values and geotechnical design criteria? Soil borings showing ground water conditions?

Any information from the Geotechnical Engineer as to whether or not casings will be required?

If this information is not available, please explain how offerors are expected to develop accurate and comparable bid pricing for the drilled bell piers when the primary cost- driving factors have not been defined in the project documents. Assumed depth of all piers? As per the Geotec Report, the minimum embedment of the drilled shaft shall be 3-ft into competent unweathered Yazoo "blue" clay. The approximate elevation to top of competent unweathered Yazoo "blue" clay varies, ranges from about Elev. 312 ft to Elev. 307 ft. Design loads for each pier? the factored vertical (kip), shear (kip) and moment (kip-ft) loads for CP3, CP4, and CP5 are 120, 8,9 and 200,11,35 and 290,13, 50, respectively.

Allowable bearing values and geotechnical design criteria? See Geotec Report. Soil borings showing ground water conditions? See Geotec Report.

Any information from the Geotechnical Engineer as to whether or not casings will be required? See Geotec Report.

6406/18/2026Please confirm that the contractor is not responsible for any mobile SPS requirements?None Required
6506/18/2026Please confirm that no temporary HVAC will have to be provided during construction? No temporary HVAC will be required.
6606/18/2026Please confirm there are not blast or bullet resistant doors or windows required?Design all exterior glazed openings to meet the blast requirements of the PSRDM for Essential Facilities. Refer to specified blast design calculation requirements in sections 08 41 13 for storefronts and 08 56 53 for windows. Ballistic resistance is not required in this design. Per the PSRDM, hollow metal doors constructed with 14-ga metals meets the VA's blast requirements. Blast analysis, certification, and / or testing is not required.
6706/18/2026Can the bid date for the project be extended to provide more time for contractors? The VA does not anticipate extending the solicitation close date; however, please continue to monitor SAM.gov.
6806/18/2026Can a second round of RFIs be submitted once the initial RFI answers are provided as usually these answers call for more clarifications in most cases? The VA does not anticipate a second round of RFIs.
6906/18/2026Please advise the meaning of designation on partitions marked as shown on drawing

(G-006). This is not shown on the Legend on the attached sheet.

Are we required to do any additional work to these walls to achieve their designated fire rating other than to fire stop any penetrations which we add to the walls? Can we assume the walls as they now exist meet the required fire rating? The legend for the fire ratings is shown on G-002. The markings in themselves do not direct the Contractor to do any upgrades to these partitions. Refer to other drawings for locations where partitions must be created or modified. The ratings are identified both for general understanding of the code compliance for the facility and to assist the Contractor in accounting for the firestopping scope that will be required as utilities are routed through the existing facility.
7006/18/2026The specifications (Para 1.4 of Section 01 00 00 required unarmed guards at all times when work is not underway. This would seem to be redundant since the site is surrounded by a 7 foot security fence and since such a small area is involved. Not Required
7106/18/2026Can we get a copy of soil report referred to in Para 1.10 of Section 010000?A/E to provide in addendum
7206/18/2026Is a Resident Engineers Office (Para 1.15 Section 010000 required? VA personnel have an equipped office where they normally work. Not Required for the COR, just for construction functions.
7306/18/2026Can the contractor's superintendent wear three hats, i.e., can he also serve as QC manager and as SSHO?Yes based on qualifications.
7406/18/2026Para 1.1 Section 01 45 35 Are any design conditions as noted in this section which require a special inspector? If so, which inspections are applicable?Refer to tables in pages 6 and 11 of Spec 01 45 35
7506/18/2026What is meant by "activation budget" Alternate 12 and 13?VA cost to open the facility.
7606/18/2026What is depth of bottom of drilled piers? As per the Geotec Report, the minimum embedment of the drilled shaft shall be 3-ft into competent unweathered Yazoo "blue" clay. The approximate elevation to top of competent unweathered Yazoo "blue" clay varies, ranges from about Elev. 312 ft to Elev. 307 ft.
7706/18/2026Who is responsible for the design of the Retaining Wall? Refer to note 8 on sheet CD101.
7806/23/2026In the event it is necessary to us slip casing to install the drilled piling, will the contractor be compensated by change
order for the increased cost? If it proves impossible to install drilled piling even using slip casing, what will be the next course of action?Refer to the Geotechnical report for anticipated soil conditions.
7906/25/2026The Deducts requested in the solicitation, and shown in the general plan pages, architectural pages, structural pages, landscape pages, and civil pages do not align. Please provide direction on which list takes precedent for pricing on bid day. Please see attached excel file with deducts highlighted in yellow.Refer to the deducts per price schedule and G-002
8006/25/2026
Can a manufacturer and color be selected for the face brick? The specifications do not include this information and describe a wide variety and types of brick. The brick veneer will use modular size face brick. The intent is to match the existing brick, which is a redish brown with some modulation in color. Contractor should obtain pricing from brick supplier for a range of options that may match and present those options for consideration during the submittal stage.
