Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C241-23-AP-1549, Direct Digital Control Building Management System components

1. Contracting Activity: Department of Veterans Affairs, VISN 01, Station 523, Facilities

Management Service, VA Medical Center Jamaica Plain, 150 South Huntington Avenue, Boston, MA 02130. The proposed procurement, Request for Proposal (RFP) 36C24123R0073, MATOC Seed Project 523-19-602 Install Site Security Campus Wide.

2. Brief Description of Supplies/ Services required and the intended use/Estimated

Amount: The justification is to support construction project 523-19-602 Install Site Security Campus Wide at the VA Medical Center Jamaica Plain, Boston, MA. This justification is for other than full and open competition for the procurement of certain construction materials.

The use of a particular brand name for the items listed below is a small portion of the construction materials requested to accommodate standardization of these items throughout the facility for the following:

Direct Digital Control (DDC) Building Management System (BMS) including components- American Energy Management (AEM). This system is VA Jamaica Plain Engineering’s Building Standard for the DDC HVAC BMS.

Estimated value: $19,727.33

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The items identified above in paragraph 2 have been standardized throughout the VAMC. DDC BMS including components-American Energy Management (AEM) is the existing building management control system installed and operating campus wide at the Jamaica Plain VAMC. Any products to be used on the existing HVAC BMS must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project needs to be provided by the same manufacturer as that of the campus wide system. Other manufacturer’s components will not not operate properly or operate at all on the existing system. The VA has service contracts that currently cover existing systems. It is cost effective for the new DDC system and components to be installed and maintained under the existing service contracts. Introducing other manufacturer’s products will void the existing DDC system’s manufacturer’s warranty. Therefore, only this manufacturer’s products are acceptable; no substitutions.

4. Description of market research conducted and results or statement why it was not conducted: The purpose of the site security project project is to improve security throughout the campus, not the current established DDC BMS system.The current system requires the same brandname manufacturer for system components. Any products to be used on the existing HVAC BMS must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project should be provided by the same manufacturer as that of the campus wide system. Other manufacturer’s components will not operate properly or operate at all on the existing system.

In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brandname; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small Business (SDVOSB) Set Aside.This justification for Other Than Full and Open Competition for brand name only will be posted to Contracting Opportunities with the solicitation.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-

1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the Contracting Officer will make a determination of fair and reasonable pricing prior to award.
