Section C.1.9 contains the following: ”Work beyond 80 hours in a 2 week pay period may be required on a surge/ad-hoc basis due to mission needs and must be approved by the COR. Any labor hours beyond 80 shall be billed at the TO FP/LOE rate. Overtime rates are not the responsibility of the Government.” Question: There appears to be a conflict in this section where the text implies there is only the TO FP/LOE rate with uncapped hours that places a financial risk on industry that we have no ability to predict and the Price Template includes columns for both Overtime Rate and Double Overtime rate. Question: Section C.1.13 states that “The Contractor may be required under individual TOs to provide light cargos and medium trucks. The contractor shall also have current Department of Transportation (DoT) certified fleet of vehicles and associated licenses to perform transportation of mail/goods/materials to include movement and transportation of hazardous materials across state lines as required. The service provider must have the DOT certificated fleet prior to the TO contract award.” Question: Is the Government’s intent that the contractor lease or purchase vehicles prior to task order award? Requiring contractors to acquire vehicles prior to award places a needless financial risk on the contractor while providing no improvement to task order performance. Will the government consider revising language to require contractors provide any required vehicles at the time of award? RFP Reference: IDIQ RFP Section C.1.13, page 20

Question: The RFP cautions against compensation levels lower than those of predecessor contractors for the same work. This information is not known to the offers except for the incumbent(s) of existing contracts providing these services. This may create a structural incumbent advantage.
Recommendation: Change the evaluation approach to evaluating the compensation levels relative to market norms and survey information which is publicly available rather than the specific compensation of incumbent contractors which is only known to them. Question: The RFP states that price competition will occur at the Task Order Level; however, the RFP provides no mechanism to permit IDIQ holders to selectively discount the maximum rates established at the IDIQ level based on the unique requirements and competitive environment for a specific task order. The RFP as it stands requires prime contractors to establish fixed labor prices at the IDIQ level and then bid those rates, unchanged, on seed task orders and task orders solicited after award. Both seed task orders require that bidders use their IDIQ rates to populate both task order pricing templates, and both task order RFPs intend to use price as an evaluation factor. If that is the Government’s intent, the firm with the lowest price at the IDIQ level will, by rule, have the lowest price on both seed task orders as both specify in great detail the labor mix – hours and labor categories are fixed. In other words, there is no possibility of price competition at all on task orders.
Recommendation: Add additional tables and formulas and any other necessary elements in Attachment 5, along with instructions in sections L and M, that allow submission and evaluation of subcontractor rates. This may take the form of composite rates or the FBI may choose to establish maximum IDIQ rates that contractors can choose to discount when bidding the seed task orders and any task orders solicited after IDIQ award. Alternatively, the FBI could choose to move price competition to the task order level by allowing bidders to establish maximum rates at the IDIQ level.
IDIQ price evaluation would then be limited to reasonableness and realism evaluations and IDIQ awards more reflective of technical capability. Seed task orders and any subsequent task orders would then be competed both on the basis of technical solutions and price.

The contractors are encouraged to bid competitive labor rates at the IDIQ level. The IDIQ labor rates are the maximum rates for the life of the contract, per L.-7.1. Each task order released against the IDIQ, will be competed among all IDIQ contract holders. Each task order will vary by technical requirment, labor categories, quantity of labor, and duration. Price is not the only factor evaluated at the task order level. Competition is possible.

The “IDIQ Attachment 5 Pricing Template” file has a Rates tab with a row per location for Fringe %.
However, for Service Contract Act (SCA) positions, fringe benefits do not equate to an equal percentage across all positions since, for instance, the $4.80/hr. Health & Welfare rate is a higher percentage of the component of fringe for a lower hourly paid SCA employee than for a higher hourly rate SCA employee. Thus the approach the government is using in the pricing sheet to calculate Fringe $ in the columns in each location site won’t work for SCA positions pricing. We noted that bidders can insert additional purple columns, please confirm that we could insert columns to show the rate build-up for SCA Positions versus Salaried positions. Fringe data can be a percentage on the dollar or a column can be inserted to provid frige.

This is a broad requirement that could range drastically in value. The Pricing Template incorporates the Travel costs into the Total Evaluated Price. Because the travel requirements are not defined,
1) Will the Government consider removing Travel costs from the Total Evaluated Price and instead modifying the contract in the future if travel is needed?
2) If no, will the Government provide further detail regarding the Travel Locations, Number of Travelers, and Length of Trips?

Attachment 4 Past Performance Questionnaire instructions indicate that only Section II shall be filled out by Offerors and provided back to the FBI with their proposal submittal. Within the IDIQ RFP Amendment 02, under L.5 Volume III: Past Performance – Factor 3 (page 109 of 118), it states the Offeror shall provide completed questionnaire(s) back to the FBI with their proposal submittal.
