SECTION M EVALUATION FACTORS FOR AWARD

M.1. WBR 1452.215-82 Evaluation Factors for Award – Quality Predominance – Bureau of Reclamation (Mar 2021)

(a) Award will be made to the responsible offeror submitting a proposal which conforms to the solicitation and is most advantageous to the Government considering the factors and any significant subfactors listed in this provision.

(b) In the evaluation of proposals, all evaluation factors (listed in this provision) other than cost or price, when combined, are considered to be significantly more important than cost or price.

The evaluation factors are listed in order of relative importance. However, the degree of importance of cost or price may increase with the degree of non-cost or non-price equality between the proposals. If a proposal is determined by the contracting officer to be "technically unacceptable" as a result of evaluating all factors other than cost or price, the proposal may be rejected from further consideration. The contracting officer reserves the right to make award to other than the technically acceptable offeror with the lowest cost or price proposal if it is determined that the technical benefits of another offeror's proposal justify its higher cost or price.

The contracting officer also reserves the right to make award to a lower-priced, lower-scored offeror if it is determined that the cost or price premium involved in awarding to a higher-rated, higher-priced offeror is not justified.

M-16

Since technical proposals are being solicited to obtain information to be used in the evaluation, the Government reserves the right to use information outside of the proposal to evaluate the capability of offerors and the value of offers.

(c) Pursuant to FAR 15.305(a)(1), a cost or price analysis will be performed to determine price reasonableness and any instances of unbalanced pricing, using one or more of the techniques at

FAR 15.404-1.

(d) The following factors and significant subfactors (if listed), will be considered in evaluating proposals and making the source selection:

1. General Technical Plan

2. Management Control Plan

3. Past Performance

4. Price

Evaluation Standards:

FACTOR 1 – General Technical Plan

Evaluation Standards:

• The Government will rate more favorably, Construction Schedules that address risk mitigation and allow for more opportunities for schedule recovery in the event of unforeseen site conditions or severe winter weather.

• Offerors that propose construction activities that do not comply with the restrictions provided in specifications Section 01 14 12 Work Restrictions and Limitations and

Section 01 14 20 Dam Operations and Unwatering will be a proposal deficiency for this evaluation factor. .

• The Government will evaluate the depth, completeness and effectiveness of the offeror’s proposed technical plan and construction schedule to ensure that the narrative demonstrates that the offeror, acting as the prime contractor understands the principal components of the work identified in the specifications.

FACTOR 2 – Management Control Plan:

Evaluation Standards: The Government will evaluate the depth, completeness and effectiveness of the offeror’s proposed management control plan to rate the offeror’s ability to accomplish required construction activities with multiple subcontractors within the required work windows. The Government will give greater consideration to information on those plans deemed most relevant to the effort described in this RFP.

FACTOR 3 – Past Performance:

M-17

Evaluation Standards: Past performance will be evaluated based on information received from:

1) responses to PPQs; 2) data independently obtained from the government and commercial sources (for example and not limited to, CPARS, FAPIIS, DUNS & Bradstreet Reports).

Offerors will be evaluated on the degree to which they have completed similar projects on schedule and the volume of performance issues. Information submitted regarding adverse performance problems will be considered, as well as mitigating circumstances.

The purpose of the past performance evaluation is to allow the Government to assess the offeror's ability to safely perform the work in a timely manner, and as required by the specifications, based on the offeror's demonstrated past performance history. Offerors without relevant past or present performance history, or whose performance record is so limited that an adjectival rating cannot be reasonably assigned shall receive the rating “Neutral," meaning the offeror is treated neither favorably nor unfavorably. During the evaluation of past performance, the Government may give greater consideration to information on contracts deemed most relevant to the effort described in this RFP.

FACTOR 4: Price Proposal: N/A for Technical proposal.

Evaluation Standards: The price proposal will be evaluated for price reasonableness in accordance with FAR 15.404-1 and any instances of unbalanced pricing. The total price to be evaluated is the total price of all CLINs (1 through 49) contained in Section B.
