About this file

This document outlines resource protection measures and schedule of changes for a solicitation to improve the wastewater treatment plant at Phantom Ranch in Grand Canyon National Park. The solicitation is issued by the National Park Service for short term improvements to the wastewater treatment plant, and includes measures to protect park resources such as timing restrictions on vegetation removal and archaeological monitoring. Additional requirements address avoiding impacts to Mexican spotted owls, condors, and other wildlife through restrictions on equipment use and construction activity near nesting sites. The schedule of changes includes adding provisions for daily site cleanup, use of wildlife-proof trash receptacles, and compliance with migratory bird regulations. Flights transporting contractor personnel are limited to start and end of work days except in emergencies.

1. ADD paragraph 1.4.G as follows:

G. Resource Protection Measures: The Contractor shall comply with the following measures required to protect park resources.

1. Vegetation removal shall not occur between early-April and mid-August.

2. Archaeological monitoring is required for all ground disturbing activities. Monitoring will be provided by the Government.

3. Light and heavy construction equipment shall not be used within 0.5 mile of Mexican spotted owl nest/roost sites nor within 0.5 mile of condor nesting activity. The

Contractor will be entitled to an equitable adjustment if work is impacted by this requirement.

4. Project staff shall avoid interaction with condors and contact park staff if condors visit the project site. Outdoor construction activity will cease until condors leave the site. The

Contractor will be entitled to an equitable adjustment if work is impacted by this requirement.

5. Project site shall be cleaned up at the end of each day to minimize the likelihood of condors or other wildlife visiting the site.

6. Project staff shall not disturb any wildlife species (reptiles, migratory birds, raptors, or bats) found nesting, hibernating, estivating, or otherwise living in, or immediately nearby, worksites. The Contractor will notify the Contracting Officer if any wildlife species are observed at the worksite. Contractor may continue work unless it is determined to cause disturbance to wildlife. Minor interruptions will not be considered as a delay. The

Contractor will be entitled to an equitable adjustment if his work is stopped or adversely impacted for ½-hour or more.

7. Trash and recycling receptacles will be wildlife proof certified.

8. Grand Canyon’s Parkwide Spill Response Plan will be used by the Contractor.

9. For all trenches or excavations, provisions (generally in the form of ramps; with a slope <

45o) must be made every 20-50’ to allow for the escape of animals that may fall in, or they must be covered.

10. Contractor shall keep any open water in the WWTP area always covered when work is not actively in progress to prevent animals from falling in or landing. This provision applies to any exterior open water which for this project is expected to be the new or existing headworks structures when they have water in the tanks.

11. Contractor shall comply with the Migratory Bird Treaty Act [16 USC 703]. Any active bird nest shall be left in place and undisturbed until the young hatch and depart.

12. Contractor shall promptly collect and remove small construction/demolition debris.

2. DELETE paragraph 1.10.B and REPLACE with the following:

B. Photos will be provided showing surface conditions at the site of earthwork.

Section 01 65 50

3. ADD paragraph 3.5.B.2.a.4) as follows:

4) Except for cases of emergencies and crew safety, personnel flights will take place only at the start and end of each work tour and may be combined with other personnel flights to minimize the total number of flights. Combining of flights will not be done in a way that reduces the allowable capacity for Contractor personnel transport.
