About this file
This is a Questions and Answers Log for Solicitation No. 140A1626R0014, a Bureau of Indian Affairs construction project for CRIP Main Canal Checks and Lateral 73 Construction. The Q&A document addresses seven inquiries submitted by potential bidders between April 1-4, 2026, covering technical clarifications, contract structure, and logistical matters.
The responses clarify several critical contracting issues: the pricing schedule for CLIN 4 has been updated from unit-priced to Lump Sum basis for items 401-418, and FAR 52.211-18 (Variation in Estimated Quantity) has been added to address estimated quantities in CLINs 403, 404, 406, 407, 411, 412, 415, and 416. Technical answers confirm grading point elevations at 309.80 feet for points 84-85 and provide missing construction limit point coordinates (1059554.70 N, 505865.11 E). CLIN 419 remains in the contract with post-award quantity variations for concrete on a Cubic Yard basis determined by final pole-reaction calculations, with FAR 52.211-18 protections now applied. Section M regarding small business goals has been revised with additions noted in red font in Amendment 0001. Site access coordination is available through Manuel Ramirez (928-669-0305) or Clarence Begay (520-251-3889), and no official site visit was conducted, though individual visits can be arranged. All revised documents and the complete FAR clause requirements have been included with Amendment 0001.

Sheet1 Questions and Answers Log for Solicitation No. 140A1626R0014, CRIP Main Canal Checks and Lateral 73 Construction
| Number | Question | Answer | Date Answered | |
| 1 | On drawing set B08_A12_DRAWINGS_LATERAL_73_IFC on sheet G03, is there a missing construction limit point between points #24-25, there is an angle change shown east of station 71+00. | The angle change between construction limit points 24 | ||
| and 25 has the coordinates 1059554.70 N, 505865.11 E. | 4/1/26 |
2 On drawing set B08_A12_DRAWINGS_LATERAL_73_IFC on sheet C08, based on the excavation contours are points #84-85 supposed to be elevation 309.80. in addition, based on detail a/c08 it looks like it is 309.8 across the bottom of that excavation. The intended elevation of grading points 84 and 85 is 309.80 feet. 4/1/26
3 Bid Additive #1, CLIN 4, includes estimated quantities for the following CLINs: 403, 404, 406, 407,411,412,415, and 416. However, FAR 52.211-18, Variation in Estimated Quantity is not included in the solicitation or resultant contract documents. Per FAR Part 11.703 (c), the contracting office shall insert clause at 52.211-18, Variation in Estimated Quantity, in solicitations and contracts when a fixed-price construction contract is contemplated that authorizes a variation in the estimated quantity of unit-priced items. Please clarify this clause was mistakenly omitted and/or how the CO will address any potential overruns/underruns of these variable quantity items without the inclusion of this mandatory clause. The pricing schedule for CLIN 4 has been updated to describe bid items 401 through 418 on a Lump Sum basis.
FAR 52.211-18, Variation in Estimated Quantity, has been added to the solicitation/RFP.
4 Bid Additive #1, CLIN 419 introduces post-award quantity variation (additive or deductive adjustments in concrete on a Cubic Yard (CY) basis determined by the final pole-reaction calculations) into an otherwise firm-fixed price (FFP) contract. This Offeror believes this creates undue risk to the contractor because: • Foundation sizing is not fully defined until after award (contractor-developed structural calculations and shop drawings), effectively incorporating a limited design-build element; and
• Without FAR 52.211-18 or clear equitable adjustment triggers, adjustment would be limited solely to the pre-priced CLIN 419 unit rate under Section 01 29 00, even for material variations. The Offeror therefore request the Government's consideration of the following remedies:
1. Elimination of CLIN 419 entirely, with all foundation quantities governed by CLIN 403 (1 Lump Sum) price and any variations handled as changes under FAR 52.243-4 Changes; or
2. Confirmation that any material quantity variation under CLIN 419 will be treated as a change under FAR 52.243-4, entitling the Contractor to an equitable adjustment for direct, indirect, schedule, and productivity impacts beyond the direct application of CLIN 419 unit price (and, if added, under FAR 52.211-18).
| This clarification will allow the Offeror to price Bid Additive #1/CLIN 4 in a manner that is fair, reasonable, ad fully supportive of BIA's objectives for MC420 project. | Item Number 419 under CLIN 4 will not be removed. The pricing schedule for CLIN 4 has been updated per the response to Question #3. FAR 52.211-18, Variation in Estimated Quantity, has been added to the solicitation/RFP. In addition, Item Number 320 (CLIN 3) has been removed from the Pricing Schedule in B08__A01_Pricing_Schedule.pdf and Section 012900 – Payment Procedures in B08__A05_Specifications_MC420_IFC.pdf. These revised documents are included as Attachments with Amendment 0001. All FAR Clauses/Provisions included in Solicitation 140A1626R0014 remain applicable. | 4/1/26 | ||
| 5 | Section L.6.2.1.5 of the referenced solicitation states that the small business goals of this procurement are listed in Section M: Evaluation Factors for Award. Section M does not specifically state what the current goals are for this project. Can you state what the intended goals are so that we can navigate how we will meet the requirements? | Section M: Evaluation Factors for Award has been revised and has been included with Amendment 0001. Additions/revisions are in red font color. | 4/1/26 | |
| 6 | We are bidding the project, and I was wondering if it would be acceptable to visit the site later this week. Is this site open to the public? Please let me know. | Access to project sites may be allowed by first coordinating with either Manuel Ramirez (phone: 928-669-0305, e-mail: Manuel.Ramirez@bia.gov) or Clarence Begay (phone: 520-251-3889, e-mail: Clarence.Begay@bia.gov). |
| If you have any technical question(s)/RFI(s) during these site visits, please make a note and then submit your question(s)/RFI(s) in writing to the Contracting Officer. | 4/1/26 | |||
| 7 | Do you have a plan holders list or a site visit list for this job? We’re a metal fabrication company. | No official site visit was conducted for this solicitation/RFP. However, you may contact Manuel Ramirez or Clarence Begay as noted in Answer #6 for information regarding site visits by contractors. | 4/1/26 |
