About this file
This document is a Questions and Answers (Q&A) file issued by the Oregon Department of Transportation (ODOT) Procurement Office for Request for Proposal (RFP) #73000-00013144 related to a Statewide Cultural Resources Price Agreement. The RFP seeks professional services firms to establish Price Agreements for cultural resources services across three regional categories: Region 1, Region 2, and Regions 3, 4, and 5 combined. ODOT intends to award one Price Agreement per region, with proposals due on November 5, 2025, following a pre-proposal conference on October 13, 2025. The initial contract term will be a two-year Work Order Contract assignment period, potentially extendable for up to three additional years.
The solicitation is a qualifications-based selection process with no direct pricing component. The collective maximum not-to-exceed amount for all Price Agreements is estimated at $2,000,000, with funding primarily from the Federal Highway Administration (FHWA). For state-funded Work Order Contracts exceeding $100,000, there is a 12% Certified Small Business Aspirational Target, while federally-assisted contracts will have a 23.43% Disadvantaged Business Enterprise (DBE) goal. Proposing firms must have personnel meeting the Secretary of the Interior's Standards for Archeology and Architectural History and possess at least two ODOT-qualified personnel. Billing rates will be negotiated for Work Order Contracts exceeding $250,000, with ODOT implementing a new Billing Rate Policy for contract management.

Questions and Answers #1 Q1 Request for clarification on the intent of Price Agreements to be awarded through this solicitation. Does it mean that only those who are awarded Price Agreements will be able to bid on future ODOT contracts for the life of the Price Agreements?
Response: The intention of the Price Agreements is for Work Order Contracts (WOCs) to be assigned to the Price Agreement holders for that particular region. For example, Region 1 can award a WOC to the Price Agreement holder for Region 1 and would negotiate a WOC with them. ODOT may still enter into ORS 190 Agreements or consider other firms if needed for similar services by separate contract. The Price Agreements will provide for an expedited WOC assignment method. See Attachment A, Sample Price Agreement, Exhibit F, Section 1.1.
Q2 Can we have a copy of the Subcontractor Solicitation and Utilization Report (SSUR)?
Response: Yes. The SSUR can be located here:
https://www.oregon.gov/odot/business/ocr/pages/forms.aspx
Q3 There is a 12% Aspirational Target for WOCs. Do proposing firms need to include those firms in our proposal?
Response: It is up to each Proposer. Aspirational targets would apply to any WOCs that are State funded only, and do not have federal funding. ODOT anticipates that most, if not all, WOCs that will be issued from the Price Agreement(s) will have federal funds. Proposers may choose how to respond to each evaluation criteria.
Q4 Will rates be negotiated for each work order contract?
Response: ODOT is currently in the process of implementing a new Billing Rate Policy that would apply to any WOC that exceeds $250,000.00. Billing rates will need to be established for any WOC that exceeds $250,000.00. After notice of Intent to Award, there will be further discussion with the successful proposers related to the new Billing Rate Policy and the application of the new Billing Rate Policy to WOCs under this Price Agreement series. This RFP is solely a qualifications-based-selection, and does not include a price component in the evaluation criteria. This may impact the application of the new Billing Rate policy.
Q5 Will there be only one awardee for each region?
Response: Yes, pursuant to RFP Section 1.1.2, Agency intends to award PAs for the following PA Categories:
· 1 PA for ODOT Region 1 projects;
· 1 PA for ODOT Region 2 projects; and
· 1 PA for ODOT Region 3, Region 4 and Region 5 projects.
Q6 Would ODOT select the same firm for more than one regional Price Agreement?
Response: It is possible that the same firm may be awarded more than one regional Price Agreement. Please refer to RFP Section 2.3 Method of Award.
