About this opportunity

Utah State Board of Education is requesting proposals for external, independent investigators to serve the Utah Professional Practices Advisory Committee (UPPAC) under RFP USBE-MI27022-RFP, with proposals due September 12, 2026. Multiple awardees are anticipated; no guaranteed work volume is stated.

Investigators will be assigned on a rotating and random basis to conduct investigations into educator misconduct, background check issues, and licensure reinstatement matters. The scope requires investigative planning and case assessment, evidence gathering and interviews, attendance at monthly UPPAC meetings, and delivery of comprehensive written investigative reports to the UPPAC Executive Secretary at least five days before each monthly meeting. Investigators must demonstrate substantial experience conducting in-depth investigations and writing investigative reports consistent with these requirements, plus documented experience in educational law. A writing sample of no more than ten pages from prior investigative or relevant work is required. All investigators must disclose potential conflicts of interest, including current or anticipated representation of schools, school districts, or charter schools, or involvement with the Board during the next five years, and explain conflict resolution if awarded.

The maximum contract budget is $350,000 for the initial term through June 30, 2027, with potential for four additional one-year renewal options at USBE's discretion. Offerors must propose an all-inclusive hourly rate. Travel costs outside Salt Lake County require advance authorization. Cost proposals exceeding the $350,000 maximum will be deemed non-responsive.

Technical evaluation comprises 71 percent of total points (250 points); cost comprises 29 percent (100 points). Minimum passing score is 227.5 points out of 350. Cost is evaluated using a formula where the lowest-cost proposer receives full cost points; proposers exceeding 200 percent of the lowest cost receive zero cost points.

The Standard Terms and Conditions require commercial general liability insurance of $1 million per occurrence and $3 million aggregate; if handling data, contractors must maintain protected information and cyber liability insurance of $1 million per occurrence and $2 million aggregate. Contractors must comply with FERPA, NIST 800-53 security standards, and maintain network security conforming to GovRAMP requirements, with all data stored and processed exclusively within United States data centers using encrypted transmission. Confidentiality requirements and strict FERPA compliance are mandatory.
