About this file
This is a GRAMA Claim of Business Confidentiality form submitted pursuant to Utah Code Section 63G-2-305(1) and (2) in connection with the Utah State Board of Education (USBE) Request for Proposals for Utah Professional Practices Advisory Committee (UPPAC) Investigators, Solicitation # USBE-MI27022-RFP. The form allows companies submitting proposals to assert claims of business confidentiality over sensitive information including non-public financial statements, specific employee names and contact information, customer information, client lists, and subscription lists. Companies may invoke this protection when information qualifies as a trade secret under Utah Code Section 13-24-2 or constitutes commercial information or non-individual financial information where disclosure could result in unfair competitive injury to the submitting party or impair the governmental entity's ability to obtain necessary information in the future.
The GRAMA form requires the submitting company to provide a concise statement of reasons supporting the business confidentiality claim and must be signed by an authorized company representative with the date and company name. The form references the Utah Government Records Ombudsman office and provides links to relevant Utah Code sections governing trade secrets and GRAMA claims. This protective mechanism enables vendors responding to the UPPAC Investigators contract opportunity, which seeks external independent investigators for hearings on a rotating basis with contract terms running through June 30, 2027, plus four optional one-year renewals, to maintain confidentiality over proprietary or sensitive business information during the procurement process.
