About this opportunity
The Utah State Board of Education (USBE) is publishing a notice of intent to award a sole-source contract to the Utah Afterschool Network (UAN) for afterschool program quality assessment and technical assistance services without engaging in standard procurement, with a challenge period closing September 22, 2026. This is a Part 8 exceptions award under U.C.A. 63G-6a-802, justified on the grounds that UAN is the only organization in Utah holding Weikart Forum certification for Program Quality Assessment Tool observations, providing both customized in-person professional development and technical assistance to 21st Century Community Learning Center grantees.
The scope spans professional development and learning systems for afterschool staff across all USBE 21st CCLC grantees serving over 45,000 youth statewide. Deliverables include a blended learning professional development system (annual statewide conference, regional training, eLearning Institute, topic-based sessions, professional learning communities); quality improvement mentoring and technical assistance through Afterschool Consultants to 21st CCLC programs; Salesforce database administration and data system support through a dedicated Data Specialist; and development and enhancement of a Quality Improvement Model using Program Quality Assessment tools. UAN will provide office space, equipment, and resources supporting hybrid work arrangements and will reimburse authorized staff travel and cellular expenses. Monthly observation and site-visit reports and annual reports due June 20 are required, documenting program quality improvements, professional learning events, attendee numbers, and impact reports.
The contract value is $1,298,875 over five years ($259,775 annually) from July 1, 2026 through June 30, 2031, with annual amendments anticipated. USBE conducted market research contacting other organizations in the afterschool field and conducted online searches; none identified competing sources capable of delivering both required in-person services and Weikart Forum certification. Vendors wishing to challenge may submit documentation through the Utah Public Procurement Place Supplier Portal during the notice period demonstrating alternative competing sources and comparable or superior capability.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Utah State Board of Education (USBE) is publishing this notice in accordance with the Utah Procurement Code and, as authorized by U.C.A. § 63G-6a-802, intends to award a contract without engaging in a standard procurement process if it is determined by the Head of the Procurement Unit for USBE, in writing, that: *There is only one source for the procurement item; *Transitional costs are a significant consideration in selecting a procurement item and the results of a cost-benefit analysis demonstrate that transitional costs are unreasonable or cost-prohibitive, and that the award of a contract without engaging in a standard procurement process is in the best interest of the procurement unit; *The award of a contract is under circumstances, described in rules adopted by the board, that make awarding the contract through a standard procurement process impractical and not in the best interest of USBE; *The procurement item is intended to be used for, or in connection with the establishment of, a state store, as defined in Section 32B-1-102. In the Files section, USBE has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files. Identification of Other Qualified and Interested Vendors The purpose of this notice is to determine if there are any other interested and qualified vendors that meet the specifications of this notice. Any such vendors wishing to challenge the proposed award must submit the following information: *The name of the contesting person; and *A detailed explanation of the challenge, including documentation showing that there are other competing sources for the procurement item; *Documentation that your firm can provide a comparable or better procurement item that meets or exceeds the specifications; *Documentation that your firm can also provide the same proprietary procurement item or an equivalent procurement item; and *If transitional costs are identified as the justification for this notice, a comparison of the transitional costs identified in this notice against your firm's anticipated transitional costs. Regardless of any prior communications with USBE, all vendors interested in responding to this notice must submit a response to this posting containing all of the information requested above. THIS NOTICE IS NOT A REQUEST FOR PROPOSALS, INVITATION FOR BIDS, OR REQUEST FOR QUOTES. No action is required if you have no objections to the proposed award. ALL CHALLENGES TO THE PROPOSED CONTRACT AWARD MUST BE SUBMITTED THROUGH THE UTAH PUBLIC PROCUREMENT PLACE PORTAL, and any questions regarding this notice, including requests for additional information, must be submitted through the Public Procurement Place Portal during the public notice period. If, after the public notice period has passed, the Head of the Procurement Unit determines that there are other interested and qualified vendors that meet the specifications of this notice, USBE will not award a contract pursuant to this notice; otherwise, if no valid challenges are received, then USBE may award a contract to the identified vendor without engaging in a standard procurement process. Please read the entire form very carefully before responding to this notice.
